I highlighted Section 6(c)-similar to the FEIR-that indicates a yearly capacity of 237,250 tons. What we are looking to do-where it was the Board of Health that reduced the daily volume of 650 tons per day to 500 tons per day or from 237,250 annual tons down to 156,000 annual tons-is come before the Board of Health and look to get back the 150 tons per day and put us back to where the MA DEP FEIR, MA DEP BWP SW 01 Site Assignment,and all of the submittals to the Board of Health were all based on an annual volume of 237,250 tons. When you are back in North Andover and you and Brian LaGrasse have some time to tour the facility and talk about the 150 tons per day just give us a call and we will make ourselves available. DATE NOTICED IN MONITOR : December 8, 2004 As Secretary of Environmental Affairs, I hereby determine that the Final Environmental Impact Report (FEIR) submitted .on the above project adequately and properly complies with the Massachusetts Environmental Policy Act (G. L. c. 30, ss . 61-62H) and with 'its implementing regulations (301 CMR 11.00) . Project Description: As described in the FEIR, the project consists of the construction of a 30, 000 square foot (sf) transfer station and recycling facility for -construction and demolition (C&D) material and coimnurcial solid waste. The facility is proposed to handle a maximum of 650 tons per day (tpd) or a total of 237, 250 tons per year. The 6-acre site contains a 15,000 sf building that is used by a solid waste company for maintenance and office use. This use accounts for 2 acres of the .site, and the other 4 acres is used as a storage lot for solid waste transfer trucks and trailers. The proposed facility will be located on this 4-acre portion of the site. Since the DEIR review, the proponent has made refinements to the_project and is now proposing to install a Stormceptor unit to improve total suspended solids (TSS) removal rates from stormwater flows_ The proponent has also committed to restricting the release of transfer trailers onto surrounding roads during the weekday pm peak hours of 4 : 00 to 6: 00 pm. Furthermore, it has *^rj Prided on Recycled Snick20%Poe ConsumerWoes EOEA #13203 FEIR Certificate January 14, 2005 redefined the Commercial Solid Waste (CSW) that it will accept to not include waste with a high proportion of food waste, such as restaurant waste. This mitigation measure was incorporated to prevent potential vectors (birds) at the nearby airport. . The facility will be equipped with roll-up doorways that will only be opened to allow trucks to enter and exit the building. All operations and processing will be confined to the building. The non-recyclable construction and demolition waste will be loaded onto trailers for transport to disposal sites, and recycled goods will be collected for transportation to recycling facilities. Trucks carrying waste will enter the transfer station via the main entrance on Holt Road, and they will exit via the same driveway. Trucks arriving to pick up recyclable goods and wastes will enter from the main driveway and will exit two driveways leading from trailer pits along either side of the building. A total of 30 parking spaces for employees and visitors currently exist, and the proponent is proposing another 15 parking spaces. According to the proponent, the existing operations generate approximately 70 trips per day. The proposed project is estimated to generate an increase of approximately 292 vehicle trips per day. The proponent has indicated that the hours of operation are between 6:00 AM and 6:00 PM, seven days per week. It will serve the northeast region of Massachusetts. Standards and Purpose of MEPA Review: The project has generated a substantial number of comments, many of which have expressed opposition to the proposed project. As part of the MEPA process, I do not make substantive judgements as to the proposed land use, nor will I act as an agent of appeal or affirmation of local or regional land use decisions. MEPA is not a zoning process, nor is it a permitting process. MEPA review does not in itself result in any formal adjudicative decision approving or disapproving a project. The purpose of MEPA review is to ensure that a project proponent studies feasible alternatives to a proposed project; fully discloses environmental impacts of a proposed ,project; and incorporates all feasible means to avoid, minimize, or mitigate Damage to the Environment as defined by the MEPA statute. After completion of the EIR process, the state permitting agencies must then issue substantive decisions on whether or not to permit those aspects of the project within their respective jurisdictions. If permits are issued, the state agencies must incorporate the information in the EIR process into their required Section 61 Findings, thus formalizing the mitigation 2 1 • EOEA #13203 FEIR Certificate January 14, 2005 commitments contained in the EIR. Section 11. 