Dear Planning Board:
Please find enclosed ten sets of the documents required under
the Zoning By Law for a Special Permit PRD. The development
complies with all of the relevant provisions of this By Law.
In addition, we have worked hard to address all of the
concerns raised by the Technical Review Committee in our
submission. The team of professionals assembled include Joe Borgesi,
Andover Consultants, Curt Young, Sasaki Associates and Claude
Miquelle. They have allowed us to present an extremely carefully
planned, environmentally sensitive and high quality development.
Supplementary information on Sasaki Associates and Claude Miquelle
is enclosed for your reference.
While we are disappointed that Scott Stocking is no longer with
the Town, we would urge you to contact him with respect to the time
and care invested in complying with the objectives and suggestions
of the numerous committee meetings which he chaired.
We are proud of this submission. We believe that it goes
beyond meeting the letter of the By Law by capturing the spirit of
those who drafted the By Law.
We look forward to the public hearing on March 16, 1989.

the Rosemont project . There are two specific areas of
concern about the Rosemont design and the effect it wi l 1 have
on Holly Ridge : the sewer connection and the runoff .
Holl -° Ridge is a 13 lot subdivision which required a
sewage pump station . A station of a 10 gpm capacity with a. 2
inch force main would have been adequate to serve that
prof ect . Hoviever , through the Planning Board process and at
the direction of -the North Andover D. P .W . 2MC: Trust was
r•epu i red to i nstal 1 a 250 gpm stat i on and a 6 i nch force
main . The reasoning for the larger station as presented b>,
the G . P .M . was that eventually the Town would like the
station to serve as part of a central sewer system and serve
far more homes than just Holly Ridge . If ZMC was required to
put in such a large station it would seem reasonable that the
Town would require " Rosemont " to provide sewer improvement to
the Holly Ridge pump station rather than to allow the sewage
to f 1 ow to the Route 114 pump station .
The drainage analysis as presented by Andover
Consultants •for Rosemont shows a zero increase in peak flow
for the 100 year storm , but an increase in flow for the 10
and 50 year storms . Additionally , the drainage study does
not account for the effect of the increased volume the Holly
Ridge subdivision nor cues it evaluate the combined effect of
the increased volume with Mosquito Brook .
It is my opinion that this project wi l 1 cause flooding
of the Holly Ridge subdivision and vli l l poss i bl Y increase the
rate of f 1 ow of Mosquito Brook north of ,Johnson Street .

I am writing in regards to the development entitled " Rosemont "
which went before the Planning Board on March 16th , 1989 .
The questions and concerns that were raised that night were as
follows ;
* The Planning Board has scheduled a site visit for
March 25 , 1989 . We would like you to have the center line
of Rosemont Drive , and all intersections clearly marked .
* The Planning board would also like to see examples of the
kind of rip-rap walls that you have proposed for the
entrance off Chestnut Street .
* Considerable concern was raised regarding the proposed
sewer system and how the site would handle run-off during
peak levels . I realize that you are prepared to answer any
questions as they arise and I am confident that you will
keep me informed as to your conversations with
Christiansen & Sergi .
The Planning Board has voted to continue the public hearing on
this matter until the first meeting in April , which will be held
on April 5 , 1989 . In the event that you have any questions , do

An Environmental Notification Form has been submitted for this
project . According to Chapter 30 , Section 62 , the Secretary of
Environmental Affairs must issue a decision regarding the sig-
nificance of the potential environmental impacts of this project ,
and must determine whether and Environmental impact Report should
be required to document these impacts and all feasible means to
reduce damage to the environment .
Therefore , a consultation meeting will be held to receive advice
and comment from agencies , officials , and citizens regarding
which environmental issues , if any , are significant on this
project , Opinions as to the extent of significance of possible
environmental impacts will be welcome :

Dear Planning Board:
Drainage concerns were raised by the engineer for the
principals of the Holly Ridge (Deerfield) Subdivision at the original
hearing on the Rosemont development. This abutter feels, based on
their engineering data, that flooding could result on their property.
While we are confident that this will not occur, we are undertaking
an analysis of Musquito Brook to confirm our data. The abutter is
unwilling to share this information with us, notwithstanding the
request made by the Planning Board.
Therefore, we request a continuance of our hearing until April
20, 1989 to undertake the additional analysis.

In the course of the permitting process, a number of written
inquiries or questions have been submitted to Parthenon regarding
this development. Attached to this memorandum are the four
separate letters.
All questions have been now satisfactorily resolved as follows:
1. North Andover Fire Department letter dated
March 15, 1989
1 . Residential Sprinklers will be installed;
2. All road grades are 9% or less;
3. Names of roads approved by the Fire Department;
4. Hydrants will be placed in conformity;
5. Signage will be posted;
d. Box will be installed with keys given to Fire Department;
7. A fire break will be maintained as requested;
8. There will be numbers on all houses;
9. Alarm and detection devices will be approved by Fire
Department prior to installation,

IV. Planning and Community Development letter dated
May 4, 1989

We have worked very hard with all concerned town officials
and look forward to securing the Special Permit and developing
Rosemont, which should prove to be an asset to the community and
a financial gain. to the tax base of the community.
Rosemont is an efficient use of Clay Pit Hill in harmony with its
natural features. The vast majority of the land is preserved as open
space and is subject to a perpetual restriction. While fully
protecting natural resources, we are meeting the town's housing
needs by providing luxury attached single family homes in which
the owner's can enjoy carefree living.

