Pursuant to the authority of G.L. c131 §40, the Commissioner of Natural Resources has considered your
notice of intent and plans submitted therewith, and has determined that the proposed project described
therein, is significant to at least one of the following: public or private water supply; ground water supply;
flood control; flood damage prevention; prevention of pollution; protection of land containing shellfish; or
protection of fisheries. The Commissioner finds that in order to protect the aforesaid interests,the following
conditions are necessary and al I work must be performed in strict conformance therewith:
CONDITIONS
1. Failure to comply with all conditions stated herein, and with all related statutes and other regulatory
measures, shall be deemed cause to revoke or modify this permit.
2. The provisions of G.L. cc. 91 and 111, and any regulations adopted thereunder, must be fully complied
with.
3. This permit does not grant any property rights or any exclusive privileges;it does not authorize any injury
to private property or invasion of private rights.
4_ This permit does not relieve the permittee or any other person of the necessity of complying with a]I other
applicable federal, state, or local statutes, ordinances, bylaws and/or regulations.
5. The work authorized hereunder shall be completed within one (1) year from the date of this permit. A
one (1) year extension of this period may be obtained by the submission of plans to the Commissioner of
Natural Resources which indicate the remaining work to be performed. if said work is not completed
within the initial one (1) year period, or the one (1) year extension thereof, the permittee, or his
successors or assigns must apply for a new permit pursuant to G.L. c.131 §40, provided, however, that all
conditions imposed herein shall remain in full force and effect.
6. Any fill used in connection with this project shall be clean fill, containing no trash, refuse, rubbish or
debris, including, without limiting the generality of the foregoing, lumber, bricks, plaster, wire, lath,
paper, cardboard, pipe,tires, ashes, refrigerators, motor vehicles or parts of any of the foregoing,
7. No work may be commenced until fourteen (14) days of receipt of this Order.
S. No work shall be undertaken until the final Order, with respect to the proposed project, has been recorded
in the Registry of Deeds for the district in which the land is located.

You are hereby notified of your right to a hearing before this Department pursuant to the provisions
of G. L_ c3.0A-§-10. The right for a hearing is extended to the applicant or any lawful intervener(s) who may be
aggrieved by the terms and conditions of this permit. The request for a hearing must be made in writing to the
Department within fourteen (14) days of the receipt of this permit.
