The Administrator provides details on the OOC granted in June 2021 for the construction of a new sewage
pump station at 1600 Osgood Street. Stormwater management BMPs and new sewage pipes were installed
over a 2.7 mile span. The project is complete, erosion controls have been removed, and the site is stable.
However, special condition #50 requires inspection and maintenance reports to be submitted one year after
the stormwater BMPs start live. The system has only been operating since December 12, 2023. Because this
is an ongoing condition, the report is expected to be submitted in six months. She recommends issuing a full
certificate of compliance with ongoing conditions.
Greg Hochmuth, Epsilon Associates and Michael Camadeco, Woodard & Curran are present.

Small Project

The Administrator presents the proposal for an in-kind deck replacement. The existing deck is located just
outside of the 50-foot NBZ to BVW. The proposal includes replacing the existing deck with a new
composite deck and stairs within the same footprint. If the Building Department requires the footings to be
replaced, the excavation will be completed with hand tools. Recommendations include approving the
proposal as a Small Project under category "B" with erosion controls and having pre- and post-construction
meetings with the Conservation Department, homeowners, and contractors before commencing work.
Construction materials and machinery should be kept at least 50-feet from the wetland resource area. If

ground disturbance is necessary, the Conservation Department must be notified, and straw wattle erosion
controls should be installed before any digging begins.

The Administrator presents the proposal for demolishing existing brick steps at the front entrance of the
house and replacing them with a 12x12 deck and steps. Ground disturbance includes installation of four deck
post footings, all materials will be stockpiled in the lawn adjacent to the deck. In order to bring the existing
concrete and brick stairs from the front entry to the driveway up to code, repairs will also be done to them.
This work involves rebuilding the existing brick overlay and fixing the concrete base as needed; no
significant ground disturbance is expected. The work is around 175-feet from Mosquito Brook at its closest
point. There is a steep slope at the front yard of the house with well-established evergreen shrubs, as well as
erosion control measures from a DPW project on the wetland side of Chestnut Street right across from the
project site. Recommendations include approving the proposal as a Small Project under category "A" and
"L" with pre and post-construction meetings.

The Administrator states the wetland is a BVW upstream of Mosquito Brook, with no Riverfront, NHESP,
or vernal pools on the property. The wetland line was inspected and minor flag changes were made. Revised
plans that reflect these adjustments have been received. According to a Letter of Map Amendment, the
property was removed from the 100-year floodplain and found to be outside the 500-year floodplain as well.
A copy of the LOMA was provided.
Evin Guvendiren, DeRosa Environmental is present.
Mr. Lynch confirms there are no open issues.
The Administrator states there are not, as the Commission issued a DOA for repaving of the parking lot and
some rip rap apron at the low point of the parking lot to slow runoff in this area. That work was completed
with no outstanding issues or concerns.

Melinda Perrone, 65 Meadowood Road, expresses worry about idling tractor trailer trucks and asks whether
the changes would solve this issue. She also asks if the Applicant plans to expand its business soon.
Mr. Manzi explains that the NACC is approving the wetland line, no work is proposed under this application.

The Administrator confirmed the third-party peer review was completed and no new information was
received since the last meeting. She believes the EO for coir logs should be maintained, but suggests
amending it to raise storm events to a 2-inch event within 24 hours for monitoring. The Enforcement Order
currently requires monitoring for 1-inch storm events within 24 hours.
Randy Christensen, previously of Stantec Consulting Services, Dominic Zazzaro from Stantec Consulting
Service and Francisco Urena from Lawrence Municipal Airport are all present.
The Commission agrees they have no additional questions and that the Enforcement Order must be
discussed separately from the NOI.
No abutters are present.

Mr. Christensen argues that there are multiple conditions in the draft OOC that are unsuitable for the project,
and he is concerned about the lack of feedback during the decision-making process and the process for
modifying the Order after it's issued, requesting the Commission to reopen the hearing.
A motion to reopen the hearing is made by Mr. McDonough, seconded by Mr. Lynch.
Mr. Christensen proposes removing or relaxing Condition #44, which involves wetland flagging reissuance
and boundary marking, as it requires significant labor. He states that all wetland flagging will be removed on
day one of construction because they are within the construction limits.
Mr. Lynch recommends the Administrator change the language to read the limit of work area shall be
designated and all wetland flags outside of the limits of work shall be reestablished.
The Commission agrees to modify the language accordingly.
Mr. Christensen discusses the limited turf area up to the wetland boundary and plans to maintain the current
mowing regime. He expresses concern about Condition #52 causing issues for LMA maintenance staff due to
a 25-foot NDZ in the middle of a mowing area. He proposes permanently marking the wetland edge vs 25-
foot NDZ.
Mr. Lynch requests that the line also be depicted on the VMP, which is utilized for maintenance.
The Commission agrees with the request since this is a Part VII Area; wetland markers will be spaced evenly
every 30-feet along the edge of the wetland.
Mr. Christensen states that Condition #58 is a residual condition from the Runway 5 project, which required
overwintering for safety and stormwater areas, and he believes turbidity monitoring is unnecessary for this
project.
The Commission agrees to strike the requirement for turbidity monitoring from the Order.