08 (8) (b) of the MEPA Regulations requires me to find a FEIR adequate if the aspects and issues have been clearly described and their nature and general elements analyzed in the EIR or during. MEPA review, that the aspects and issues can be fully analyzed prior to any Agency issuing it Section 61. Findings, and that there will be meaningful opportunities for public review of. the additional analysis prior to any Agency taking Agency Action on the Project. I find that the FEIR is sufficiently responsive to the requirements of the MEPA regulations and the Scope to meet the regulatory standard for adequacy and may proceed to permitting. Project Regulatory Environment: The project will require a Determination of Site Suitability (310 CMR 16. 00) , an Authorization to Construct, an Authorization to Operate Permit, and a Limited Air Plan Approval from the Department of Environmental Protection (DEP) . A National Pollutant Discharge Elimination System (NPDES) General Permit for stormwater discharges from a construction site will be required. Since the proponent is not seeking financial assistance from the Commonwealth for the project, MEPA jurisdiction is limited to those aspects of the project whose environmental impacts are related to the subject matter of state permits (solid waste, air quality, stormwater, and traffic) . According to the proponent, the project will consume approximately additional 550 gallons per day (gpd) of water and will generate about 450 gpd of new wastewater. The project site is connected to. the local municipal water system. The proponent will be installing a Title .5 septic system for wastewater collection. The drainage from the solid waste operations will be collected in a storage tank that will be emptied by a licensed contractor. - - Review of the FEIR: The FEIR described the proposed project, its operation and its potential impacts. It discussed the project' s consistency with the Beyond 2000 Solid Waste Master' Plan. The FEIR provided the information needed for DEP to review the proponent's Site Suitability, Site Assignment, and Authorization to Operate a Large Handling Facility. As required in my Certificate on the Draft EIR, the FEIR discussed the concerns expressed over the disproportionate burden being created by the concentration of waste facilities in this area. The FEIR 3 EOEA #13203 FEIR Certificate January 14, 2005 reviewed existing health studies for this area' s population regarding respiratory problems to determine existing conditions. Based on 'available information, the FEIR stated that there does not appear to be a potential for increased health risk associated with this facility on air quality. All existing and proposed sensitive receptors within a half-mile of the project were identified and the impacts to those receptors evaluated. .The FEIR demonstrated that Best Management Practices would be used to limit potential air pollution from the project. It identified existing and future air quality in this area with this facility. This air quality analysis identified the specific stationary and mobile sources and the specific air contaminants that• were measured. The FEIR also developed mitigation measures to reduce the impacts of dust. • Appendix C in the FEIR reviewed potential increases in dust and diesel emissions (particulate matter) from this facility (stationary) . Appendix D in the FEIR presented existing noise levels at the site border. It identified that filters may be installed to reduce noise escaping from the building vents as the project completes its design process. The FEIR contained the documentation in Appendix D for• the noise levels at the property line as required by DEP. *Appendix E in the FEIR provided a LOS analysis of the Saturday midday peak hour for existing, no-build and build conditions. The proponent corrected the mathematical errors and inconsistencies in the traffic study. The proponent was unable to identify the potential communities in the wasteshed area for this proposed facility, and relate this information to the proposed truck routes. This should be reexamined in the DEP process if such information becomes available. The FEIR identified the depth to groundwater at the project site. The FEIR outlined the proponents' specific measures to limit odor, vermin, litter, and dust impacts to surrounding neighbors. The proponent will ensure that litter/dust impacts on surrounding streets are responded to by the