Re: Kara Drive Subdivision (formerly Mills Hall Estates)
Board Members:
In accordance with the Rules and Regulations Governing theSubdivision of
Land, Town of North Andover, Massachusetts, 1981, and the Order of Conditions,
"Mills Hill Estates" Preliminary Plan of Land dated November 17, 1982, and on
behalf of my clients, the applicant, Muskabby Realty Trust, enclosed are four (4)
copies each of forms C, D, E, I and S, and twelve (12) copies each of:
1. Definitive Plans, [Zara Drive, three (3) sheets, by Andover
Consultants Inc, dated June 8, 1983
2. Definitive Plans - Construction, Kara Drive, eleven (11) sheets,
by this office dated June 8, 1983
3. Plan of Environmental Impact, Proposed Site Grading and Erosion/
Siltation Control by this office, dated June 8, 1983
4. Definitive Study, by this office, dated August 18, 1983,
all pertaining to the referenced subdivision. Also enclosed is a check, payable
to the Town of North Andover, in the amount of $3,375.00 as prescribed by Town
regulations. A separate check in enclosed for notification, postage and/or
advertising. Please process these documents as the Definitive submission for
the Kara Drive Subdivision.
A Notice of Intent has been submitted to the North Andover Conservation
Commission for the work at 50 Jay Road, three (3) copies of which are also en-
closed. Previously, the Commission found that the subdivision was not within
the jurisdiction of the Wetlands Protection Act. As discussed and substantiated
in the Definitive Study, we are requesting relief from the stipulations of
Condition #28 of the Order of Conditions governing the Preliminary Plans.
Please contact this office should questions or comments arise concerning
this submission, and when the subdivision is scheduled for discussion. Thank
you for your anticipated cooperation in this matter.

Proposed Kara Drive Subdivision

1 am representing Joseph J. Flynn as Trustee of Muskabby
Realty Trust in connection with the proposed land development
known as the Kara Drive Subdivision.
On November 21, 1983 the North Andover Planning Board
approved the proposed Kara Drive Subdivision.
On December 12, 1983, a Complaint filed with the Superior
Court was received by the Town Clerk against the Planning
Board and its members . This Complaint concerns the decision
of the Planning Board regarding their approval of the proposed
Kara Drive Subdivision.
My client , Muskabby Realty Trust , has a vested interest in
the proceedings and resolution of this case . The developer has
not been named a party in this case . However, in representing
the developer, I am in a position to be knowledgeable of the
issues concerned in this case as they affect the Town and the
development of this land .
I respectfully request your approval to file an Answer to
this Complaint and to represent the Planning Board in this case .
There will be no cost for my services to the Town of An-
dover. I will further immediately notify your Board, the
Planning Board, and Town Counsel should any matters, issues,
or legal proceedings place the Town in a compromising legal
position or in any manner adversely affect the Town or its
Boards .