A motion to amend the Enforcement Order to change the rainfall event from 1-inch to 2-inches is made by
Mr. McDonough, seconded by Mr. Mabon.
Mr. Lynch feels the EO should be in effect until the commencement of #242-1876.
Mr. Mustain opposes changing the inspection from 1-inch to 2-inch because they are already aware of
problems in the stream and want it reviewed more frequently.
Ms. Valentino recommends monitoring 2-inches or once a week, whichever is more often.
The Commission continues to discuss the request to reduce monitoring.
Mr. Lynch believes that in order to maintain consistency, the Commission should not relax the 1-inch
monitoring requirement.
Mr. McDonough moved to retract his previous motion.
A motion to amend the Enforcement Order so that it remains in place up until the commencement of
construction activities authorized under #242-1876 is made by Mr. Lynch, seconded by Mr. Mustain.

ratio; the fence will be adjusted to respect the boundary of the 25-foot NDZ.

Andrew Thibault, Goddard Consulting states they're suggesting stepping stones with grass spaces in between
to allow for complete infiltration. Prior to installation, the Administrator will be provided with a design to
confirm that it fits NACC regulations.

The Administrator states additional information requested at the last meeting, including a second row of
erosion controls, a permanent barrier along the 25-foot NDZ, an O&M plan, eliminating construction traffic
from passing over infiltration zones for the rain garden and driveway stone drip edge, research on draft
FEMA maps, and cordoning the proposed rain garden from all equipment has been provided.
Mr. Lynch points out that, while the barrier's position is appropriate, the NACC typically wants something
more robust than a post and rail fence.
Mr. Mabon agrees with Commissioner Lynch, adding that the NACC has determined that post and rail
barriers do not hinder foot traffic or yard waste disposal.
The Commission discusses the possibility of adding plantings along the post and rail fence.
Jack Sullivan, Sullivan Engineering states they are unable to accommodate any more plantings because of
the stone drip edge. He proposes to build a stone wall at the 25-foot NDZ.
The Commission agreed that since there is a post and another at the edge of the rain garden and the 25-foot
NDZ, that is sufficient.

Mr. Manzi states staff did not inspect the site, and the wetland delineation line has not been certified. The
application was filed on time; however, the inspection was unable to be completed. The NACC is required to
open the hearing, but he advises the NACC to ask questions accordingly.
The Administrator notes that a previous OOC was issued in 2020 for septic system renovation, driveway
relocation, front steps, walkway, and porous paver patio; the Order was closed in October 2023.The new
project proposes demolishing a portion of the original house and driveway, deck, stairs, walkway, and

retaining wall for a new garage, addition, utilities, deck, patio, rain garden, and Buffer Zone plantings. A
waiver request has been filed, and much of the new construction occurs within the pre-existing footprint of
structures or driveways.
Mr. Lynch suggests the conversation should begin with the waiver request, but the NACC cannot discuss
until the line is confirmed.
Maureen Herald, Norse Environmental assures that all planned structures will be within the current
impervious area, minimizing impact on the Buffer Zone. Their proposal includes constructing a deck over an
existing patio and expanding planting in the 25-foot NDZ as on-site mitigation. The Applicant proposed
800-s.f. of mitigation for the new 89-s.f. of pervious pavers at the north of the addition. The house is fully
within the 50-foot NBZ as it predates relevant regulations.
Mr. Mustain voiced concerns with pavers and grading within the 25-foot NDZ. He would prefer to see the
project stay within its present footprint.
Ms. Herald states this area is currently a lawn area, no tree removal is proposed. A rain garden is proposed to
infiltrate the garage area.
Mr. Mabon expresses concerns with the Proposed Wetland Resource Area Impacts table.
Ms. Herald states grading is proposed and proceeds to further explain the table.
Ms. Valentino inquiries if alternatives to the rain garden outside of the 50-foot NBZ were investigated.
Andrew Fonzi, the Applicant, inquires if the NACC would prefer a rain garden or a cultec system under the
driveway. He states there is a water line that runs underneath the driveway.
The Commission agrees they would like to see the cultect system analyzed as part of the alternatives
analysis. They request a brief description of the geometric form in the wetland which was discussed and
acted on during a previous project.
Ms. Herald offers to research cultec system specifications. She gives background information on the
geometric form in the wetland and believes that the water elevation is close to the wetland elevation.
The Administrator notes that even though the NACC gave the concrete pad permission to stay, it was not
meant to be used as a foundation. She gives the consultant the preliminary FEMA map so they may be
included in the design.
Mr. Lynch states for the record that the Commission comments are based on the presumption that the
wetland line is in fact not going to move.

