DECISION
TUCKEIPPARMS-Preliminary Plan
June 21 , 1984
1 . A new twelve ( 12 ) inch ductile iron cement lined water pipe ,
seal coated inside/tar coated outside shall be installed for
a distance of 1000 feet on Mill Road and Johnson Street to
the proposed road . The pipe shall be installed 15 feet from
the property line with 5 feet of cover below the finish
grade .
2 . Eight ( 8) inch ductile iron cement lined water pipes- seal
coated inside/tar coated outside shall be installed 15 feet
from the property line :
a . along the proposed road ; from Mill Rd. to Johnson St . ,
and
b. for 665 feet along the property lines of lots 9 and 15
to Turnpike St .
3 . Eddy break£lange fire hydrants to, North Andover
speci.fications ' shall be installed with 6 inch Mueller or
equal. gate valves (open left ) in accordance with AWWA
specifications L 500 52 T with 100 lb. sliding type cast
iron gate boxes marked "WATER" at the following locations :
a . stations 5 +. 0 and 10 . + 0 ; and
b . statLons._A . + .50 ,. 9 + 10 . and ..13 " + ,30 .
. 4 . A twelve (12) .inch gate valve is required at Johnson Street ;
eight (8) .inch at Mill Road, and at the intersections of the
proposed road and Turnpike Street .
5 . All work must pass the leakage and pressure tests performed
in accordance with AWWA standard C600 and chlorinated in
accordance with AWWA C601 ' Standard Procedure for
Disinfecting Water Mains ' . Adequate public liability and
property damage insurance , as well as a street opening bond
for work on Mill Road and Turnpike Street , in the amount
satisfactory to the Highway Surveyor will be required .
6 . A Notice of Intent shall .be filed with the Conservation
-Commission as required under Chapter 131-Wetland protection
Act and the local Conservation Commission ' s regulations .
7 . Drainage in the form of two ( 2 ) catch basins shall be
installed at the intersection of the proposed roadway and

Mill Road and possibly may require 4dditi,onal drainage . at
Johnson St .
8 . In the areas of fill. , no drainage structures shall be
installed until adequate measures have been taken to ensure
that proper fill materials are used to prevent settlement .
9 . All headwalls axe to be installed in accordance with Section
V. 'Required Improvements ' subsection H . 3 of tie
Subdivision Rules and Regulations .
10 . Any drainage from cellars or lot development shall, be tied
into the designed drainage system to be shown on the
definitive plan, and approved by the Planning Board and
Highway Surveyor . Drainage not shown on definitive p:l.an
will not be added during construction unless required by the•
Highway Surveyor .
11 . Road pavement amd gravel width shall be increased by three
(3) feet in all areas where Cape Cod berm is required , to be
determined in the field by the Highway Surveyor .
Notation to be placed on plan:
12. Slope easements shall be shown on the definitive plan in
order to meet slope and shoulder requirements in accordance
with Section V. ' Required Improvements' . to be recorded by
appli�E_a_ntanZ deededto the Town of North Andover .
13 . The leveling area that approaches the intersection with Mill
Road shall be designed in accordance with Section IV.

14. Any brick used shall be clay brick. All masonry is to have,)
solid bed and end joints of quality cement mortar .
15 . Road cross-sections will be clearly illustrated on plan for
definitve review.
'Notation: Definitive plan will reflect ,Section IV C.,- �
16 . The manholes shown at stations 2_. + 0 , 41, + 50 and 9 + 00 are
not required . The manhole at station `9 + 50 shall be
adjusted to be a catch basin.
17 . 1 The proposed 'road : shall connect through to Johnson St . in
accordance with Section IV, A, 4 , (a) .
` 18 . In permitting the access/egress onto Mill road the
following off-site improvements shad be completed in order
to ensure the safety, convenience and welfare of the Town ' s
inhabitants :
a . Appropriate measures shall be taken to eliminate the two
blind curves on Mall Road at Lot 1 and to the south of the
access/egress .
b. Complete topographic detail shall be submitted with the
definitive plan .
c . The grade of Mill Rd . shall be altered to permit a safe
approach to the proposed road .

19 . Areas to be stumped shall be clearly delineated on the 1
definitive plans , to be reviewed and approved by the Planning
Board. '

The applicant shall submit a Statement of._. Environmental
Impact as r,equ,i.red ,.in Section -111B5 to the Planning Board.
--Infor'i�ati.on describing the impact on Town Services
subsection e shall be included.
21 . Prior to seeking lot releases , the applicant shall have.
installed utilities and applied the proper binder coat from
Mill Rd. to Johnson St . to ensure safe access for travel by
residents and emergency vehicles .
22 .. The owner shall:. retain -title to the- fee --of each street ,
path, or ..easement •in or- apPur.tenant ':to .the ..subdivision until.

and drainage facilities in a manner satisfactory ,- ,to the
Board during that period . Notation that fee is to be
retained shall be placed on the definitive plan.
23 . Applicant shall show inlet and outlet of all adjoining
wetland areas and shall include their impact from drainage
off this subdivision . The Planning . Board may require a zero
increase in the rate of runoff.
24 . All test pits and percolation tests shall be located on the
definitive plan and . all results including spring water
tables shall .be submitted to the Planning Board .

