Site Description: The subject parcel is located at 166 Salem Street and comprises the"The Captain Nathanial Berry Homestead"Subdivision. The subdivision will include an existing house, a new residential street, two new single family house lots totaling 2.3 acres and an existing undeveloped 25,00 square foot lot. The parcel is approximately 2.9 acres in land area and was created in June 9, 1999, recorded as plan# 13511 at the North Essex Registry of Deeds. Report.Soils are described in Section Ili of the attached Stormwater Management The USGS locus map for this site is shown on the attached Figure 1. The subject parcel is not located in a special Flood hazard Area on Flood Insurance Rate Map Community Panel No. 250098 0006C, as depicted on Figure 2. The subject parcel is wholly located within the Town of North Andover Watershed Protection overlay zoning district as depicted on Figure 3: Town of North Andover Zoning Map. As such,the parcel is subject to the requirements set forth in Section 4.136 of the Town of North Andover Zoning By-Laws. it 11. Protect®escriastion: The applicant seeks to construct a new 292 foot long roadway and 3 new single family homes within the Watershed Protection District. Portions of the roadway, one house and a stormwater detention/infiltration basin will be within the non-discharge buffer zone. The proposed addition is located outside the Watershed Protection District's 250' Non-Disturbance Zone to Lake Cochichewick and its associated BVW. Ill. Written Documentation- In accordance with the Town of North Andover Planning Department's "General Requirements to Be Met for Obtaining a Watershed Special Permit"the applicant offers the following information: 1. encouraging the most appropriate use of the land: The newly created lots are of similar size and configuration to other lots in the neighborhood.The existing lot is currently occupied with a single family dwelling. 2. preventing overcrowding of the land: The existing structure and proposed addition meet or exceed all dimensional requirements of the Residence 4(R4)zoning district. 3. conserving the value of land and buildings: The existing home on the property will be preserved. The new homes will be designed to compliment the existing area homes in style and stature 4. lessening the congestion of traffic: The proposed roadway will meet all town standards and it is not anticipated that the three additional homes will contribute to traffic congestion in the area. 5. preventing undue concentration of population: The addition of three single family homes in this area will not cause an undue concentration of population in this area. i 6. providing adequate light and air.- The proposed single family home landscaping will be consistent with that in the area and will provide adequate light and air. 7. reducing the hazards from fire and other danger.- No significant hazard from fire or other danger is associated with the construction of the proposed addition. i i 4 ` ` Ei assisting/n the economical provisions oftransportation, water, sewerage, schools, and other public facilities: ' The proposed development and subsequent sale of new homes will . contribute ho the tax base in North Andover, and the resulting fees paid for use cf transportation,sewerage, etc will assist in the economical provisions of public facilities. 0. controlling the use of bodies ofwater, including watercourses: ' Nu use ofa watercourse ' is proposed. The work proposed within the non-disturbance buffer zone cannot be moved outside of the buffer zone due to the area and topographical restraints. 3. Evidence of approval by the Mass. Dept. of Environmental Protection (DEP) of any industrial waste water treatment or disposal system or any waste water treatment of system fifteen thousand(15,000)gallons per day capacity. The applicant does not propose any industrial waste water treatment or disposal system or any wastewater treatment or disposal system of fifteen thousand gallons per day capacity on site. 4. Evidence that all on-site operations including, but not limited to, construction, waste water disposal, fertilizer applications and septic systems will not create concentrations of Nitrogen in groundwater, greater than the Federal limit at the down gradient property boundary: The existing site is served by municipal sanitary sewer and proposed houses will be served by public sewer. As such,the project as proposed will not contribute to increases in concentrations of nitrogen or phosphorus in Lake Cochichewick. 5. Projections of down gradient concentrations of nitrogen, phosphorus and other relevant chemicals at property boundaries and other locations deemed pertinent by the SPGA: See response to item number 4, above. 6.
