The undersigned hereby further covenants and agrees with the Town of North Andover, upon approval of said DEFINITIVE plan by the Boards 1. To install utilities in accordance with the rules and regulations of the Planning Board, the Public Works Department, the Highway Surveyor, the Board of health, and all general as well as zoning by—laws of said Town, as are applicable to the installation of utilities within the limits of ways and streets; 2. To complete and construct the streets or wars and other improvements shown thereon in accordance with Sections 'Iv and V of the Rules and Regulations of the Planning Board and the approved DEFINITIVE plan, profiles and cross sections of the same. The following members were present and voting: Paul R. Lamprey, Chairman; William N. Salomme, Vice—Chairman; William Chepulis; and John J. Monteiro. Frank C. Colinas, Engineer, represented the developer, Scott Properties, petitioning for a subdivision of a parcel, of land containing approximately 18 acres of land and consisting of 12 lots, situated, off Boston Street to be mows as "Paddock Estates". � Mr. Gelinas informed the Board that this subdivision is located across from the "Wplow Ridge" subdivision, has no communal water or sewerage, has two minor intermittant ! streams, is on the watershed of the Soug River, the drainage is basically at the inter— section of Boston St. and Paddock Lane (2 catch basins) and the predominant amount of Stater flows through the 30 in. culvert at Lot //I. He added, that there is no practical place to put a dry hydrant with an impoundment area. All lots have 150 ft. frontage and conform to the Zoning By—Lair, A discussion took place regarding the availability of water for fire protection. No persons were recorded as opposed, but Mr. Bruce Horton, 8 Olympia Way, Andover voiced concern about drainage on or near Lot #7. , At a meeting held on June 6, 19*17, Member Chepulis made a motion to approve the proposal. Mr. Salemme seconded the motion. The vote was as follows: Messers Chepulis, Salemme and Lamprey in favor, Mr. Monteiro opposed. The subdivision was approved subject to the following conditions: 1. That the record owners of the subject land forthwith execute and record a "covenant � running with the land", or otherwise provide security for the construction of ways and the installation of municipal services within said subdivision, all as provided by G. L. c, 411 sec. 81—UU. 3 r Paddock Estates Decision .2- .2. That all such construction and installations shall in all respects conform to the governing rules and regulations of this Board. That the 20 ft. drainage easement on Lot ,#E5 shall be extended to the end of the lot. 4.`� That the stations be shown on the plan from the proposed road. 5. V/That the size of the lots shall be stated in square feet. 6� That a 20 ft. drainage easement be shown on the westerly side of Lot #7 for the entire length of Lot #7. _ 7. That the Highway Department letter shall be incorporated into this approval except for the statement which reads "This subdivision should connect with Cray St. if at all possible". 8. That a 20 ft. drainage easement shall be shown on the southeasterly side of Lot #t`1 from the entrance of the culvert that crosses Boston St. in order to acoomodate the drainage pick-up by catch basins at intersection of Paddock Lane and Boston St. 9. That significant trees shall not be removed, damaged, or destroyed. 10. That, if existing, the ponding area shall be shoim on Lot #/7. 11. Percolation tests shall be certified by a registered professional engineer. 12. That no work shall be done in the subdivision until security in the form of a bond or covenant has been duly recorded and the plans are signed and recorded. That all fire protection improvements shall be constructed in accordance with the standards of the Board of Fire Engineers, 14.
