HomeMy WebLinkAbout07-18-1989 Legal Document PRD -unsigned- i 1 EN2LIIMETARY C70VENANZ' DATE: North Andover, MA KNOW ALL MEN by these presents that the undersigned have submitted an Application dated April 28, 1988 to the North Andover Planning Board for approval of a definitive subdivision, Planned Residential Development Special Permit of Land entitled "Woodchuck Grove", plan by Design Engineering, -Associates, dated April 28, 1989, with seven (7) revisions through July ,7, . . 1989, owned by Wilmac Realty Trust and Walter F. and Isabelle M. Grady of land located on the Westerly side of Salem street and showing seventeen (17) proposed lots. The undersigned has requested the Planning Board to approve such Plan. In consideration of said Planning Board of North Andover in the County of Essex, approving said Plan, the undersigned hereby covenants and agrees with the inhabitants of the Town as follows: 1. That the undersigned or their Executors, Administrators; Devisees, Heirs, successors and Assigns, shall not apply for a Building Permit on any of the Lots in the subdivision until they have filed with the Planning Office, a proposed Site Grading and House Construction Plan for each lot. The filing of such Plan shall be a prerequisite to the obtaining of a Building Permit for construction of a home on any lot within the subdivision. The Planning Board shall release Lots on an individual basis for construction upon the filing of a Bond 1h an amount of Two Thousand and no/100 ($2,000.00) 'Dollars, to assure that no erosion or other construction problems will occur to the detriment of the Town or other lot owners within the subdivision. Upon satisfactory completion of the construction on the site, on each given lot; the Bond and this covenant shall be released. 2. The undersigned agrees to record this covenant with the Essex County Registry of Deeds forthwith, or to pay the necessary recording fees to the said Planning Board in the event the Planning Board shall record this document forthwith. 3. This covenant shall be executed before endorsement of approval of the definitive plan by the Planning Board and shall take effect on the endorsement of approval.
