Prior to any construction activity at this site, the applicant shall submit a wetlands and storage replacement plan to replace the wetlands areas to be filled by the proposed roadway construction. This plan shall be reviewed and approved by the NACC prior to implementation. 14. The applicant has stated at the Public Hearing that no wetland areas will need to be altered for any of the construction of any of the pro- posed houses, driveways, or subsurface disposal systems. In order to insure no such alteration and to provide for wetland protection measures, . a Request; for Determination shall be filed with the NACC for any work on Lots 1, 2, 3, 7, 8, and 9. 15. The construction sequence and erosion control plan listed on sheet 2 of the plan identified in condition 12b shall be followed during site development. 16. Upon completion of construction and grading, all aicas shall be stabilized' permanently against erosion. This shall be done e:, t:her by sodding, mulching according to Soil Conservation Service standard , u: by loaming and seeding. All erosion prevention and sedimentation protection measures found necessary during construction by the North Andover Conservation Commission will be implemented at the direction of the NACC or Highway Surveyor. 18. Any changes in the submitted plans, Notice of Intent, or resulting from the aforementioned conditions must be submitted to the NACC for approval prior to implementation. If the NACC finds, by majority vote, said changes to be significant and/car deviate from the original plans, Notice of Intent or this Order of Conditions to such an extent that the interests of the Wetlands Protection Act cannot be protected by this Order of Conditions and would best be served by the issuance of additional conditions, then the NACC will call for another public Bearing within 21 days, at the expense of the app- licant, in order to take testimony from all intere. ted parties. Any errors found in the plans or information submitted by the applicant shall be considered as changes and procedures outlined .for changes shall be followed. 20. The provisions of this Order shall apply to and be )inding upon the applicant, its employees, and all successors and aFAgns in interest or control. 21. In addition to the requirements of Condition No. 11 , the applicant must submit a letter; from the professional who prepared the plans, certifying compliance with this Order of Conditions. Said 4et •er will certify, but not be limited to the following: a. "As-Built" elevations of all drainage ways constructed within 100 feet of any area subject to the Wetlands Protection Act. b. "As-Built" elevations and grades of all filled or altered Wetland Areas. c. Distances to all sturctures and alterations within 100 feet of any areas subject to the Wetlands Protection Act. An "As-Built" topographic plan of all areas within the jurisdiction of the Wetlands Protection Act must be submitted when a Certificate of Compliance is requested. 22. Members of the NACC shall have the right to enter v )on and inspect the presises to evaluate compliance with this Order of ;onditions. 23. Accepted engineering and construction standards and procdures shall be followed in the completion of the project. Issuance of these conditions does not in any way im ,ly or certify that the site or downstream areas will not be subject to flooding, storm damage, or any other form of damage due to wetD, js, 24. A surety performance bond or letter of credit running to the Town of North Andover shall be provided in the amount of $5,J00.00' whi.ch shall be in all respects satisfactory to Town Counsel and the North Andover Conservation Commission and shall be posted with the Treasurer, of the Town of North Andover before commencement 'of work. In advance of any work on th is project, the applicant shall notify the NACC and shall arrange an on-site conference among the NACC, the Contractor and the applicant to ensure that all of the Conditions of this Order of Conditions are understood. This Order 'also shall be made a part of the contractor's written contract. 14. The applicant, or its successors, shall notify .the NACC in writing of the identity of the on-site construction supervisor hired to coordinate construction during the work on the site and to ensure compliance with this Order: 15. Prior to any. construction on the -site a double row of staked hay bales . s with siltation fencing shall be used as erosion control- devices and placed as shown'on the plan .referenced in Condition 12c. This barrier shall be inspected and.'approved. by the NACC prior to the start of construction. This row of hay bales shall remain intact until all disturbed areas have been mulched, seeded, and stabilized to prevent erosion. Prior - to' start of construction the applicant shall submit: a plan in-- corporating the aforementioned erosion control devices with proper ' reference- to such. 16. The applicant shall. have on hand at the start of any soil disturbance, removal or stockpiling, a minimum of twenty-five (25) hay bales and sufficient stakes for staking these bales.. Said bales shall be used only, for the contgrol of emergency erosion problems, and shall not be used for 'the normal,,control of erosion, as described in Condition #15. 17. Upon completion of. construction and grading, all disturbed areas located outside . resource areas shall; be stabilized permanently against erosion.This shall be done, either. by sodding, or by foaming, seeding, and mulching according to ,Soil Conservation Service standards. if the latter course is chosen, stabilization will. be considered once the surface shows complete vegetative cover has been achieved. i 1 Page 4 } '; ORDER OF CONDITIONS , Trot 2 Old cartway DEQE #2142-406 18. Any changes in the submitted plans, Notice of Intent, or resulting from the aforementioned Conditions must be submitted to the NACC for approval prior- to implementation. If the NACC .finds; by, majority � vote, said changes to be significant and/or' deviate from the original plans, Notice of Intent or this Order of Conditions to such an extent that the interests of the Wetlands Protection Act� and Bylaw cannot be protected by this Order of Conditions, then the NACC will call for another public hearing within 21 days, at the expense of the applicant, in order to take testimony from all. ingterested parties. Within 21 days of the' close of said public hearing, the NACC will issue an amended or new Order of Conditions. 