Dear Mr, Huntress,
I am requesting that no decision regarding the easement on my
property located at 114 Penni Lane be made at the next scheduled
Planning Board meeting. I understand that the next scheduled
meeting is on 6/27/91. I am requesting a continuance to the Public
Hearing to allow my attorney sufficient time to examine all
appropriate material before a decision is made by the Planning
Board,
In light that Mr. Nelson has had Town's approval to build a road
through my property since June, 1990, and the first Planning Board
hearing was on June 13th, clearly indicates that it would be
unreasonable to not allow me and other abutters to have sufficient
time to understand and adequately respond to the issues.
I am planning to be present at the 6/27 meeting and will make my
request verbally for a continuance.

Dear Mr. Perna:
Since December of 1987 1 have been seeking relief from a situa-
tion created in the 1970fs when the N.A. Planning Board ac-
cepted a subdivision plan for what is now Penni Lane. The plan
provided an easement to my land but showed no frontage on the
road.
At the public hearing I asked the board if there would be any
impediment to my developing the property'. The board informed
me that the easement was there to facilitate further develop-
ment. For this reason I offered no objections to the plan on
this point nor did I request any modifications to the plan. As
it has turned out, the board was incorrect in its assumption
that I could simply go ahead whenever I chose to do so.
On June 13 1 will submit to the board a plan to extend the road
over the easement as provided by the original plan, and to
create a one-lot subdivision on a three-acre lot. Given the
significant costs and losses I have incurred over the long and
frustrating history of my efforts to develop the property,
(e.g. , acting in good faith on assurances from the Board and
staff that I would get access to my land and that I would not
be at risk, I bought a house to which I expect to retire
anticipating funds from the sale of my lot to finance the pur-
chase; I offered the Penni. Lane lot for sale and subsequently
had to turn down a substantial signed offer to purchase because
of the frontage problem. In the meantime the financial burden
of the purchase of my retirement home remains. )
Accordingly, I am asking the Board to waive the filing and per
lot fees normally associated with a subdivision plan. Had I
been advised accurately from the beginning, I would not be in
the position of having to file a subdivision plan at all.

This is to clarify my Letter of June 4 , 1990 in which T
granted you permission to construct a road on the Town' s easement
off Penni Lane. said permission also authorizes you to
incorporate the easement as a portion of the proposed street
right-of-way on a plan submitted to the Planning Board for
subdivision approval in connection with the development of your

Dear Mr. Nelson:
l have been informed by the Accounting Department that the
Town has been getting statements from the Lawrence Eagle Tribune
showing a balance of $94 . 54 . After a few months of the accounting
department researching the matter and getting all the paperwork
from the 'Tribune ' it is apparent that the $94 . 54 represents one
week publication of your legal notice , that of May 30, 1991 . The
notice published on dune 6 , 1991 was not paid. The total amount
for the two weeks was $189 . 08 .
T have enclosed copies of the original bill and statement for
your inspection. You can either send payment with a copy of the
enclosed directly to the ' Tribune ' or to the Town of North
Andover.
l am very ,sorry for this inconvenience . Your prompt attention
in this .matter is greatly appreciated.

Re: Charles Nelson - Penni Lane
I spoke with Charles Nelson this morning regarding his Penni Lane
lot. He needs to file with the Conservation Commission for work
being completed within 100 feet of a wetland. The only work in
this area appears to be grading for the construction of the
driveway; therefore a permit should not be difficult to obtain.
I will have the Conservation Office let you know when this item
is on the agenda for discussion.

At their meeting of August 1, 1995, the North Andover Planning
Board voted to release to Flintlock, Inc. the $1, 000. 00 bond plus
interest being held by the Town for Penni Lane.
The Board voted to release these funds as the site has been
completed according to the plan and we have an as-built plan in the
file.
