APPLICATION FOR APPROVAL OF DEFINITIVE PLAN

To the Planning Board of the Town of North Andover:
The undersigned, being the applicant as defined under Chapter 41, Section
91 L, for approval of a proposed subdivision shown on a plan entitled

The undersigned hereby applies for the approval of said DEFINITIVE plan
by the Board, and in furtherance thereof hereby agrees to abide by the Board's
Rules and Regulations. The undersigned hereby further covenants and agrees
with the Town of North Andover, upon approval of said DEFINITIVE plan by the
Board:
1. To install utilities in accordance with the rules and regulations of the
Pluming Board, the Public Works Department, the Highway Surveyor, the
Board of Hoalth, and all general as well as zoning by-laws of said Town,
as are applicable to the installation of utilities within the limits of
ways and streets;
2. To complete and construct the streets or ways and other improvements shoran
thereon in accordance with Sections Iv and V of the Rules and Regulations
of the Planning Board and the approved DEFINITIVE plan, profiles and cross
sections of the same. Said plan, profiles, cross sections and construction
specifications are specifically, by reference, incorporated herein and rude
a part of this application. This application and the covenants and agree-
ments herein shall.,be binding upon all heirs, executors, administrators,
successors, grantees of the whole or part of said land, and assigns of the
undersigned; and
3. To complete the aforesaid installations and construction within two (2)
years from the;dale .] reof.

The North Andover Planning Board has voted to APPROVE said plan9 subject to the
following conditions:
1. That the record owners of the subject land forthwith execute and record
a "covenant running with the land"i or otherwise provide security for the con-
struction of ways and the ,installation of municipal services within said sub-
division# all as provided by G.L. c. 4' S. 81 U.
2. That all such—construction and installations shall in all respects.
conform to the governing rules And 'regulations of this Board.
3. That, as required by the North Andover Board of Health in its report to
this Boardq no building or other structure shall be built or placed upon Lots

consent of said Board of Health.

Dear Sir:
The following petition was heard at a meeting of the Planning Board on Monday
evening, March 1 , 1976 at 700 P.M. in the Town Office Meeting. The following
members were present and voting: William Chepulis, Chairman; 1'rit2 Ostherr,
Vice-Chairman; William N. Salemme, Clerk; and Paul R. Lamprey.
.Prank Co Gelinas, representing Benchmark Construction Co., Inc., petitioned for
a subdivision of a parcel of land containing approximately 11L acres situated
on Winter Street, subdivided into 5 lots and to be known as "Benchmark Estates".
Mr. Gelinas presented plans to the Board and stated that the proposed road is
575 ft. in length and contains a oul de sac with a 75 ft. radius. The land is
serviced by municipal water; an 8" water line presently exists on Winter St.
which will be tied in with a 6" line to be brought to the end of the cul de sac.
The drainage includes 3 sets of catch basins. There is no sewer system. All
the drainage is from Winter St. to the middle of Lot 15 where there is an inter-
mittent stream,and easements to that location will be provided.
The following abutters voiced opposition to the proposal: Mike Smolak, John
Benincasa, Adam Marcinuk. The following neighbors voiced opposition: Joyce
Sanstrom, Sandra Munroe, Patty Zahouriko. The opinions of the above persons were
that the environmental problems already existing in this area will be substantially
increased by the development. All cited the fact that the area is extremely wet
and were concerned about the brook which runs through the property and the drainage.
At a meeting held on March 22, 19769 the Subdivision Control Subcommittee moved
approval of the definitive plan subject to the following conditions:
1, that the record owners of the subject land forthwith execute and record a
"covenant running with the land", or otherwise provide security for the construc-
tion of gays and the installation of municipal services within said subdivision,
all as provided by G.L. c. 41 , S. 81-U.

2. that all such construction and installations shall in all respects conform to
the governing rules and regulations of this Board.
3. that water, and sewer if applicable, improvements be constructed in accordance
with the standards of the Board of Public ijorks.
Q.. that fire protection improvements be constructed in accordance with the standards
of the Board of Fire Engineers.
5, that roadway and surface drainage be constructed in accordance with the standards
of the Highway Surveyor.
6. that no lot be built upon until a subsurface sewage disposal system permit be
granted by the Board of Health,
7. that the hydrants shall be located at locations to be determined by the Board of
Fire Engineers.
8. that the paved roadway be 26 feet in 'width, with an 18" gravel overlap on each
side.
go that drainage be installed across the roadway at approximately station 2+00 to
relieve the impoundment that might otherwise occur.
10. all drainage easements shall be deeded to the town of North Andover.
The vote on the motion was as follows -- Messers Chepulis, Ostherr and Lamprey in
favor; Messers Monteiro and Salemme opposed.