23. In conjunction with the possible sale of this lot, the applicant shall submit to the NACC a signed statement by the buyer that he is aware of an outstanding Order of Conditions on the development and has received notice under Condition #27 below. 25. Members of the NACC shall have the right to enter upon and inspect the premises to evaluate compliance with this' Order .of Conditions. 26. Accepted engineering and construction standards and procedures shall be followed in the completion of the project. 27. The provisions of the Order shall ,apply to and be binding upon the applicant, its employees, and all successors and assigns 1n interest or control. 28. Issuance of these Conditions doews not in any .way imply or certify that the site oz downstream ,areas will not be subject to flooding,, storm damage, or any other form of damage due to wetness. Page 5 ORDER OF CONDITIONS Lot 2 - Old Cart Way DRQR #242-406 29, A proper bond- or the deposit of money or negotiable securities f.. sufficient in the opinion of the Commission .to secure the performance of the conditions and observance of the safeguards of such order of conditions running the Town of North Andover shall be proved in the amount of $2,000.00. Such bond .or security, if filed or deposited shall be approved as to form and manner of execution by Town Counsel and/or the Town 'treasurer, shall be posted with the Treasurer of the Town of North Andover before commencement of work. Said bond or .deposit of money or negotiable security shall be conditioned on the completion of all conditions hereof, shall be signed by a party or parties satisfactory to the NACC, the Town Treasurer, and Town Counsel, and shall be released after completion of the project, provided that provision, satisfactory to the NACC, has been made for performance of any conditions which are of a continuing nature. This condition is issued under the Authority of the Town of North Andover Wetlands Protection Bylaw. . 30.- In addition to the requirements of. Condition #11, the applicant shall submit a letter to the NACC from a registered professional engineer certifying compliance with this Order of Conditions. Said letter shall .certify, but. not be limited to the .following: a. `"As-Built. elevations of all drainage ways construcged within 100 feet of any wetland resource area. Y' 1 b. Any fill used in connection with this project .;lull be clean fill, containing no trash, refuse rubbish or de- bris, including but not limited to lumber, bricks, plaster, wire, lath, paper, cardboard, pipe, tires, ashes, refrigerators, motor vehicles or parts of any of the foregoing. 7:. No work shall be undertaken until all administrative appeal podods.f(om.this Order have elapsed or, if such an appeal has been filed, until all proceedings before the Department have beeh completed. 8. No work shall be undertaken until the Final Order has been recorded in the Registry of Deeds or the Land Court for the district in which the land is located, within the chain of title of the affected property. In the case of recorded land, the.f=inal Ordershall also be noted in the Registry's Grantor Index under the name of the owner of the land upon which the proposed work is to be done. to the case of registered land, the Final Order shall also be noted on the Land Court Certificate of Title of the owner of the land upon which the proposed work is to be done. The recording information shall be submitted to the NACC on the form at the end of this Order prior to commencement of the work. 9. A sign shall be displayed at the site not less than two square feet or more than three square feet in size bearing the words, "Massachusetts Department of Environmental Quality Engineering, File Number, _ 242— 4.07 10. Where tree Department of Environmental Ouality Engineering Is requested to make a determination and to issue a Superseding Order, the Conservation Commission shall be a party to all agency proceedings and hearings before the Department. 11 , Upon completion of tho work described herein, the applicant shall.forthwith request in writing that a r+ Certificate of Compliance be issued stating that the work has been satisfactorily completed. 12. In advance of any work on this project, the applicant shall notify the NACC and shall arrange an on-site conference among the NACC, the Contractor and the applicant to ensure that all of the Conditions of this Order of Conditions are understood. This Order also shall be made a part of the contractor's written contract. 14. The applicant, or its successors, shall notify the NACC in writing of the identity of the on�site construction supervisor hired to coordinate construction during the work on the site and to ensure compliance with this Order. 15. The applicant shall submit to the NACC necessary documentation for the driveway easement to access Lot #2. 16. Prior to any construction on the site, a double row of staked hay bales shall be placed as shown on the plan referenced in Condition 12c. This barrier shall be inspected and approved by the NACC rior to the start of construction. This row of hay bales shall remain intact - until all disturbed areas have been mulched, seeded, and stabilized to prevent erosion. The applicant shall submit revised plans incorpor- ating the new erosion control harrier prior to the commencement of any activity on the site. 17, The applicant shall have on hand at the start of any solid disturbance, removal or stockpiling, a minimum of twenty-five (25) hay bales and sufficient stakes for staking these bales. Said bales shall be used only for the control of emergency erosion problems, and shall not be used for the normal control of erosion, as described in Condition #15. 