Osgood, Katherine C. Osgood and Gayton Osgood, Trustees of Old North Andover Realty Trust, gave to the Planning Board of North Andover, Essex County, Massachusetts, by notations attached to a plan recorded as Plan No. 5537, their covenants and conditions running with the land to assure said Town of their compliance with said Board's rules and regulations governing the construction of ways and the installation of utilities to service Lots 8, 9, 10, 11, 12, 13, 14, 15, 16, 17,' 26 and 27 as shown on Plan No. 5537, recorded in the Northern Registry District'; of said County, and 11I1EREAS, Old North Andover Realty Trust (hereinafter called the Trust) , the present owner of the area shown on said plan, and its developer, now desires to avail itself of the option accorded to it by G. L. c. 41, s. 80 U, of otherwise providing such assurance as to the installation of such services to certain mwmbered lots shown on said Plan, NOW THEREFORE, in consideration of the "Release" by said Planning Board of certain of the conditions of said Covenant, which is to be recorded herewith, The Trust, by its Trustees, Benjamin C. Osgood, (Catherine C. Osgood and Gayton Osgood, as Principal, and Said Benjamin C. Osgood, Katherine C. Osgood and Gayton Osgood, all of said North Andover, individually and jointly and severally, as Sureties, hereby ARE AND STAND FIRMLY BOUND unto said Town of North Andover in the full and just scan of Twelve Thousand (�a12,000.00) Dollars all as follows: THE CONDITION OF THE FOREGOING OBLIGATION is that if the Principal, in or within one year from the date hereof, shall faithfully and fully comply with all such rules, regulations and requirements of said Planning Board, including any conditions which may have been or which may hereafter be specifically im- posed by it, relative to the construction of i ys and the installation of municipal services within, said tract to service Lots 8, 9, 10, 11, 12, 139, 14, 15, 16, 17, 26 and 27, inclusive, as shown on said Plan, then this obligation shall be null and void BUT OTHERWISE THE SATE SHALL BE AND RZvTPJN IN FULL FORCE AND EFFECT, AND NAY BE ENFORCED BY SAID PLANNING BOARD FOR THE BII`�EFIT OF SAID TOivT? OF NORTH ANDOVER, all as provided by the governing provisions of law. ACID W11E5, the Trust has or will hereafter deliver to said Planning Board a certain book evidencing a savings account, standing in its name, in Merrimack Talley National Bank, as a deposit further to assure its compliance with the conditions of its foregoing Bond, NOW THEREFORE, the Trust hereby assigns and sets over to the Town of North Andover all its right, title and interest in and to said account, and authori- zes said Planning Board to cake withdrawals therefrom, from time to time, applying the same for the benefit of said Town under the provisions of said s. 80 U.
