HomeMy WebLinkAbout2024-07-15 Select Board Minutes NORTH ANDOVER SELECT BOARD MINUTES JULY 15, 2024 Executive Session: Chair Roache stated the Board will enter Executive Session pursuant to Massachusetts General Law chapter 30A, Section 21(a)(3)- to discuss strategy with respect to litigation- 27 Charles Street as an open meeting may have a detrimental effect on litigating position, pursuant to Massachusetts General Law chapter 30A, Section 21(a)(3)- to discuss strategy with respect to litigation-Kroger opioid settlement as an open meeting may have a detrimental effect on litigating position, pursuant to Massachusetts General Law chapter 30A, Section 21(a)(2)- to conduct strategy session in preparation for negotiations with non-union personnel, pursuant to Massachusetts General Law chapter 30A, Section 21(a)(3)- to discuss strategy with respect to collective bargaining as an open meeting may have a detrimental effect on the bargaining. Ms. Phillips seconded. Motion approved 5-0. Call To Order: Chair Brian Roache called the open meeting to order at 7:02PM in the Select Board Room located at 120 Main Street North Andover. Select Board in Attendance: Chair Brian Roache, Janice Phillips, Laura Bates, Clerk Rosemary Smedile and David Kres were present. Non-Board Members in Attendance: Town Manager Melissa Rodrigues, Deputy Town Manager Denise Casey and Assistant Town Manager Laurie Burzlaff were present. Public Comment George Chory of 81 Bradford St brought a petition for a truck exclusion on Bradford St. Brian Gross of 45 Settlers Ridge Rd asked the Board to support the petition for a truck exclusion on Bradford St, speed reduction on the street, add road barriers and add traffic signage as well as cutting back the vegetation. Susan Carpenito of 68 Bradford St stated the urgency for something to be done with Bradford St traffic and speed control. Randy Hart of 151 Carter Field Rd stated the fear of walking on Bradford St. Chris Irwin of 105 Carter Field Rd stated that walking on Bradford St is impossible with even wind from vehicles almost knocking her over from the excessive speed of the truck. Anne Meehl of 31 Bradford St stated the difficulty of going in and out of the driveway due to excessive speed on the road. Paula Andreoli of 15 Bradford St stated the difficulty of obtaining mail from the mailbox due to vehicle excessive speeds. Delores Betcher & April Betcher-Winter of 80 Bradford St. stated the concern for the excessive speeds and fear of going on walks. Dominic Mangano of 324 Bradford St stated that tractor-trailer trucks are still operating late at night and are using jet brakes waking people up at night as well as the use of excessive speeds by vehicles. Tim Boland of 56 Bradford St stated the concern for the excessive speed as well as trucks operating late in the evening. Amy Mastromonaco of 222 Bradford St stated the excessive speed of vehicles and the concern of walking on the street, getting the mail and retrieving trash cans. Њ NORTH ANDOVER SELECT BOARD MINUTES JULY 15, 2024 LICENSING MOTION: Ms. Smedile motioned to open a meeting of the North Andover Licensing Commission. Ms. Bates seconded. Motion approved 5-0. MOTION: Ms. Phillips motioned to open the public hearing to hear comments on the application from Konstandinos Chongris . Ms. Smedile seconded. Motion approved 5-0. PUBLIC HEARING- beverages restaurant license at 80 Chickering Road all alcoholic beverages restaurant license at 80 Chickering Road MOTION: Ms. Smedile motioned to close the public hearing to hear comments on the application from Konstandinos Chongris . Mr. Roache seconded. Motion approved 5-0. ant license at 80 Chickering Road MOTION: Ms. Phillips motioned to an all alcoholic beverages restaurant license at 80 Chickering Road. Mr. Roache seconded. Motion approved 5-0. MOTION: Mr. Roache motioned to close a meeting of the North Andover Licensing Commission. Ms. Smedile seconded. Motion