To the Planning Board:
The undersigned, being an applicant under Chapter 41, 81-0, 81-T, 814U, MGt_, for approval of a proposed
subdivision plan, hereby submits a Definitive Plan and makes application for approval to the North Andover Planning
Board:
The undersigned hereby applies for the approval of said Definitive plan by the Board, and in furtherance thereof
hereby agrees to abide by the Board's Rules and Regulations, The undersigned hereby further covenants and
agrees with the Town of North Andover, upon approval of said Definitive plan by the Board:
a. To install the utilities in accordance with the rules and regulations of the Planning Board, Department of Public
Works, the Board of Health, and all general as well as zoning by-laws of said Town, as are applicable to the
installation of utilities with the utilities within the limits of ways and streets;
b, To complete and construct the street or ways and other improvements shown thereon in accordance with
Section V and VI of the Rules and Regulations of the Planning Board, including all Appendices (1-VI)and
Figures(1-27), and the approved Definitive plan, profiles and cross-sections of the same. Said plan, profiles,
cross-sections and construction specifications are specifically, by reference, incorporated herein and made a
Part of this application. This application and the covenants and agreements herein shall be binding upon all
heirs,executors, administrators, successors, grantees of the whole or part of said land, and assigns of the
undersigned; and
C. To complete the aforesaid installations and construction within two (2) years from the date hereof.

Other Municipal Charges
The Town of North Andover General Bylaw Chapter 129-1, provides that any application for a
permit or license may be denied, suspended or revoked if the applicant or holder thereof has
failed or refused to pay any taxes, fees, assessments, betterments or other municipal charges
assessed to the applicant or holder to any business, corporation or trust in which that individual
has an interest. By signing this application, the applicant represents that he or she has paid all

PROPOSED WAIVERS -- 485 WOOD LANE DEFINITIVE SUBDIVISION

Requested waiver: 1. Chapter 165 sections 1-11 Stormwater Management and Erosion Control
Justification:
In place of Stormwater Management and Erosion Control plan and calculations,the
proposed pavement will be pitched towards our locus and a stone trench will intercept
the runoff along the entire length of the proposed 12' roadway on the locus side.
Requested waiver:2.Chapter 250 sections 1-49 Stormwater Management and Erosion Control
Justification:
In place of Stormwater Management and Erosion Control plan and calculations,the
proposed pavement will be pitched towards our locus and a stone trench will intercept the runoff
along the entire length of the proposed 12' roadway on the locus side.

Justification:
In place of Stormwater Management and Erosion Control plan and calculations,the proposed

Justification;
In place of the Standard street design,a 12'wide roadway,pitched towards our locus,without
curbing and a stone trench that will intercept the runoff along the entire length of the roadway will
be constructed.
Requested waiver: 5.Chapter 255 section 6.11 Sidewalks
Justification: Sidewalks will not be required for this Subdivision.
Requested waiver: 6.Chapter 255 section 6.12 Monuments
Justification:
There are no monuments proposed for this Subdivision.
Requested waiver:7.Chapter 255 section 6.14 Storm drainage
Justification: In place of storm drainage a stone trench will Intercept the runoff along the entire
length of the proposed 12' roadway on the locus side.
Requested waiver:B. Chapter 255 section 6.15&6.16 Water facilities&Sewers
Justification: A water and sewer main will not be required for this Subdivision,only a sewer service
line and water service line to the new dwelling.

Justification: Trees and other plantings are not proposed for this Subdivision.
Requested waiver: 10.Chapter 255 section 6.19 Guard rails
Justification:Guard rails are not proposed for this Subdivision.

Justification:A street sign,for Great Oak Street,already exists at the intersection of Wood Land and
Great Oak Street.

Justification: Street lights already exist at the locus.
Requested waiver: 13. Chapter 255 Attachment 1A3 Utilities
Justification: A water and sewer main will not be required for this Subdivision,only a sewer service
line and water service line to the new dwelling and there is already a gas main line and overhead
electric lines,on Great Oak Street to service the proposed lot.
Requested waiver: 14. Chapter 255 Attachment 1A8 Guard Rails& Posts
Justification: Guard rails will not be required for this Subdivision.
Requested waiver: 15.Chapter 255 Attachment 1B Curbing
Justification: In place of the standard street design, a 12'wide roadway, pitched towards our locus,
without curbing and a stone trench that will intercept the runoff along the entire length of the
roadway will be installed.
Requested waiver: 16. Chapter 255 Attachment 1C1-2 Sidewalk Pavement
Justification:There are no new Sidewalks proposed for this application.
Requested waiver: 17.Chapter 255 Attachment 1D Sidewalks, Pathways&Bicycle Paths
Justification:There is no existing bike path on Wood Lane and given the length and width of the
proposed 12' roadway,a bike path should not be necessary.
Requested waiver: 18.Chapter 255 Attachment 2.1 Pipes,Culverts and Drains
Justification: In place of Standard drainage specifications,a stone trench will intercept the runoff
along the entire length of the proposed 12' roadway on the locus side.
Requested waiver: 19.Chapter 255 Attachment 2-2 Catch Basins
Justification: In place of catch basins,a stone trench will intercept the runoff along the entire length
of the proposed 12'roadway on the locus side.
Requested waiver:20. Chapter 255 Attachment 3-1 Underground Electric Distribution System
Justification:There is already an overhead electric line servicing Great Oak Street.
Requested waiver:21. Chapter 255 Attachment 3-2 Applicant's Responsibilities for underground

Justification; Trees and other plantings will not be required and are not proposed for this
Subdivision.

Justification:

Waivers from Submission Requirements
With respect to items 1-6 herein ,the Applicant requests the Board to make a finding,in accordance
with Section 255-2.7.C.of the Subdivision Regulations,that the waived requirements do not
constitute a violation of state law nor do they impair the ability of the Board or other Town Boards
and officials to understand the nature and impacts of the proposed plan;nor would the waived
requirement impair the ability of the Board to process the application.
Waivers from Development Requirements
With respect to items 7-24,the Applicant requests the Board to make a finding,in accordance with
Section 255-2.7 of the Subdivision Regulations,that the waived requirements will not impair
functioning,long term maintenance nor appearance of the future development of the land shown on
the plan,and are consistent with the Board's development objectives which are to minimise pavement
and design the way in a manner which Is integrated into the redevelopment of the surrounding lots.
Waivers from Regulations Above
With respect to all the waivers above,the Applicant requests the Board to make a finding,in
accordance with Section 255-2.7 of the Subdivision Regulations that the grant of these waivers above
is in the public interest and not Inconsistent with the intent and purpose of the Subdivision Control
law.All of these requested waivers will not impair the functioning,long term maintenance nor
appearance of the future development of the land shown on the plan; nor will the waived
requirements result in an adverse impact for the areas adjacent to the land shown on the plan.