18. Upon: completion of construction and grading, all disturbed areas located outside resource areas shall be stabilized permanently against erosion. This shall be done either by sodding, or by loaming, seeding, and mulching according to Soil Conservation Service standards. If the latter course is chosen, stabilization will be considered once the surface shows complete vegetative cover has been achieved. Page 4 ORDER OF CONDITIONS Lot 3 Old Cart Way DEQE #242-407 19. After proper grading, all disturbed areas located within a resource area, except those areas designated as compensatory wetlands, shall be foamed and seeded with not less than four (4) inches of good quality loam. Before seeding, ground limestone shall be applied at a rate sufficient to bring the soil test to pH 6.5. In addition, 10-6-4 fertilizer, or its equivalent, shall be applied at a rate of fifteen (15) pounds per one--thousand (1000) square feet, in accordance with Soil Conservation Service Cuidelines. 20. No earthen embankment in the buffer zone shall have a slope steeper than 2: 1. 21 . All erosion prevention and sedimentation protection measures found necessary during construction by the NACC will be .implemented at the direction of the NACC. 22. Where shall be no stockpiling of soil or other materials within b twenty-five (25) feet of any resource area. 23. During and after work on this project, there shall be no discharge or spillage of fuel, oil, or other pollutants into any resource area. 24. Any changes in the submitted plans, Notice of Intent, or resulting from the aforementioned Conditions must be submitted to the NACC for approval prior to implementation. If the NACC finds, by majority vote, said changes to be significant and/or deviate from the original plans, Notice of Intent or this Order of Conditions to such an extent that the interests of the Wetlands Protection Act and Bylaw cannot be protected by this Order of Conditions, then the NACC will call for another public hearing within 21 days, at the expense of the. applicant, in order to take testimony from all interested parties. within 21 days of the close of said public hearing, the NACC will issue an amended or new Order of Conditions. 25. Any errors found in the plans or information submitted by the applicant shall be considered as changes, and procedures outlined above for changes shall be followed. 26. In conjunction with the possible sale of this lot, the applicant shall submit to the NACC a signed statement by the buyer that he is aware of an outstanding Order of Conditions on the development and has received notice under Condition #28 below. 27. Members of the NACC shall have the right to enter upon and inspect the premises to evaluate compliance with this Order of Conditions, 28. Accepted engineering and construction standards and procedures shall be followed in the completion of the project. 4 Page 5 ORDER OF CONDITIONS Lot 3 - Old Cart jay D.B.Q.E.#242--407 29. The provisions of the Order shall apply to and be binding upon the applicant, its employees, and all successors and assigns in interest or control. 30. Issuance of these conditions does not in any way imply or certify that the site or downstream areas will not be subject to flooding, storm damage, or any other form of damage due to wetness. 31. A proper bond or the deposit of money or negotiable securities sufficient in the opinion of the Commission to secure the performance of the Conditions and observance of the safeguards of such Order of Conditions running to the Town of North Andover shall be provided in the amount of $2,000.00. Such bond or security, if filed or deposited shall be approved as to form and manner of execution by Town Counsel and/or the Town Treasurer, shall be posted with the Treasurer of the Town of North Andover before commencement of work. Said bond or deposit of money or negotiable security shall be conditioned upon the completion of all conditions hereof, shall be signed by a party or parties satisfactory to the NACC, the Town Treasurer and Town Counsel, and shall be released after completion of the project, provided that provision, satisfactory to the NACC, has been made for performance of any conditions which are of a continuing nature. This condition is issued under the Authority of the Town of Forth Andover Wetlands Protection Bylaw. 32. In addition to the requirements of Condition #11, the applicant shall submit a letter to the NACC from a registered professional civil engineer certifying compliance with this Order of Conditions. Said letter will certify, but not be limited to the following: a. "As--Built" elevations of all drainage ways constructed within 100 feet of any wetland resource area. b. "As-Built" elevations and grades of all filled or altered wetland resource areas. C. Distances to all structures and alterations within 100 feet of any wetlandkesource area. An "As-Built" topographic plan of all areas within the jurisdiction of the Wetlgnds Protection Act and Bylaw shall be submitted when a Certificate of Compliance is requested. 33. No underground storage of fuel oils shall be allowed within 100 feet of a resource area. This Condition shall survive this Order of Conditions, and shall run with the title of the property. 34 Fertilizers utilized for landscaping and lawn care shall be of the low nitrogen► content variety, and shall be used in moderation. Pesticides and herbicides shall not be used on any lot in the subdivision within One-hundred (100) feet of a wetland resource area.
