The fire department does not object to this arrangement for the following reasons: • The roadway is to terminate at the hammerhead. • If the roadway were to be extended it would be brought to Town road standards. • The present road has been widened and provides access for fire department vehicles. • The 10"water main has been extended with new hydrants installed. • The hammerhead would provide sufficient area if maintained in all weather conditions for the fire department apparatus to turn around one at a time. We would also request that this residence be required to have a residential sprinkler system installed as part of the order of conditions for this project. Please contact either Lt. Currently this stretch of Winter Street i�, a 4ravel road and therefore not maintained by the town , The fina; Product of Winter Street as specified by the Phase 3C Sewer Pxoje= ~. u.ill be a gravel road similar to its present condition . Sewer stubs to existing homes and vacant lots will be installed, which will create the potential for some lots to be developed, Development of t.-.hese lots should require construction of a roadway with sufficient: width,, grade and construction as outlined in the town' s rules alid regulations . Winter Street cannot be made a thruway to Great F;3nd Road, therefore a cul-de-sac will also be required and tho lcts will have access from South Bradford Street only. Answer Yes , in my opinion according to the attached information , Winter Street from Great Pond Road to South Bradford Street is either a Town way or a private town way, however, the Town of North Andover has no obligation to maintain or to keep all or any part of this way in repair. .issue: Can this portion of Winter Street be used as a way for the purpose of development of land along said Street. Answer: Subdivision control may be avoided if it can be shown that this portion of Winter Street was in existence when the subdivision law became effective in North Andover, and further, in the opinion of the North Andover Planning Board , if this section has sufficient width, suitable grades and adequate construction to provide for the needs of vehicular traffic in relation to the proposed use of the land, and also for the installation of municipal services to serve such land and the buildings to be erected thereon . Facts: A. Maps and Plans, All plans , unless indicated , are recorded at the Registry of Deeds. 1 . Winter Street from South Bradford Street to Great Pond Road is shown on the old plan mounted at the Town Clerk' s office. 2. Plan 2496 shows this portion of Winter Street but notes it is "discontinued. " 3. Plan 5970 shows Winter Street as a boundary. . 4. Plan 7437 shows Winter Street to scale measuring approximately 30 feet in width. This plan notes Winter Street as "abandon. " 5. Plan 7436 shows Winter Street but it is not named. Also, Frank G. Gelinas decided to place the boundary to the middle of Winter Street. 6. Plan 9390 shows Winter Street with an opening onto South Brad- ford Street. 7 . Plan 7548 shows Winter. Street. The plan notes Winter Street as "abandon. " ,[)AND CgI1t-N 8. Assessor' s Plan, Sheet 103, shows Winter Street with no notations RNFYS AT LAW and further opening onto both South Bradford Street and Great F1ManuAHE Pond Road and Bridle Path. VHH.NIA UIa I(} 9. Official Town Map shows dotted lines indicating where Winter 11 Street would connect South Bradford and Great Pond Road. - I B. Town Records, I . Official Town Street Card shows this portion of Winter Street as being "public" until Town Meeting of 1930, 2. In Article 31 of the March 1930 Town Meeting Warrant, a copy Of which is on Page 16 of the Annual Report, there was a pro- posal to the voters either to discontinue as "town ways or private town ways" the following section of "streets or ways in town" - the list includes "Winter Street from Great Pond Road to South Bradford Street ," or in the alternative to discontinue maintenance of said streets and ways . Y It is important to note that in 1930 this section of Winter Street was identified as a "Town way or private Town way. " It is also important to note that it was voted NOT to discontinue these streets or ways but only NOT to keep them in repair. C. Deeds recorded at Registry of Deeds of abutters. I . Book 381 , Page 668. Original deed into Naruszewicz. Fourth Parcel , Rose Meadow, is locus. Spofford Road is our section of Winter Street, probably named after Spofford Woodland at inter- section of Winter Street and Great Pond Road, see plan 2496. Description states "bounded northerly by Spofford Road. . . . . " 2. Book 842, Page 97 . Description uses Winter Street section as bound. Notes Winter Street was formerly Spofford Road, Indicates long use as a read and access. 