This Board has reviewed the subdivision plan
of John. J. McLay on Turi pike Street.
Each individual lot 0.1.1_ have to have a
percolation test conducted by our engineer, William Driscoll, to
d.eternftn(; the suitability of the land .for a sub surface septic
system. Mr. Driscoll's recommendations mill be based on the individual
requirements of the prospective owners of -these lots.

Dear Sir:
The ,following petition was heard at a meeting of the Planning Board on Monday
evening April 27, 1970 and continued on May 49 1970 at the Town Office Building.
The following members were present and voting: William Chepulis' Jr., Chairman;
John J. Monteirov Secretary; Charles W. Tromblyp Jr.t Vice Chairman; Robert J.
Burke and Donald N. Keirstead.
JOHN J. McLAY petitioned to subdivide a parcel of land containing five lots and
approximately seven acres on Turnpike Street (Route 114) at the location of his
Garden Center. 1t is proposed that he will sell Lot #4 to R.C.A. Consumer Products
Division and that they wish to construct a building there. Mr. MaLay appeared on
his own behalf and a representative from R.C.A. was also present;. Preliminary plans
had been presented to the Board previously and several recommendations and changes
were made on the Definitive plans' as requested. There were no abutters present
and there was no opposition to the petition. Mr. Keirstead made a motion to take
the petition under advisement' Mr. Trombly seconded the motion and the vote was
unanimous.
A meeting was held on Tuesday evenings May 12, 3.970 at which time the same members
.were present with the exception of Mr. Trombly who was unable to attend. Letters
were received from the Board of Public Works4 Highway Department and Board of Health.
The Board discussedand voted on the petition. Mr. Keirstead made a motion to
APPROVE the subdivision subject to certain conditions as listed below. Mr. Monteiro
seconded the motion and the vote was unanimous.
The conditions are as follows:
1. That the record owners of the subject land execute and record a "covenant
running with the land" within 20 days from the date of this decision' or otherwise
provide security for the construction of ways and the installation of municipal
services within said subdivision' all as provided by G.L. c. 419 s. 81®U.
2. That all such construction and installations shall in all respects conform
to the governing rules and regulations of this Board.

3. Thatq as required by the North Andover Board of Health, no building or other,
structure shall be built or placed upon lots as shown on said plan without the
prior consent of said Board of stealth.
4. That water and sewer will be according to the rules and regulations of the
Board of Public Works.
5. That surface drains and street bounds must be installed. The roadway shall he
hot—topped and consist of 2" binder and 101 wearing surface and Yurtner construction
shall be in accordance with other requirements under the Subdivision Rules and
Regii1ati.ons of the Planning Board. Proper street signs must be installed.
6. Must comply with the Beard of Fine Engi.neerst requirements as to the .fire alarm
system.

In response to your query about the installation of a water main in
John A MaLay's subdivision on Turnpike Street, please be advised
as follows*
The Planning Board did not negate the Board of Public Workag
recommendation for an eight-inch water main Instead of a six-inch
water main. The Planning Board inadvertently signed the plan before
causing the change of water main size to be shown. One condition of
approval of the plan is that the requirements of the Board of Public
Works must be met,
Mr. MdLay has bean advioed verbally and by letter that$ in accordance
vith the above condition, an AL44-inch water main muut be i1al-
stalled. He has also been reqpested to change his plan to specify
an eishb-inch main and submit the changed plan to the Planni, Board
for filing and distribution.

Dear Sir:
I will be unable to make any recommendations in
accordance with your letter of September 14, 1971 for
the following reasons:
(1) No request was made for me to make an
inspection until after the work was completed. I
should have be requested to make cm inspection when the
sub grade was ready for gravel, when gravel was being
placed, when the gravel was ready for the placing of
bituminous material and during the placing of bituminous
material.
(2) In order for me- to make recommendations cores
of the bituminous will.. have -to be taken, and tests of the
depth of gravel and compaction will have to be made.
When this has been completed and the results forwarded
to me I will then make recommendations.
(3) There is a head wall of loose concrete blocks
which should be either of poured concrete or rubble and
should be constructed according to Mass. Dept. of Public
Works Sppcifications.
(4) T was unable to find one stone bound.
(5) Corrections should be made in the construction
of some of the catch basins.
Please have fir. McLay notify me when he has made
the necessary arrangements.