approved 5-0. (out of order) Discussion regarding Bradford Street speeding and truck use Ms. Rodrigues explained the study for Bradford St. traffic had been ordered and will be stating. Ms. Rodrogues explained as follows: Heavy Commercial Vehicle Exclusions are regulated by MassDOT. According to MassDOT, any public way is eligible for a Heavy Commercial Vehicle Exclusion provided a suitable alternate route is available and approved by MassDOT. The alternate route must meet one of the following conditions: approval. Ms. Bates mentioned putting radar signs out to make drivers more aware of their speed. Ms. Bates mentioned the excessive vegetation on Barker Street to Carter Field Road. Ms. Smedile asked Chief Gray what can be done to mitigate this issue. Chief Gray stated the police have been adding cruisers to Bradford Street as well as radar signs. Public Comment (out of order) by Vin Roberts of 270 Bradford St mentioned when trucks turn to Route 133 they are forced to slow down but they do not slow down on Bradford St. Jeremy Hall of 102 Bradford St. asked the Town Manager if the comprehensive study report will be made public. Ms. Rodrigues stated yes. Mr. Hall asked if specific recommendations will be made and will it be comprehensive. Ms. Rodrigues stated yes. Ms. Rodrigues suggested Mr. Hall send an email request to receive the scope of the project. Mr. Roache asked if it is known how much room is available to improve the shoulder. Ms. Rodrigues stated will look into the right of way. Ћ NORTH ANDOVER SELECT BOARD MINUTES JULY 15, 2024 Vote on Memorandum of Understanding with Police Lieutenants MOTION: Ms. Phillips motioned to approve the Memorandum of Understanding with the Police Lieutenants as presented. Ms. Smedile seconded. Motion approved 5-0. Vote on contract with Fire Chief John Weir MOTION: Ms. Bates motioned to approve the contract with Fire Chief John Weir. Ms. Smedile seconded. Motion approved 5-0. Request from North Andover Athletic Association to change the date of their road race from October 12, 2024 to October 19, 2024 MOTION: Ms. Phillips motioned to approve the contract with Fire Chief John Weir. Ms. Smedile seconded. Motion approved 5-0. Vote to approve MOU with Haverhill for kennel Mr. Roache asked how many animals a day need the kennel. Chief Gray stated at least one a day. MOTION: Ms. Bates motioned to approve the Memorandum of Understanding with Haverhill for a kennel. Ms. Phillips seconded. Motion approved 5-0. Appointment of Select Board member to Affordable Housing Trust MOTION: Ms. Bates motioned to appoint Janice Phillips to serve on the Affordable Housing Trust for a term ending June 30, 2026. Ms. Phillips seconded. Motion approved 5-0. Discussion regarding school deficit Ms. Rodrigues stated the following regarding the school deficit: the FY2024 total deficit for the North Andover Public Schools totals $4,560,383.17 after the amount needed to cover the deficit by the Town and Schools was $5,619,953.17. Vote on FY24 budget reallocation MOTION: Mr. Kres motioned to approve the FY24 budget reallocation as presented. Ms. Phillips seconded. Motion approved 5-0. Approval of Open Session Minutes of June 17, 2024 and June 27, 2024 MOTION: Mr.Kres motioned to approve the Open Session minutes June 17, 2024 as written. Ms. Phillips seconded. Motion approved 5-0. MOTION: Mr. Kres motioned to approve the Open Session minutes June 27, 2024 as written. Ms. Phillips seconded. Motion approved 5-0. SELECT BOARD UPDATES th Ms. Bates thanksed the Festival Committee for the July 4 activities Ms. Bates thanksed the DPW for their hard work with the recent water main break Ќ NORTH ANDOVER SELECT BOARD MINUTES JULY 15, 2024 Mr. Roache thanked the Police and Fire departments for the recent incident at Village Green TOWN MANAGER UPDATES - Ms. Rodrigues ADJOURNMENT MOTION: Ms. Phillips made a MOTION, seconded by Ms. Smedile to adjourn the Select Board meeting at 8:22PM.