The Administrator reports that homeowners are in communication with their engineer to obtain a Certificate
of Compliance. She believes the as-built plan will reveal the location of the unauthorized patio in relation to
the wetland.
Mr. Lynch recommends putting a deadline in place for the as-built plan.
Robin & Paul Trickett, the homeowners are present. They were given a timeline from the engineer of 2-3
weeks to complete the as-built plan.

Maureen Herald, Norse Environmental states the restoration plan has been updated to include a
microhabitat, a post-and-rail fence with North Andover wetland markers, and removal of everything outside
the 50-foot Ephemeral Pool NDZ. They request the fire pit and gravel walkway within the 75-foot
Ephemeral Pool NBZ remain, and 476-s.f. of historic lawn area be kept. They also request the mulch on the
easterly side slope to stay, the gravel path will be completely removed and the area replanted.
Claudinei Do Carmo, the homeowner is present.
The Administrator agrees that the proposed lawn area is reasonable and believes that the fire pit and
walkway should be allowed because this area has historically been a lawn area with no habitat to worry
about.
Mr. Lynch supports preserving the fire pit area since it will provide the homeowner with a space to recreate.
His assessment of the mulch area has not changed since the previous meeting; he does not believe keeping
or adding mulch that would eventually erode and migrate to the stormwater feature provides any benefit.
Mr. Mabon agrees with Commissioner Lynch that the fire pit and walk way should be permitted to remain.
He also agrees in maintaining the lawn area shown as part of the design and removing the mulch from the
slope on the front wetland to avoid the stormwater feature.
The Administrator states if the mulch area is to be removed, she recommends using an erosion control
blanket and a seed mix that germinates quickly.
Mr. McDonough questions if the historic lawn 20 years ago included more than what is shown currently.
Ms. Herald explains the historic lawn area. They have asked to maintain 17.5% of the lawn area, while
everything on the other side of the post and rail fence will be allowed to revert to natural vegetation. The
concrete and wooden stairs will be entirely removed.
The Commission considers amending the EO and agrees that the Restoration Plan must be implemented by
October 23, 2024, with invoices for native plants and seed mixes provided. A wetland consultant oversees
planting, monitoring, and compliance, resulting in 75% shrub survival and 90% seed mix coverage. Dead or
dying plants need to be replanted. The NACC must see progress before they will consider waiving the fines.

The Administrator states a NOI was submitted several weeks ago for work on a garage extension,
breezeway, and septic system improvement; however, it was rejected because of incompleteness. On May
29th, staff was informed that construction had begun at the back of the property. Unauthorized activity, such
as excavation, soil disturbance, deck and footing replacement and plant clearing, occurred totally within the
25-foot NDZ. The existing patio, spa, landscaping, and lawn in the back of the house had been removed,
leaving behind loose silt. Full deck removal, rehabilitation, and footing replacement - The footing work
ruptured the water main, necessitating line replacement and hence the whole excavation. Both the
Conservation and Building Departments issued a cease and desist on the property. Historic permitting
revealed that the deck, spa, and patio were legally existing constructions. She feels that replacing lawfully
existing structures as part of an after-the-fact NOI is acceptable.
Mr. Manzi questions if the site has been stabilized.
The Administrator notes that the soil is still loose, but erosion measures have been installed. According to
the Administrator, the garage requires ZBA approval, which means they must file concurrently with ZBA
when submitting the NOI.
Mr. Lynch expresses concern with the unpermitted construction activity.

Matt MacInnes, MJM Designs, states that he was contracted to repair the deck but discovered there were no
appropriate footings. A well line was damaged during excavation for new footings, causing the job to be
rushed. Staff requested erosion controls and a silt fence, which were constructed. Mr. MacInnes maintains he
was not aware of any further work being done on the property. He has since applied for a building
application, which is being reviewed.
The Commission discusses the Enforcement Order and agrees work on site shall continue to cease and desist
until all necessary permits and pre-construction requirements are met. The existing erosion controls,
including the silt fence and straw wattle, must be maintained. To stabilize the exposed soil, rapid growth
seed mix or hydroseeding must be applied. By August 14, 2024, a comprehensive NOI, along with
attachments and plans, must be submitted to the Conservation Department. This NOI should include details
of past and proposed work, including the replacement of manipulated structures.
