Dear Mr. Bourgeois:
This letter is in response to your letter dated January 14, 1987
with respect to a potential abatement .of taxes for these lots if they
are declared "unbuildable" by the Conservation Commission. , The NACC
had not forgotten your earlier request, but felt we had to develop a
general policy on this issue rather than react to individual requests
on a case-by-case basis.
Specifically, we need to address how we protect a piece of
property from future development (as of example, through conservation
restrictions) before we recommend any abatement of taxes. We also need
to address the issue that a piece of land is not "unbuildable," but
rather that under current regulations it would not receive approval for
building. We are in the process of investigating these issues in order
to establish a general policy, and will be responding to your request
as soon as we have such a policy.

Roadwa Completion
Dear Karen:
Recent Special Permit Applications by Channel Building Company have
precipitated inquiries by Planning Board members, Fire Chief Dolan, and the
North Andover Conservation Commission as to the status of roadway work in the
Business Park. Work remaining for pratical purposes consists of completion
of the base paving, utility connections at the cul-de-sac at the end of
Bayfield Drive/Route 125 and final paving of the subdivison roadways.

The development is close to being built-out, and Mr. Osgood's timetable
accordingly calls for completion of the roadway work during this construction
season. Of necessity, the utility and base paving work at the cul-de-sac is
the first step, and this work has been delayed somewhat by the Enforcement
Order from the North Andover Conservation Commission and, more recently,
while Mass. Electric obtains an updated permit from the State D.P.W. to make
permanent connections in the Route 125 R.O.W. Mr. Upham of Mass. Electric
informs me that this permit application has been filed and is customarily
granted in several weeks time. This would place 114 Associates in a position
to start work.
As concerns conditions adjacent to the Willows Racquet Club, the potholes
there have long been patched. Final paving at this location will be done
with the rest of the roadway.

This note is a follow-up to our discussions at the January 27th meeting of the
NACC on the above referenced subdivision.
First let me reiterate that the NACC has no discretionary powers that we can use
to allow "extra" wetland filling In order to achieve the connection between these
two streets that we all agree would be of benefit to the Town. The wetland
regulations under the Act that we use as minimum standards have performance
standards that allow D_Q filling of bordering vegetated wetland resource areas
(Section 10.55 (4) (a) of the regulations). A commission is only given
discretionary powers to allow filling by exception up to the 5,000 square feet
limit (Section 10.55 (4) (b)).
The only case where more filling can be allowed Is for a "limited project." Such a
project is defined as one where reasonable alternatives for access are unavailable
(Section 10.53 (3) (e)), Clearly for this project reasonable alternatives exist,
although they may not be the best from the Town or developer's point of view.
There are three ways in which a connecting road may be approved under these
regulations. These include:
1 . The connecting road could be constructed to cross the wetland areas at
Its narrowest point if its alignment took it through the Ogan Foods
parking area. This would obviously be the preferred alternative from
our point of view.
2. The road might also meet the performance standards for bordering
vegetated wetland resource areas if a detailed wetland survey showed
that less than 5,000 square feet of this particular type of wetland was
affected. This would obviously take some field Identification and
survey work to determine. Moreover, we would want to review the
plans and calculations on which these numbers were based very
carefully to insure that the wetland resource areas were classified
properly. [We recently denied the Jared Estates - Phase 11
subdivision because we disagreed with the wetland classifications.]

3. A third possibility is to request a variance from the regulations from
the D.E.Q.E. Commissioner as allowed for under Section 13.58 of the
regulations. This request might fall since it has a "no reasonable
alternative" test life the limited project exception mentioned above.
As we mentioned at our meeting, we have no objection to establishing a connection
between Bayfiled Road and Route 125 in order to solve some of the traffic
circulation problems in the North Andover Business Park subdivision. We would
be happy to support an application to the state for a curb cut to do this.
