Beit enacted, etc., as follows- Section 81P of chapter 41 of the General taws, asappearing in the 1984 Official Editions, is hereby amended by string out, in lines 13 and 1, the word "fourteen" and insie r ting in place thereof, in each ins- t ance. the word:- twenty-one. Approved June 3, 1 Constructive Approval/ Endorsement Kupperstein v. Planning Bd., 66 Mass. App. Ct. 905 (2006). The statute, G. L. c. 41, § 81P, is clear, and the Legislature utilized the mandatory word shall in several instances. The statute directs that the planning board shall give written notice of its determination to the clerk, and if not, the board "shall be deemed to have determined that approval . . . is not required, and it shall . . . make such endorsement on [the] plan, and [upon] its failure to do so . . . [the municipal] clerk shall issue a certificate to the same effect" (emphases supplied). G. L. c. 41, § 81P. In the event of a plan's constructive approval, the action of the board, or of the municipal clerk, is mechanical, and the landowner's entitlement to the endorsement and certificate is mandatory. Georgetown Planning Bd. v. Georgetown Planning Bd., 2014 Mass. LCR L XIS 115, *11-12. Here, the intent of the constructive endorsement provision in G.L. c. 41, §81P is plain from the face of its words: if the board fails to act on an ANR application in timely fashion, it "shall be deemed to have determined that approval under the subdivision control law is not required, and it shall forthwith make such endorsement on said plan, and on its failure to do so forthwith the city or town clerk shall issue a certificate to the same effect." Adams v. Brolly,46 Mass. App. Ct. 1, 3 (1998). As a result of the planning board's failure to record its action pursuant to G. L. c.41, § 81P, however,the plan was constructively endorsed.
