The undersigned hereby applies for the approval of said DEFINITIVE plan
by %the Board,, and in furtherance thereof hereby agrees to abide by the Board's
Rules and Regulations. The undersigned hereby further covenants and agrees
with the Town of North Andover, upon approval of said DEFINITIVE plan by the
Board:
1. To install utilities in accordance with the rules and regulations of the
Planning Board, the Public Works Department: the Highway Surveyor, the
Board of Heath, and all general as well as zoning by—laws of said Town,
as are applicable to the installation of utilities within the limits of
ways and streets, including the required cable, to be installed by Continental
Cablevision,
2. To complete and construct the streets or ways and other improvements shown i
thereon in accordance with Sections Iv and V of the Rules and Regulations
of the Planning Board and the approved DEFINITIVE plan, profiles and cross
sections of the same. Said plan, profiles* cross sections and construction ?
specifications are specificallyl..by reference, incorporated herein and made

ments herein shall be binding upon all heirs: executors, administrators,

5 . In accordance with the Board of Public Workh recommendations :
a ) An eight (8.) inch ductile iron cement lined '•water pipe , seal
coated inside , tar coated outside shall be installed on Anne
Lane . This is for 450 feet of eight inch pipe installed
fifteen feet . from property line with five feet of cover
below the finish grade of the street.
b) An -eddy breakflange hydrant to North Andover specifications
will be required at Sta . 4+40 . Said hydrant shall be instal-
led with a six .inch Mueller or equal gate valve (open left)
complying with AWWA specifications L500 52T with sliding
type cast iron gate box marked "Water. "
c ) A twelve by eight inch tapping sleeve and gate will be
required at Salem Street.
d ) All of the above work must pass, the leakage and pressure
tes.ts performed in accordance with Section 13 of AWWA
C600 and shall be chlorinated in accordance with C601
Standard Procedure for Disinfecting Water Mains . Adequate
public liability and property drainage insurance as well
as a street opening bond in an amount satisfactory to the -
Highway Surveyor must be provided for the work on Salem
Street .
6 . In accordance with the Fire Department ' s recommendations :
a ) The proposed name , Anne Vane , should be changed to eliminate
any confusion . The proposed street name shall be submitted
Voaxrd +to signing the definitive . and approved by the Planning
b ) All lot numbers shall be posted during construction .
c ) Permanent house numbers shall be posted prior to occupancy .
d ) The roadway should be made suitable for emergency vehicle
access prior to occupancy of any residence . .
e ) No open b•jrning 'is permitted except as allowed by the Fire
Department.
7 . A Notice of Intent shall be filed with the '.North Andover Con-
servation Commission as required under Chapter 131', Wetlands
Protection Act and local Conservation Commission ' s regulations .
Any changes required may be cause for reconsideration of the
subdivision under M. S . i, . , Ch . 41 .
8 . All requirements of Subdivision Control Laws pertaining to
' Street Trees ' shall be .enforced by the Tree Department.
9 . In accordance with the Highway Department' s recommendations :
a) Stone bounds shall be 8" square by 4 ' long.
b) Grade on shoulder area to be 1/4" per foot.
c ) All utilities to be buried a minimum of 30" deep and

d ) H,eadwall to be built to the Highway Department' s speci-
fications available at the Highway Department.

e) Twenty foot wide drainage easement shall run continuous
to abutting property . j
f ) Road paved width should be twenty two feet with 18"
overlap of gravel .
g ) Road crown shall be 3/8" per foot.

of Salem Street and the proposed road .
i ) Cul-de-sac shall be centered on the roadway and not off

10. A stump pit burial plan shall be submitted to the Planning
Board and Highway Department for review and approved prior
to any on site construction.

11 . A covenant restriction shall be placed on the deeds of Lot 1
and Lot 2 describing the narrow strip of land along both sides
of the proposed road as no access ' buffer strips ' . Said E
covenant will not permit any further lot development off of
the proposed roadway.
12 . The Developer shall be required to record all plans and docu-
ments signed by the Board in connection with this Subdivision x:
in the North Essex Registry of Deeds . The Developer shall
be further required to provide the Board with a Certifie,d
copy of all such recorded plans and documents . Should the

the Board reserves the right to retain an attorney to do so
