As I mentioned when we talked today,John asked me about the zoning boundary after the meeting and Jean Enright
brought it up today. Clearly,Jerry and I should have noticed this when we met with you before you filed the preliminary
plan and for that I apologize.
have attached the zoning map revised to 1992 that shows the zoning boundary to be the railroad ROW. I have also
attached the language of the 1987 Annual Town Report for the article that changed certain areas of the R-2 zone to R-1.
The language in the article clearly mentions that the boundary between the two zones in the "Eastern MA Electric
company right of way".

I wanted to let you know that I had not checked the zoning boundary for the Appleton St. plan as thoroughly as I should
have. The railroad ROW is the zoning boundary, according to the language in the 1987 zoning warrant article that
changed the zoning for the parcels around the lake from R2 to R1, Also, I have a copy of a zoning map from 1991 that
shows the ROW as the boundary. I called Phil Chrlistiansen this morning and have given him the attached information.
Jean was the one who brought this to my attention today—she is very observant! Let me know if you have any
questions.

Folks,
have attached the revised plan that I received today from Jack Sullivan for 0 Great Pond Road. Jack will stake out the
corners of the lot and will also stake out the corners of the proposed structure by tomorrow, so that it will be ready for
viewing by Saturday. We did not set a time for this visit—you can each go on your own schedule. (The site visit for
Appleton St. is scheduled for 9 AM Saturday.

Folks,
In advance of the site visit for the 464 Appleton St. development,you should know that there will be some changes
made to the plan based on zoning. The zoning boundary on the proof plan (attached) is incorrect. The R3 zone ends at
the railroad ROW. As a result, the entire development lies within the R1 zoning district which is 2 acre zoning. This will
change the number of lots that are allowed, I should have told the applicant about the zoning boundary when they first
met with myself and Jerry Brown (Building Inspector) but I missed it. Jean actually pointed this out to me last week and I
notified the developer.
The site visit will continue as planned and this item will be on the Planning Board agenda for September 18. If you have
any questions, let me know.

Dear Board Members:
The DPW Engineering Dept. has received a request for comment on the above referenced project. Based
on the Preliminary P. R. D. Subdivision Plan for"Regency Place"dated July 16, 2012 by Christiansen& Sergi
Inc, Haverhill MA. I offer the following comments:
1. The development utilizes many low impact development(LID) techniques requiring drainage
easements outside of the right of way. The DPW does not have personnel to maintain these
facilities. A homeowners association should be created to maintain the drainage in perpetuity. The
association should be referenced to in the individual lot deeds.
2. An O&M plan for the LID facilities should be created and incorporated in the home owners
association.
3. Much of the drainage infrastructure/swales as shown will be located on private property.
Easements should be created to describe the entirety and granted to the homeowners association.
a. The operation and maintenance of the entire drainage system listed in the Stormwater Report
will remain a private responsibility in perpetuity.
b. The Board's decision should reflect this fact preferably with deed restrictions on the
individual lots.
4. The DPW does not require the newly created subdivision road to be a through street to Appleton St.
5. The proposed new roadway entrance should leave Blue Ridge Road with a negative pitch.
6. The frame elevations for the proposed catch basins at the entrance of the subdivision should be lower
than the grades at the existing Blue Ridge Road edge of pavement.
7. The roadbed subgrade and gravel fill width must be the full 32 feet wide (4' at each shoulder) if the
granite curbing is to be waived.
8. Should check dams be installed in the steeper sections of the shoulder drainage Swale? Particular
attention must be paid to the grass seed mix proposed for the swales.
