hereby submits said plan as a DEFINITIVE plan in accordance with the Rules and
Regulations of the Forth Andover Planning Board and makes application to the
Board for approval of said plan.

The undersigned hereby applies for the approval, of said DEFINITIVE plan
by the Board, and in furtherance thereof hereby agrees to abide by the Board's
Rules and Regulations. The undersigned hereby further covenants and agrees
with the Town of North Andover, upon approval of said DEFINITIVE plan by the
Board:
1. To install utilities in accordance with the rules and regulations of the
Planning Board, the Public Works Departments the Highway Surveyor, the
Board of Heal.thv and all general as well as zoning by laws of said Town=
as are applicable to the installation of utilities within the limits of
ways and streets;
2. To complete and construct the streets or ways and other improvements shown
thereon in accordance with Sections Iv and V of the Rules and Regulations
of the Planning Board and the approved DEFINITIVE plan, profiles and cross
sections of the same. Said plan' profiles, cross sections and construction
specifications are specifically, by reference, incorporated herein and made
a part of this application. This application and the covenants and agree—
ments herein shall be binding upon all heirs' executors, administrators,
successors, grantees of the whole or part of said land, and, assigns of the
undersigned; and

The North Andover Planning Board has voted to APPROVE said plant subject to the
following conditions:
1. That the record owners of the subject land forthwith execute and record
a "covenant running with the land"s or otherwise provide security for the con—
struction of ways and the installation of municipal services within said sub—
division, all as provided by G.L. c. 41f S. HI—U.
2. That all such construction and installations shall in all respects
conform to the governing rules and regulations of this Board.
3. That, as required by the North Andover Board of Health in its report to
this Board# no building or other structure shall be built or placed upon Lots

consent of said Board of Health.

The following petition was heard at a meeting of the Planning Board on Monday
evenings, August 16 and September 13, 1976 at 7:30 P.M. in the Torn Office 1'_eeting
Room. The following members were present and voting: Fritz Ostherr, Chairman;
William Chepulis, Vice-Chairman; John A Mon,teiro, Clerk; Paul R. Lamprey and
William i'ir. Sa.lernme.
Mr. Richard Perkins and Kr. Frank C. Celinas represented Forth Andover ssociates
and petitioned for a subdivision of a parcel of land containing approxima,tely.b8
acres, situated off ;linter Street, subdivided into 54 lots and to be known ass
"Winter dill Estates".
Mr, Perkins, one of the o:•nzcro of the property, told the Board that the overall
density of the Subdivision would be 1.3 acres per house lot; that they tried not to
disturb the terrain, give drainage proteotion and are prepared to give easements
to the To°1:n at the time that the property is oubdivided in order to preserve the
trat er:rays.
Mr. Gelina.s presented plans to the Board and stated that the project would include
6100 feet of roadway, that they will bring in `Sbcn water from Winter St. and that
the site in chara,cteri.zed by 3 ridges running; south to north perpendicular to .'inter
St. He further emplained drainage plans and their intention to reconstruct the
meadow with a dam. There are 3 access trays to the property -- from Main St. , Boy_ford,
Foster St. , and Bale St, along Winter, and there are two accesses and egreeses within
the locus itself.
Cpposition was s expressed by I,1r. Monteiro regarding drainage and traffic situations
which he felt were severe problems. The following residents and/or abuttere also
voiced opposition: Michael Smolak, Dale St. ; Ks. Sandra. 1.1unroe, Winter St. ; Robin
Munroe, Winter St. ; and Philip Busby, Sr. , Chestnut ;t. All were concerned about
the drainage facts.

September 16, 1976
Upon motion made and seconded by the Subdivision Control. Subcommittee on September
13, 1976 the vote :1a.r as follo,,is to APPROVE the subdivision subject to the conditions
listed below — I•?evsers Chopulis, Lamprey and Ostherr in favor; Koosers Monteiro and
Salemme opposed. Conditions;
1 . That the record owners of the subject land forthwith execute and record. a
"covenant running with the land", or otherwise provide security for the construction
of ways and the installation of miunicipa.l services within said subdivision, all as
provided by C.L. c. 411 S. 81—U.
2. That all such construction and installations shall in all respects conform to
the governing rule, and regulations of thi,_ Board.
3. That all water mains shall be installed in accordance with the Board of Public
Works specifications.
4. That all, fire protection improvements shall be constructed in accordance with
the standards of the Board of Fire Engineers.
5. That roadi-ray and surface drainage shall be constructed in accordance with the
standards of the Highway Surveyor.
6. 'Mat Lots 8 & 9 shall be set aside as a't-9ini--Park"; in an�T event, the drainage
easement shall prevail.
7. Drainage shall be provided on ?linter St. at the intersection of the two access
roads, in accordance with the ffij3hway Surveyor's letter of 8/16/76.
8. That no lot may be built upon until a subsurface sewa e disposal Uystem permit
is granted by the Board of Health.
