Tymon, Town Platmer for the Town of North Andover, Massachusetts, having personal knowledge and skill of the facts herein stated,under oath depose and say as follows: 1, I am the Town Planner for the Town of North Andover, Massachusetts, and on May /2 , 2013, 1 was authorized by a Majority of the Planning Board of the Town of North Andover to execute this affidavit; 2. On August 20, 1979, a Majority of the Planning Board of the Town of North Andover executed a Subdivision Control Agreement Securing the Construction of Ways and Municipal Services (the "Agreement") on a plan entitled, "Definitive Plan of Winter Hill Estates, Located in North Andover,Massachusetts," dated July 5, 1976, prepared by Frank C. Gelinas &Associates, Engineers &Architects, and recorded with the Northern Essex Registry of Deeds as Plan No. 7570 and 7571; 3. Through error and oversight, Lot 54 on said plan, also known as 50 Sawmill Brook Road, was never released from said Agreement; 4. Lot 54 is no longer encunrbered by the terms of said Agreement since the street has been Conveyed to the town. 5. This Affidavit shall be relied-upon for the purpose of clarifying the status of title for the issuance of title insurance.
