Section 81 P.Any person shine*to cause to he recorded a plan of land situated in a city or town in which the
subdivision control law is in effect.who bell eves,that his plan does not require approval under the subdivision
control law,rnav submit his plan to the planning board of such city or town in the manner prescribed in section
iglit -one and, if the board finds that the plan does not require such approval, it shall forthwith, =ithout a
public hearing,endorse thereon or cause to be endorsed thereon by a person authorized by it the words"approval
under the subdivision control law not required"or words of similar import with appropriate name or names
sing ed thereto,and such endorsement shall be conclusive on all persons. Such endorsement shall not be withheld
unless such plan shows a subdivision. Ifthe board shall determine that in its opinion the plan rehires approval, it
shall within twenty-one days ofsr h submittal give written notice ofits determination to the clerk of the cite or
town and the person submitting the plan,and such person mad submit his plan for approval as provided b • law
and the rules and regulations of the board,or he may appeal from the determination of the board in the manner

notify;the clerk-of the city or town and the person submitting the platy of its action within t era -one days after

Constructive Approval/ Endorsement
Kupperstein v. Planning Bd., 66 Mass. App. Ct. 905 (26).
The statute, G. L. c. 41, § 81P, is clear, and the Legislature utilized the mandatory word shall in several
instances. The statute directs that the planning board shall give written notice of its determination to the clerk,
and if not, the board "shall be deemed to have determined that approval . . . is not required, and it shall . . .
make such endorsement on [the] plan, and [upon] its failure to do so . . . [the municipal] clerk shall issue a
certificate to the same effect" (emphases supplied). G. L. c. 41, § 81R In the event of a
plan's constructive approval, the action of the board, or of the municipal clerk, is mechanical, and the
landowner's entitlement to the endorsement and certificate is mandatory.

Here, the intent of the constructive endorsement provision in G.L. c. 41, §81P is plain from the face of its words:
if the board fails to act on an ANR application in timely fashion, it "shall be deemed to have determined that
approval under the subdivision control law is not required, and it shall forthwith make such endorsement on
said plan, and on its failure to do so forthwith the city or town clerk shall issue a certificate to the same effect."

As a result of the planning board's failure to record its action pursuant to G. L. c. 41, § 81P, however,the plan
was constructively endorsed.
