The undersigned, being the applicant as defined under Chapter 41, Section
81—L4 .for approval of a proposed subdivision shown on a plan entitled

The undersigned hereby applies for they approval of said DrFINITTVN plan
by the Board, and in furtherance thereof hereby agrees to abide by the Boardfa
Rules and Regulations. Tho undersigned hereby further covenants and agrees
with the 'down of North Andover, upon approval of said DEFINITIVE F 1NIT1VE plan by the
Board:
1. To install utilities in accordance with the ruses and regulations of the
Planning Board, the Public Works Department, the high ►ay Surveyor, the
Board of Health, and all general as well as zoning bylaws of said Town,
as are applicable to. the installation of utilities wi..hin the Limits of
ways and streets; including the required cable to be , istalled by Continental.
Cablevision.
2. To complete and construct the streets or ways and hth• rr improvements shown
thereon in accordance with Sections Iv and V of tti , F, les and Regulations
of the Planning Board and the approved DEFINITIVE plan, profiles •and cross
sections of the sanie. Said plan, profiles, cross sections and construction
specifications are spe;cificalltiy, by reference, incorpcFFated herein and made
a part of this application. This application and the Covenants and agree—
ments herein *hall"be binding upon all heirs, sxecutors, -administrators,
successors, grantees of the whole trr part of said land, and assigns of the"
undersigned; and
3. To complete the aforesaid installations,,an4 construction within two (2)
years from the date hereof.

The North Andover Planning Board has voted to APPROVE said plant subject to the
following conditions:
1. That the record owners of the subject land forthwith execute and record
a "covenant running with the land", or otherwise provide security for the con-
struction of ways and the installation of municipal services within said sub-
division, all as provided by G.L. c. 41t S. 81-U.
2. That all such construction and J-nstallations sha 1 in all respects

for approval by the applicant prior to implementation ir• the field.
3. That, as required by the North Andover Board of Iealth in its report to
this Boards no building or other structure shall be buil' or placed upon Lots
No. 1 through 9_ as shown on said Plin without the prior
consent of said Board of Health.
4. Other conditions:
a. All Planning Board order of: conditions are to be placed on the recorded definitive plat
b . Prior to signing the definitive plans all deeds of ea,,,ements shall be submILLCd to
the Planning Board and held in escrow until completion. At the time of completion the
developer or owner shall execute such documents for the Town.
c . A certified as-built plan shall be submitted showing the location of all utilities
(electric,water; sewer, telephone) prior to binder coat application.
- d, Final as-built plans shall be submitted to the Planning Board prior to final release
of security.
e. A certified plan from a Registered-Engineer or Land Surveyor shall be submitted to the
Planning Board for review detailing proposed stump. pit areas for approval prior to
construction. All stump pit areas are to be.-approved by the Highway Surveyor.
f . The applicant/owner/developer s"hall- be-aware- of the fact that approval of this
subdivision under the Planning Board's Rules & Regulations will not relieve said parties
- of the responsibility to other property owners upon whose land may be affefted by indirect
or direct development storm water discharge.
In the event that no appeal shall have been taken from said approval within
twenty days from this date, the North Andover Planning Beard,will forthwith
thereafter endorse its formal approval upon said plan.

5 . In accordance with the Board of Public Works r ,commendations :
a . ' An eight ( 8) inch ductile iron cement linad water pipe , sea].
coated inside , tar coated outside shall be in: taped for 1600 feet
on Boston Street and 800 feet along the proposed roadway.
Installation shall be fifteen ( 15 ) feet fro, ti,e property line with
five ( 5) feet of cover below finish grade .
b . Eddy breakflange fire hydrants to North And.-ver specifications
are to be installed at sta . 5+0, 10+0, 15+30 .
C . Eddy breakflange hydrants to North Andover specifications are
to be installed at sta . 4+80 and 8+0 .
d . AI.L hydrants shall be installed' with six ( 6) inch Mueller or
equal, gate valves (open left ) complying with AWWA specifications
L500 52T with sliding type cast iron gage boxes ( 100 lbs . ) marked
' WATER' .
e . Eight ( 8) inch Mueller or equal gate valve (open left ) will be
required at sta . 0+0 and on either side of the intersection of
Boston Street and the proposed roadway .
f . AIL of the above work must pass the leakage and pressure tests
performed in accordance with Section 13 Standard 600 and shall be
chlorinated in accordance with AWWA Standard C601 Standard Procedure
for Disinfecting Water Mains . Adequate pub .ic Liability and
property damage insurance, as well as a street opening bond in an
amount satisfactory to the Highway Surveyor sl all be required for
the work on Boston Street .
6. In accordance with ' the Dire Departments recommendations :
a ., All lot numbers shall be posted during construction.
b. House numbers shall be posted as soon as pk -ssible .
C . No open burning is permitted except as pr -)vided by the Tire
Department .
d . Underground fuel storage must comply with Department
- regulations .
e . Prior to taking occupancy, the subdivision street shall provide
adequate access to each residence for fire apparatus , by having at
Least: a binder coat applied .
7. A Notice of Intent shall be filed with the North Andover
Conservation Commission as required under Ch. 131 , Wetlands
Protection Act and local Conse�_vation Commission ' s reguaations and
any changes required may be cuase for reconsideration of the
subdivision under M .G . L. , Ch. 41 .
8. All requirements of the Subdivision Control Laws pertaining to
' Street Trees ' shall be enforced by the Tree Department .
9. In accordance with the Highway Department ' s recommendations :
a . Incorporate the detention area alon, rith all other drainage
courses , as easments to the Town. Such easemcits , along with the
road widening easement on Boston Street shall be recorded at the

Registry of Deeds by the developer .
10. In accordance with Section II .B. 5 of the Planting Board Rules and
Regulations , the applicant shall, deed a fifty ( 50) foot wide parcel
of .land along with slope easements to the Tcwn for the future
extension to the abutting land .
Lofts 5 and 6 sha:l.l have sufficient land arer, and frontage (as
required in the North Andover Zoning Bylaw ) eccluding said future
extension .
11 . Lots 5 and 6 shall contain reserve slope eG.sme. ,ts .
12 . The applicant shall revise the new tot lines for. Lot 9 in accordance
with the North Andover Rules and Regulations and Zoning Bylaw .
D13 . Prior to endorsement of the definitive plan, theapplicant ` shall
propose a street name; for the ;3ubdivis.ion road to be approved by the
Planning Board'.
14. Corner soundings •shall be brought back from lot 1 and 9 along Boston
Street to the proposed roadway widening easment .