3. Kook 816, Page 405, and Book 984, Page 175 state as a bound "a discontinued roadway once known as Winter Street. " 4. Book 1315, Page 746. States Winter Street as a bound. Same as Book 842, Page 97 above. 5. Book 1896, Page 49. States Northerly and Northwesterly bound as Winter Street. This is Santo Messina deed . The Law: Research as indicated herein finds that at no time was this section of Winter Street either discontinued as a public or private way or street or was abandoned . This section still appears on Town maps and in Town records , although in varying dotted line forms. This section still appears as boun- daries in deeds and on plans of record. The official Town meeting vote was only to not maintain this section of Winter Street, It is an established rule of law that an owner whose property is bounded by a way which connects at each end with a road leading to a highway A11050 AND colt ICN is entitled to have access going tin either direction , if all roads appear AEi'f)ItIJFVSAILAW on a plan . L.A. c. 183, Sec . 58 ''every instrument passing title to real estate abutting a way, whether public or private, . . , shall be construed to include any fee interest of the grantor in such way. . . '' In this case there is the right of access to pass and repass . The public's right: to pass and repass and the abutting land owner' s rights of access do not appear to Have been extinguished, discontinued, or abandoned by the town or, any of the landowners. The Town , through its planning board , has the authority to determine that a way of varying with an acess onto a public road of a width less than 50 feet, may still be used for the development of land along that way. In North Andover, usually Mr. Cyr will make a recommendation as to the suitabi- lity of the way to accommodate the needs of vehicular traffic and municipal service and whether said way and bottleneck access has sufficient width, suitable grades , and adequate construction . North Andover requires a 50 foot width, but will accept a 40 foot width. It will be necessary to apply for a waiver, at both access points , to the 30 foot width shown on the recorded plans. Therefore, the Planning Board has the authority to grant a Corm A, if in its discretion it votes to waive the 50 foot width requirement for this street. However, the Planning Board may require, as a contingency to its approval , that this portion of Winter Street be improved to meet Town standards as the suitability to accommodate the needs of vehicular traffic and municipal services , It is important to note that except for that portion of Winter Street having access onto South Bradford and Great Pond Road , the middle portion of this road abuts land owned by Mr. Messina enabling this section to have a constructed width according to the Planning Board ' s decisions . a CAMJ50 AND Col W-•! Date: December 27, 2000 Re: Hammer Head Turn—a—Round Winter Street Subdivision On the Winter Street Subdivision developed by Ann Messina a problem has recently arisen. I have just been made aware that our recycling truck cannot turn a round in the designed location. It appears that the grade may be too severe. I was also informed that the trash pickup truck has been backing down Winter Street, I have not to this date been able to confirm the cause for their backing up and not driving down the street and using the hammerhead. Chief Dolan is on vacation until January 2, 2001. 1 will contact him then and find out if the Fire Trucks and Emergency Vehicles can turn around satisfactorily. Please call if you have any questuins. As I mentioned the contractor has installed the water line and hydrant, leaching eatchhasins and piping, and the roadway has been rough graded to subgrade. Minor changes were necessitated as a result of Mass. Electric poles and discussions with the neighbor. The changes will consist of the following: The 2'-3' of rip rap along the edge of pavement will be reduced to l'-2' in some locations. This was necessitated by the placement of utility poles after the approval of the plaits and the narrow width (i.e. 25') of Winter Street in a few locations. The twenty feet of pavement will be maintained as specifically required by the DPW. The profile of Winter Street will be less steep from approximately station 7+50 to 11+00. The original Platt called for a slope of almost eight percent. By coordinating the grading with the abutter, the contractor is able to construct a less steep slope of perhaps 4-5 percent. The result will be a roadway that is safer for vehicular traffic. These minor changes will not, in my opinion., change the intent of the approved plans for the roadway.