1 . In accordance with the Preliminary Plan disapproval , the Definitive
Plan does not indicate ,
a. Plans do not indicate any detail that road intersection is not
a Crest of a hill and that catch basin are not necessary. The
Highway Surveyor has requested that they be installed and
applicant has failed to provide satisfactory reasons for
their removal ,
b. Applicant has not indicated any slope easements along the
proposed roadway and therefore has not demostrated that
permission has been onbained from abutters Stephen Leone
and Marbieridge Development Corp. that side slopes can be
constructed in accordance with the Planning Board ' s Rules
and Regulations . Applicant has stated that they will be
provided but has not done so.
C . Applicant has not conformed to the Highway Surveyor' s
requirements that any brick to be used in the construction
of structures shall be clay brick and that all masonary is to
have a solid bed and that all end joints are to be of quality
cement mortar.
d. Applicant has not complied with Section V C of the Planning
Board' s Rules and Regulations in the design of the roadway
cross sections.

Board is of the opinion that applicant. does not intend to
perform.
i . The applicant has failed to properly address lte[rk 24 of the
Preliminary Plan decision. Soil logs that have been submitted
are not properly documentated.

2 . Drainage computations have not been submitted for any drain pipe
in order to give the Planning Board satisfaction as to the sizing
capacity, velocity and elevations , of the drainage system.
Applicant has generally not followed the Planning Board' s Rules
and Regulations and has given no indication of performance .
3. Applicant has not conformed with the Planning Board' s regulations
as specified in Section TTT , B, l ,d, e) , f,h, ) and k) .
4. Applicant has not conformed with the Planning Boards Rules and
Regulations as specified in Section TTT B. 3 ,k,n, o,p & q.
Additionally, all plan sizes are to be 36" x 24" .
5 . Applicant has not conformed with the Planning Board ' s Rules and
Regulations as specified in Section TTT , B , 5 .
6 . Drain Easements have not been properly dimensioned.
7 . Plans do not indicate that new water mains as required in the
Planning Boards decision are being or intended to be installed
along Johnson Street or to Route 114, or to Johnson Street.
8 . Profiles of roadway do not indicate any gate connection as
specified in the Preliminary Plan decision.
9 . Stationing on Profile Sheets is not consistent with plans .
10 . Plans do not show a permanent bench mark in the area of the
subdivision.
11 . No dimensions are provided at the intersection of Mill Road and
the proposed Street so as to indicate the beginning of the new
roadway and/or the beginning station.
12 . Nc, detail of Mill Road has been presented so as to provide the
Planning Board with sufficient information as to the width and
grade , sight distances and utilities so that the Planning Board
can make an adequate discussion and decision as to the future
safety, convenience and welfare if the new intersection in
reducing danger to life and limb abd securing safety in
emergencies.
13 . The Applicant has not proven adequately to the Planning Board
that the construction of on-site sanitary leaching facilities
can be constructed in accordance with Title 5 of the State
Sanitary Code and to the rules and regulations of the Town of
North Andover Board of Health. Specifically, the plan shows
proposed septic system in close proximity to drains and wetlaild
and are located within drain easements.
14 . The erosion controls as presented (haybales) are riot sufficient
in the opinion of the Planning Board to properly protect adjoining
areas from receiving sedimentation. The Planning Board will
require an erosion fabric fencing properly set in accordance with
the manufacturers specifications.
15 . Computations have not been submitted that indicate that the 2 inch
stone to be used at pipe outlets is of sufficient size not to be
eroded from water velocities existing from the drains .

16 , A copy of the Board of Health approved septic system design shall
be submitted to the Planning Board for approval to ascertain that
the lot grading on the septic system design complies with the
topographic maps showing proposed dwelling, leaching fields and
proposed contours prior to release of that lot. No lot will
be released from the covenant if the septic system design shows
major changes in location and/or grading without the applicant
justifying and/or mitigating that change so as to remain to
compliance with the approved plans .
17 . No lot will be released from the covenant until all drainage
has been installed in compliance with the plans and/or drainage
calculations and such drainage had been erosiion controlled.
18 . The Planning Board needs additional information regarding the
drainage calculations before the Subdivision can be approved.
The applicant has failed to convince the Board that channel---
ization of runoff water as proposed, changing the runoff from
sheet flow to point discharge, will decrease the peak flow when
modifying and improving flow velocities. The applicant shall
submit complete working formulas and/or methodically including
working calculations indicating the SCS values chosen.
19. Erosion control fencing and barriers shall be properly set as
required and shown on the plans prior to any earth movement
or roadway construction. Any indication or erosion and/or
sedimentation off the working area (beyond the erosion Controls)
shall be cause for immediate remedial action by the developer.
Zf action is not initiated immediately, the Town of North Andover
will perform such remedial action as necessary at the developers
expense . Erosion controls and maintance will be a bonded item.
20 . Any changes in the subdivison plans , including but not limited
to drainage , street lines , erosion controls, road construction,
wetland filling, dwelling locations, required by other governmental
agencies shall be submitted to the Planning Board for consideration
and approval of the Subdivision Modification under Chapter 41 .
