The undersigned hereby applies for the approval of said DEFINITIVE plan
by the Board, and in furtherance thereof hereby agrees to abide by the Board's
Rules and regulations. The undersigned hereby further covenants and agrees
with the Torn of North Andover, upon approval of said DEFINITIVE plan by the
Board,.
1® To install.. utilities in accordance; with the rules and regulations of the
Planning Board, the Public Works Department, the Highway Surveyor, the
Board of Health® and all general as well as zoning bylaws of said Town,
as are applicable to the installation of utilities within the limits of
ways and streets;
2. To complete and construct the streets or ways and other improvements shown
thereon in accordance with Sections Iv and V of the Rules and Regulations
of they Planning Board and the approved DUINITIVE plan, profiles and cross
sections of the same® Said plane profiles~ cross sections and construction
specifications are specifically, by reefereance9 incorporated herein and made
a part of this application. This application and the covenants and agree-
ments merits herein shall be binding upon all heirs, executors, administrators,
successors, grantees of the whole or part of said Land, and assigns of the
undersigned; and
3. To complete the aforesaid installations and construction within two (2)
years from, the date hereof®

at 7:30 P.M. in the Town Office Building meeting room upon the application of
DOUGLAS & WILSON, requesting approval 0 a oubdivision pursuant to the pro—
visions of G.L. c. 41, Section 81—Ts under the requirements of the Subdivision
Control Law and the rule3 and regulations governing the subdivision of the
Planning Board Sa tho Town of North ADdover® a parcel of land bounded by land
of Greenwoodf Gia.rd o Rock. and Rea; by Lisa Lane; containing 13 Lots known as
"Douglas Drive and Mark Road West" subdivision®
The following menber3 avro present and votingo William Chepulisq Chairman;
Paul R. Lamprey9 Clock; Fritz Ostherr and Donald Na Keirstead. Member John J.
Monteiro was not, presenb. This public hearing was advertised in the Lawrence };
Eagle—Tribune on 1:ebreary 16 & 2% 1974. All abutters were duly notified by
certified mail.
Preliminary subdivision plans were submitted on June 279 1973 and were con
dit.ional3y approved on kagust &® 1973. The conditions of the tentative approval
are on file in the Town Clerktu office and in the Planning Board files®
Definitive plans were submitted on February 4: 1974 and Fa public hearing held on
March 1.49 1974. A r eeord of the minutes of that hearing are on file in the
Planning Board office. The petition was taken under advisement® The hoard met
again on April 19 1974 with the following members present and voting: William
Chepulis, Chairman; 5nitz Osther:rt vice Chairman; William N. Salemmep Clerk;
John i'tontelro and Paul R. Lamprey. There were drainage problems and many of
the abQtt^ers were opyo:re:d to the development, The petitioner granted an extension

At the Planning Board meeting of May Ge 1974# all of the same members were
present. Mr. Ostherr made a motion to DISAPPROVE the subdivision$ for the
following reasons; Mr. f`oRteiro seconded the motion and the vote was unanimous.

1. Control of the drainage S incomplete and the off—site drainage problem is
not oven closo Uo resolution.
2. The locations of the fire hydrants had not changed as requested by the
Board and the Pre Chief.
3. The regulation;i require percolation tests on each lot. Holes were dug on
lots 49 1 & 9y but no tests were takon. No holes were even dug on lots
11.4 1.2 A 139 so that no tests were taken.
