Dear Attorney Johnson,
Andover Consultants has prepared the responses below to an abutter email sent to Jennifer Battersby dated October 9,
2023 regarding the above referenced project.
The abutters comments have been-reproduced below in italics with our response following in bold.
Lot 13:
Comment: The majority of the house is within the 100'Buffer Zone
Response: The proposed dwelling is within the 100' buffer zone,and as such a filing is required to be made with
the Conservation Commission,which will be done following the issuance of a decision from the Zoning Board of
Appeals.
Comment:Approximately 35% ofthe driveway is within the 100'Buffer Zone.
Response: 1,343 sf of the 3,742 sf driveway shown on the preliminary plan prepared for Lot 13 is within the 100'
buffer zone(t35.9%)which is allowed under both the Town of North Andover's Wetland Bylaw and the
Massachusetts Wetland Protection Act. A Notice of Intent will be submitted to the North Andover Conservation
Commission as is required for work within the buffer zone.
Comment: The drywell is within the 100'buffer zone.
Response: Drywells are allowed within the 100' buffer zone.
Comment: The majority of the driveway is too close to the neighboring property and not ivithin the setback line.
Response: The side setback applies to structures, not driveways. The driveway was located to maximize separation
from the from the resource area.
Lot 14:
Comment:A portion of the house is within the 100'Buffer Zone.
Response: The proposed dwelling is within the 100' buffer zone,and as such a filing is required to be made with
the Conservation Commission,which will be done following the issuance of a decision from the Zoning Board of
Appeals.
Comment:Approximately 55%ofthe driveway iswithin the 100'BufferZone
Response: 2,389 sf of the 4,085 sf driveway shown on the preliminary plan prepared for Lot 13 is within the 100'
buffer zone(±58.5%)which is allowed under both the Town of North Andover's Wetland Bylaw and the
Massachusetts Wetland Protection Act. A Notice of Intent will be submitted to the North Andover Conservation
Commission as is required for work within the buffer zone.
Comment: The drywell is within the 100'buffer zone.

Lot 1 S:
I have a completely different set of concerns with lot 15, The lot itself does not meet the street fi-ontage requirements and
based on the terrain and location of the 100'Buffe Zone, the proposed location of the home and driveway are on/within
higher elevation. How can a home, driveway, septic system, and drywell be built on top of a hill without causing
significant disruption to the surrounding homes, wetlands, and more Blasting damages homes and affects the water table
and will very likely cause issues for years to come. My home is within the F&MA Flood Zone (Zone A) and I am deeply
concerned with any changes or disruption to the water table. I am against building within the wetland surrounding my
home (and all ofNorth Andover) and even more concerned when the proposed lot don't meet current zoning laws.
The threat of water and flooding is real and only getting worse. Current zoning bylaws and wetland protection are in
place to protect residents and prevent catastrophic damage caused by the changing landscape. If the zoning board
approves these variances, it will cause additional issues as climate changes continues to impact us all.
Response: All permits will be submitted for and obtained to ensure all applicable regulations(i.e.wetlands, septic
system, blasting)will be submitted for as necessary to ensure compliance with local and state regulations.
Though the three lots before the Board are not subject to the Massachusetts Stormwater Standards,as these
standards do not apply to single family houses or to housing development projects comprised of detached single-
family dwellings on four or fewer lots,each lot has been proposed to infiltrate roof runoff into a drywell and
driveway runoff into a crushed stone infiltration trench. These features have been included to mitigate stormwater
runoff and to promote stormwater recharge on site.
