When the obvious insertions are made in the blank areas' there would seem no reason %Yhy the Town should be undergoing any extraordinary risk in having your Board execute the enclosed agreement. i assume, of course, that the documents correctly state that one of the conditions imposed by your Board upon this subdivision is that the re- cord owners shall., in order to secure the construction of ways and the installation of municipal ;services, execute a covenant running with the land "or otherwise provide se- curity" . Cyr, Highway Surveyor 1 July 14, 1977 Planning Board Town of North Andover North Andover, Massachusetts 01845 Gentlemen: On May 2 , 1977 , 1. appeared before you to ask assis- tance from the Board to persuade Mr. John Tuttle to complete the unfinished work to the front of my property on 1620 Salem Street which resulted from the drain easement granted to him by me last October 1976 at the recommendation of the Town and the Board. At this May 2nd meeting the Board unanimously voted to allow Mr . Tuttle ten days to complete this task (ref. your letter to Mr , Tuttle dated May 3 , 1977) ; the work to be per- formed under the supervision of Mr . Cyr. Gentlemen, it is now July 14, 1977 , and I would like to inform you that the work has not been completed this date. It is unfortunate that a contractor is allowed by the Planning Board to disregard their request such as the one in your May 3 , 1977 letter . It goes to show that the reputation of contractors for this sort of behavior is well deserved and yet they continu- ally expect cooperation from abutters , but they in return fail to live up to their obligations and promises . My patience has been tried to the limit and I have retained Herbert L. Schultz , Attorny at Law, to represent me in taking legal action against Mr . Tuttle . It is unfortunate that the Board could not influence Mr . Tuttle to complete his obligations to all concerned and it is also unfortunate for the townspeople and other abutters that you continue to allow Mr . Tuttle to begin new projects in town and allow him to neglect his past obligations in finishing old projects first.
