The applicantis attention-is directed to the definition of a "Preliminary
plan", G.L. c. 411 sec. 81 L, as amended by St. 1958, c.• 206, sec. 1.
"Preliminary plan" shall mean, a plan of a proposed subdivision or
resubdivision of land drawn on tracing paper, or a print thereof, showing (a)
the subdivision name, boundaries, north point, date, scale, legend and title
r,Preliminary Plan"; (b) the names of the record owner and the applicant and the
name of the designer, engineer or surveyor; (c) the names of all abutters,
as determined from the most recent local tax list; (d) the existing and
proposed lines of streets, ways, easements and any public areas within the
subdivision in a general-manner; (e) the proposed system of drainage,
including adjacent existing natural waterways, in a general manner; (f) the
approximate boundary lines of proposed lots, with approximate areas and
dimensions; (g) the names, approximate location and widths of adjacent streets;
(h) and the topography of the land in a general manner.

The following petition was hoard at a meeting of the Planning hoard on Monday
eave3ning, Novomber 20, 1972 at 7:30 P-M. in the Fire Station meeting room, The
following members were present And voting; Charles W. Trembly, Jr., Chairman;
Donald N. KeI rstead, Vice Chairman; Fritz Ostherr, Clerk, William Chepulis and
John J. Monteiro.

nine lots, entitled. "Sal-em Gardens"; located on the northerly side of Salem Street
bounded by land of Smith, New England Power end Peterson.
Mr. Sullivan appeared on his own behalf; Robert P. Morris was the engineer.
Several abutters objected because of the drainage and the wet area in the develop— i
event. On January 9, 19739 the subdivision was disapproved for various reasons, as
filed with the: Town Clerk at that time. Several meetings and discussions were
held thereafter to alleviate the drainages problems. The petitioner then submitted
corrected plans and at is meeting hold on April 2., 197.3, the Board took the following
action. Mr. Monte:iro made a motion to disapprove the subdivision; Mr. Lamprey
seconded they motion and the vote was two for disapproval and three against disapproval;
the motion f'rai.lnrl, Mr. Keirsterad then made a motion to APPRM the subdivisions; Mr.
Ostherr secondedl the motion and the vote was three for approval and two against
approval, This being a majority vote, the subdivision is approved, subject to the
following conditions.
1. i'hat, the record owners of the subject land forthwith execute and record a
"covenant; ruraniw with the l.alndI, or otherwise provide security for the construction
of ways and the installation of municipal. services within said subdivision, all as
provided by O.L. c. i4l, S. 81 µetl.
2° That tall., :such construction and installations shall in all respects conform to
the goverri ng rules and regulations of this Board.

4, That water and sew^r will he according to the rules and rngulations of the
Board of Public Works.

Subdi.vi..s4on R"les and Roy"Oti,ons of the Planning Board. Propor street ;signs
must he installed. Nppropriate inspections for the satisfactory completion of
the provisions in this pnragr aph are to be performed under the direction of the
Offi,co of the Hi.ghwry Surveyor.
b. Most comply with the Ronrd of Fire Engineers' requirements as to the fire alarm
system.
7. The two proposed catch basins on Salem Street shall be located within the
entrance to Bannan Drive and be connected to the other catch basins within the
subdivision.

CONDITIONS
1. That the record owners of the subject land forthwith execute and record
a "covenant running with the land' , or otherwise provide security for the
construction of ways and the installation of municipal services within said
subdivision, all as provided by G.L. c. 419 s. 81—U.
2. That all such construction and installations shall in all respects conform
to the governing rules and regulations of this Board.
3. That, as required by the North Andover Board of Health in its report to
this Board, no building or other structure shall be built or placed upon

It. That water and sewer will be according to the rules and regulations of the
Board of Public Works.
y. That surface drains and street bounds rust be installed; the roads must be
hot—toppod and constructed all in accordance with the requirements under the
ubdivision Rules and Regulations of the Planning Board. Proper street signs
mu9t, be installed. Appropriate inspections for the satisfactory completion of
they provisions In this paragraph are to be performed under the direction of the
Highway Surveyor.
6. Must comply with the Board o4 Fire Engineers' requirements as to the fire
