T,qo development of this condition is apparent daily. If the reasirod precautions (hay , properly applied , etc . ) to promote stabilization , as ground in opened , are not enforced : by you the Acumulation of sodiment in this wetland - feeder to Lake Cochich6wick will continue . This condition is very distressing and di2couragino to those in the neighborhood Mho have attempted for over two years , with little goccess , to protect and preserve this we?: and area and its InhabI tan ts. I over 100 years of ecological balance have been dred3el out of Long, island and Duck Fond and trees have been felled ,-!hcre they ' should not have been felled . some of the amphibians which inhabited those three ponds were removed to and found rofuZe In Sutton' s Pond . Though limited , the concessions by the Department of Natural Resources to your recommendations should nonetheless be strictly enforced and I request same . March 1 , 1976 Dear Members, aben we bought our property at 12 Sutton dill Road tivent,y years ago , Glen load was shown on the plan as a road which would someday b© behind our property. Jftat form it would take , a dead end street or (9, full street , was something we never knew. Nevertheless , the fact that it was a road implied certain safeguards , e .g. maintenance by the Town, catch basins, berms , etc. Now that a driveway is going to replace Glen Road as the means of access to lots in the Appledore developoment there are questions which arise in terms of protection of abutting property. Perhaps you can answer them or refer me to the proper Town Department for answers . � The questions are : 1) What footage is required on either side of a driveway for protection of abutting property? 2) This proposed driveway which will run between the ,Bradley and Caimi homes will carry water from the cre:gt of Sutton Hill to a low point beside our back yard . This could ar,gravate and increase an already existing seasonal accumulation of water . 'ire there any re'auirements for controlling or directinf* tha flow of water from the crest of the hill? 3) May the drainage plans be seen by an abutter? 4) If it is not out of order , I would Itke to ask that the site of the proposed driveway be viewed by members of the Pla.nninF Board . Our concern is understandable if you know that for many years we had lavin washouts from the flow of water from the crest of Sutton Hill Road down into our front ,yard . It was partially corrected about six years ago through cooperr motion between us and the Town . The Town put in berms and tried to correct the patch of the road ; we built and seeded ban'x_ings . It is still a problem under certain conditions . It manes sense to us to bring this to ,your attention before , rather than after a problem exists even though I am referring to a. driveway rather than to a Town road . I understand your answer to me at the Planning Board Meeting of Harch 1 , 1976 but could you not encoura:•e Appledore Associates to tale every precaution in re •ard to drainaC-,e? I wish to emphasize that this letter in no way indicates objection to the access route to the Appledore lots or the development of them ; our only concern is drainaCe . Dear Planning Board, In my letter of March 1, 1976 1 said that I do not object to the access route to the Appledore :dots. I am concerned, however, regarding the form that the access route takes, e.g. , driveways or a town road. A torn road, as I stated in that Letter, implies certain j safeguards; maintenance by the town, proper drainage, catch basins, and berms, etc. Another safeguard a town road provides is public safety in terms of fire. 1 request that you obtain an opinion from the Fire Chief ( in accordance with Section III E-1 of the Revision to Subdivision Rules) about accessability to lots 30, 31 and 32 in case of fire now that driveways are under consideration as access routes. By definition, ( Pg. 5 of Zoning By-laws) , a "Lot line, rear" is "The lot line opposite and most distant from the front lot line". By definition, ( $ection II A of Revision of Subdivision Rules) , a driveway is "a means of vehicular access to a lot , either through the frontage or from streets adjacent to the side or rear lot lines. Each driveway shall serVIce no more than one lot, except for multi- j family dwellings". Sutton Hill Road i® not adjaoent to the rear lot Lines of lots 30, 31 and 32, I think that that 18 why it appears ( on the Study Plan of this area) to be somewhat unusual to see driveways placed between already established homes in order to reach rear lot lines which are not adjacent to any street. Road North Andover , Mass. 01845 Tel. 685-7768 Enc. #I Statement read at Planning Board Meeting on Dec. 6 , 1976 Re : Ponds in Appledore Development Yoatord,:3,y I phoned a amber of the Conservation Commission and two members of the P1 Ing Board because I thought that seeing first hand the tra ional recreational use of Ponds within our watershed would' ramn'tie'ally bring home the massage that out-of-town developers , with no sensitivity to �ihat makes North Andover the kind of town it is , are taking from us -much that we hold dear and value. All day Saturday and Sunday, roughly forty children from all over the area were participating in healthy, invigorating exercise and play as they skated. Indirectly, they were absorbing the beauty provided for so long by those ponds. Sutton's Pond, the largest and once the most crowded of the series of ponds was virtually empty because now, of course, It is privately owned and can be used only with permission. The young people are yet unaware that by this time next year the same will apply to the ponds they were using yesterday and which have been used in this manner for over 150 years. To the best of my knowledge there is not ever a town easement for the protection of these ponds which are a tributary to our . public water supply, or for their use by the Department of Public Works when our resevoirs are emptiod for cleaning or repairs, not- to mention for recreational use.. Their protection, by easement granted. to the Town of North Andover, would in my judgement accomplish the following: 1. ) It would set a provident for the protection of other tributaries to our water supply. 2. ) It would correct an ommission in our Greenbelt Plan which provides nothing for recreation in the general area n question, 3. ) It would serve notice to out-of-town developers who come in to our town. to make money on wall tag: lot plans , with, little regard for traditional and ml�nicipal pro- vision, that we have had enough and plan to protect thRt which is the essence of our town. In the Appledore N6tice of Intent, page 44, line E, it states ,'., that , "The Appledore proposal will : E) Increase the amenities of the town by the preservation of open space and recreation areas . " I do not see any recreation areas provided for the town in the Appledore Development. I earnestly request that you ask flAll- fillm,-nt of thott intention of the Appledore Associates as a means of pursuing protoction and use of the ponds for now and future generations. In that interest I have submitted wording for an article in the Town Warrant to the Conservation Commission and I also submit it to you. The shortest skating season. was l? days long. The norm. is about 4-6 weeks of skating. The length of time and intervals depend completely j on the weather conditions , particularly precipitation, icy rain, slushy snow, etc, Fishing: The peak fishing is for about'. three weeks after opening day of the fishing season. Nhen school ends and families go away on vacation there is a let up. During the summer months there is only occassional fishing due in past to mosquitoes . There is another peak of activity just before school begins and them; is general fishing until the weathor chills. Doatl.ng;: Boating is' 'sore-what rare. Once in, a while someone tries a canoe or Inflated boat. calking: It used to bo quite common for children and adults to meander through the woods particularly in zthe area of the ponds.