proponent on a daily basis. A monitoring and inspection program for these above issues was included in the FEIR. • I Because the proposed facility may attract nuisance populations of birds, the FEIR evaluated the potential impact on the abutting -Lawrence Airport. The FEIR- addressed the concerns identified by the Massachusetts Aeronautics Commission (MAC) . It I submitted a Request for Airspace Review with the MAC and a Notice of Proposed Construction to the Federal Aviation Administration 4 I • I I I I EOEA #13203 FEIR Certificate January 14, 2005 (FAA) . The FEIR addressed the MAC's concern with the FAA's Advisory Circular (150/5200-34 (2000) ) . The FEIR developed a fire prevention plan with the local fire department. The FEIR included copies of all comment letters. It responded to all comments within the scope of the project. The FEIR was circulated in compliance with Section 11. 16 of the MEPA regulations and EJ Policies #13, 14, and 15. Copies were sent to the list .of "comments received" below and to North Andover, Haverhill, Lawrence, and .Methuen officials . A copy of the EIR was made available for public review at the Public Libraries in these above communities: Summary of the FEIR Mitigation: In the FEIR, the proponent committed to fund the following mitigation measures: • Construct an underground detention/infiltration basin for stormwater collection ($150, 000) . • Provide a new roadway sign on the Holt Road approach to Route 125 .reminding truck drivers to take a left turn to reach I-495 ($1, 000) . • Work with MHD to develop signal-timing changes at the Route 125/Route 125 Connector intersection ($10, 000) . • . Conduct traffic monitoring studies at the project site and at the Route 125/Holt Road intersection 'after. 6 months of operations and one year later to determine if traffic signals are warranted ($10, 000) . Provide for the proponent's fair share of the cost of traffic signalization a-t­ffolt Road/'Route 125,- if traffic signals are warranted (including a functional design report) and approved by MHD ($35, 000) . • Provide up to $5, 000 to the Town of North Andover for actions to enhance traffic safety along Route 133. • Stop accepting inbound material from outside parties during peak evening hours. • Commit to restricting transfer trailers or recycle trailers leaving the site between 4: 00 pm and 6:00 pm. • Commit to- provide electrically powered stationary •equipment within the facility (quieter) and low-emission diesel powered waste handling equipment. • Provide periodic sweeping of Holt Road. 5 EOEA #13203 FEIR'Certificate January 1.4, 2005 • Use low-emission sulfur diesel fuel in facility vehicles. Implement a dust emission sampling and analysis plan.. Based on a review of the FEIR and the comments submitted on this project, I hereby find that the FEIR adequately and properly complies with the MEPA regulations. I am confident that outstanding issues. can be addressed in the state and local permitting process and that the mitigation measures and monitoring programs can be further refined to ensure the project is developed and operated effectively. The purpose of these regulations is to avoid an undue concentration of solid waste facilities in one community. The Board rinds that adding a new solid waste facility in North Andover will add to the burden on North Andover. However, there are a number of mitigating :factors. First and foremost,TBI has reduced the proposed tonnage from 650 tons per day to 500 tons per day. This approximate 25%reduction in capacity reduces in a nearly linear fashion the burden on the community from truck traffic, air emissions, and other aspects of the :facility. While it is difficult to draw a precise dividing line as to an acceptable and.unacceptable burden, the'Board:finds that the burden of a 500 ton per day facility is significantly more acceptable than the burden of a 650 ton per day facility. Second, the NESWC facility receives municipal solid waste, and not the C &D waste proposed for this facility. The Board finds that neither North Andover nor the Merrimack Valley region currently have a facilitycapable of handling the waste streams that TBI proposes to accept. Third,TBI has committed to significant recycling or waste diversion. The waste diversion goals include- 0 50 percent,or 250 tons per day(tpd), waste diversion in the first two years of operation; 55 percent,or 2.75 tpd,waste diversion after two years of operation; • 60 percent, or 300 tpd, waste diversion after five years of operation; and • 75 percent,or'375 tpd,waste diversion after seven years of operation. These goals will help the state meet recycling goals aimed at reducing the need for disposal. 13