Gentlemen:
At this time, we have responded to all the concerns raised by
the various town officials and agencies with respect to this
development.
Reference is made to several new documents submitted since
the time of the last public hearing including copies of:
1 . Site Plan Submission dated May 11, 1989;
2. The expanded drainage study of Andover
Consultants, Inc.;
3 . The Erosion and Siltation Control Program
revised May 5, 1989 by Wetlands Preservation,
Inc.;
4. Boydco Booster Water Pumping Station information;
5 . Written reply to all 82 written questions posed
by various town boards or agencies pursuant to
these hearings; and
6. The Usable Open Space Restriction.
The revised plans reflect that sewer will tie in at the Holly
Ridge Pumping Station.

This issue was raised by Christiansen & Sergi in their March 1.5,
1989 letter to the Board.
Further, they questioned the drainage analysis previously

submitted. Be advised that extensive additional drainage analysis I
and plan revisions have been made with the following results:
1. . Zero increase in flow for the 10 year, 50 year
and 100 year storms;
2. The drainage study now has reviewed the
entire Mosquito Brook watershed and accounts
for the increased volume of the Holly Ridge
Subdivision and the combined effect of the
increased volume with Mosquito Brook.
3 . The study demostrates no impact on the Holly
Ridge Subdivision and the rate of flow of
Mosquito Brook North of Johnson Street.
Discussions have taken place between Mr. Christiansen and
Andover Consultants, Inc. A copy of the drainage analysis has been
presented to Mr. Christiansen although he has not supplied a copy of
his work product.
In any event, by objective analysis, this development will not
adversely impact any abettors with respect to drainage.
At this point, the Planning Board has all the information
necessary to make a decision granting a Special Permit for Rosemont.
I respectfully request that you close this public hearing and reach a
decision as soon as possible.
I believe that Rosemont can be a model development for the
Town and is exactly what was intended when this Special Permit law
was enacted.

Dear Mr. Huntress:
We hope that there was no confusion at the hearing on
Thursday, May 11, 1989 about the location of the groundwater.
We want it to be clear that groundwater had been previously
located by test drillings. In particular, there were questions about
the water table along the dirt access road into the site from Chestnut
Street, This was suggested by a Planning Board member as an
appropriate test location. Three separate drillings took place along
this road. (See the attached location map.) Groundwater was
observed at 10 feet. I can have Briggs confirm this in writing if you
wish. I can also have additional test drillings or holes dug for
observation at your convenience. I believe that Mr. Perna and Mr.
Nitzsche of the Board were going to follow up on this matter. Would
you check with them and please advise.
We continue to try to satisfy all the concerns of townspeople as
we attempt to build a model development under the special permit
law.
We look forward to hearing from you.

Dear Mr. Hedstrom:
Reference is made to the attached June 14, 1989 letter from J .
William Hmurciak to you regarding the comments of the Division of
Public Works. Mr. Hmurciak was not available today so that we were
unable to talk with him directly. However, we have or can address
all of his concerns.
Please be advised that we are in accord on item 1 . An
acceptable condition would be:
"The maintenance and operation of the proposed booster
water pumping station will be the responsibility of the
owner. The station shall not reduce the residual pressure
in the Chestnut Street water main to less than 20 psi
under any operating condition. Prior to construction, the
final design of the pumping station, including the location,
site grading, landscaping and appurtenances of the
booster station shall be subject to the review and
approval of the D.P.W."
Items 2, 3 and 7 are acceptable and will be available for the
review and approval of the D.P.W upon Mr. Hmurciak's return next
week,

With regard to item 4, Andover Consultants designed and
analyzed the tennis court detention pond so that there will be no
such topping even in a 100 year storm.
With regard to items 6 and 8, an agreement has been reached
with ZMC Realty Trust and they will provide the necessary
documentation for Mr. Hmurciak with regard to the permit for the
Division of Water Pollution Control.
With regard to item 5, Andover Consultants designed the sewer
and water main at the manhole of station 4 + 0 so that there is no
crossing. Since they parallel each other, there appears to be no
reason to provide additional vertical separation.
I trust that this will satisfy all concerns.

Dear Mr . Hedstrom:
The Division of Public Works has reviewed the May 11 , 1989
revision of the Rosemont site plan and has the following comments to make ;
1 . The maintenance and operation of the proposed booster
water pumping station will be the responsibility of the
owner . The station shall not reduce the residual pressure
in the Chestnut Street water main to less than 20 psi
under any operating condition. The location, site grading ,
landscaping and appurtenances of the booster station shall
be shown on the plan. The final design of the pumping
station shah. be subject to review and approval by the
D. P.W.
2 . The Nast hydrant on Ridge Court should be placed on the
end of the water main with the services tapped in before
the hydrant .
3 . A detail of the connection to the water main on Holly
Ridge should be shown on the plan.
4 . The emergency outlet structure for the tennis court
detention area must be capable of handling the projected
peak out flows assuming the outlet control pipe is
plugged without topping the availabale freeboard.
5 . The invert of the sewer at the manhole of station 4 + 0
on the emergency access lane should be lowered to provide
proper vertical separation between the .water and sewer
mains .
6 . A sewer system extension permit from the Division of Water
Pollution Control of the Mass . Department of Environmental
Quality Engineering, and written permission from the owner
to enter the Holly Ridge Road Pumping Station must be obtained
prior to issuance of a sewer extension permit by the Division
of Public Works .

7 . A drop manhole connection should be added to the detail
sheet .
B . Permission to open the street and construct roadway and
utilities within the Holly Ridge Road R. D.W. must be
obtained from the owner of that subdivision .

commencing construction on this development be extended from one year to
two years. The permit for the Rosemont development is dated July 18, 1990
