HomeMy WebLinkAbout1982-08-04 Draft Decision DEF SUB BEAR HILL DRAFT DECISION MOTION : To approve the Definitive Plan of Land entitled "BEAR HILL" by Frank C . Gelinas and Associates , Inc . and dated April 26 , 19,92 with the following conditions - 1 . That the record owners of the subject land forthwith execute and record a "covenant" running with the land , or otherwise provide security for the construction of ways and the installa- tion of municipal services within said subdivision , all as provided by G . L . Ch . 41 , Section 81-U . 2 . That all such construction and installations shall in all respects conform to the governing Rules and Regulations of this Board . 3. That no work shall be done in the subdivision until security in the form of a bond or covenant has been duly recorded and the plans are signed and recorded. 4 . That any changes made to the definitive plan by other town agencies or officials shall be submitted to the Planning Board by the applicant prior to implementation in the field . * for approval 5 . All street trees shall conform to the Tree Warden ' s specifications . 6 . That a Notice of Intent , if applicable , shall be filed with the North Andover Conservation Commission pursuant to M . G . L . Ch . 131 , Section 40 . If applicable , a Certificate of Compliance shall be obtained from the Conservation Commission for any order of conditions prior to the final release of any bond or covenant . 7 . The applicant/owners shall provide written proof of the owner- ship and/or status of Appleton Street from Dale Street easterly to and including Lot A prior to the Planning Board ' s endorsement of the plan . If Appleton Street is deemed a private way , the applicant/owner shall obtain written approval on a form satis- factory to the Planning Board that said way can be accepted as a public way after completion of construction . 8 . If the proposed subdivision is not serviced by the proposed sewer system , then said subdivision shall be re-submitted to the Planning Board pursuant to M . G . L , Ch . 41 , Section 81 -W . 9 . All lots which cannot be serviced by a gravity sanitary sewer system directly to the street shall not be built upon until written approval is obtained from the Board of Health and the Board of Public Works and shall be submitted to the Planning Board for approval that said lots and/or construction of such � r "Bear Hill " -2- Decision do not adversely affect the subdivision drainage system. Notation to be placed on the plan to be recorded . Note : The applicant should be aware of the fact that the drainage from his property should not create an adverse impact on anyone else ' s property . 10 . In accordance with the Fire Department ' s letter dated June 1 , 1982 a ) One 12 inch water main s,iall be extended westerly on Dale Street to Winter Street providing a looped water supply system . b) All fire hydrants shall be fully equipped with one 4?" outlet and two 2," outlets , c ) The proposed hydrant at the intsection of Road A and Road C be centrally located across from Road C . d ) All homes constructed on lots 32 , 33 , and 34 require a residential sprinkler system to be connected to the pro- posed water supply system prior to meter entering residence . Additionally , said lots shall have installed one emergency reservoir . e ) The developer is required to purchase/obtain box numbers from the Fire Chief, install and wire all fire alarm boxes , including those at the corner of Road A and Road B and Road A and Road C to be in accordance with the approval procedure of the Fire Department. f) Required underground ( conduct to weather-head) or aerial wiring is at the applicant ' s option and shall be carried to a point adjacent to existing fire alarm system on nearest pole located on Dale Street . g) Connection to fire alarm system shall be done by Fire Depart- ment crew . 11 . In accordance with the Board of Public Works ' Report dated October 7 , 1981 and letter dated June 4 , 19821 a ) A 12 inch water main shall be installed on Appleton Street from Salem Street to Dale Street as shown on supplementary plan . Two hydrants shall be installed on this proposed line , one 500 feet and one 1 ,000 feet from Salem Street . b ) A 12 inch water main shall be installed on Dale Street from Appleton Street as shown on supplementary plan and shall be extended an additional 950 feet further on Dale Street in a westerly direction to the center of Lot 1 as shown on " Plan of land located in North Andover, Massachusetts , pre- pared for Designer Homes by Frank C . Gelinas and Associates , Inc . dated July 31 , 1981 " , and endorsed as a Plan Not Requiring Approval by the North Andover Planning Board on August 3 , 1981 . Fire hydrants shall be installed every 500 feet on Dale Street from the intersection of Appleton Street to the center of Lot 1 as described above . c ) A 12 inch water main shall be installed on Appleton Street from the intersection of Dale Street as shown on the 1� - i .. "Bear Hill " -3- Decision supplementary plan and shall extend an additional 1 , 350 feet further in a southerly direction on Appleton Street . Fire hydrants shall be installed every 500 feet on Appleton Street for the length of the water line . d ) The new 12 inch ductile iron water main on Dale Street shall extend to the centerline of the last " Form A" lot . e ) All proposed 12 inch water mains on Dale Street and Appleton Street shall be tied into existing 6 inch water mains where they cross at their termini . f) A 12 inch water main shall be installed from Dale Street to Roadway B a distance of 2 ,440 feet to provide an additional tie in for the proposed reservoir adjacent to this property on Town Farm Hi 11 . c�) The fire hydrant ( s ) proposed at Station 37 + 30 shall be eliminated . h ) All lots which are above elevation 320 shall not be ser- viced by town water . Pressure boosters in any street main shall not be allowed . Notation to be placed on the record plan . i ) Any lots below the elevation 320 which will require pressure boosters shall have individual booster pumps which shall be the responsibility of the homeowner . Notation to be placed on the record plans . j ) Three 12 inch date valves shall be installed at the inter- section of Roadway A and Dale Street and at the intersection of Roadway A and B . Three 8 inch gate valves shall be installed at the intersection of Roadway A and C . k ) A 12 inch water main shall be provided on Roadway B a distance of 500 feet to land of the Town of North Andover along the 20 foot utility easement shown on Lot 40 . 1 ) A 12 inch water main shall be installed along the property line of lots 36 and 37 to land owned by the Town of North Andover a distance of 400+ feet . A 20 foot utility easement deeded to the Town of North Andover shall be provided and be fully dimensioned on the plan in the above location . m) An B inch water main shall be installed on Roadway C for a distance of 500 feet . Said main shall be installed 15 feet from the northerly property line . A fire hydrant shall be installed at Station 5 + 00 on Roadway C . n ) A 40 foot "utility" and "right-of-way" easement shall be provided from the cul -de-sac of Roadway C across lots 30 and 31 for land owned by the Town of North Andover . o ) The proposed 12 inch sewer line on Dale Street shall be installed in the center line of Dale Street and a profile shall be provided . A detail of the brook crossing on Dale Street shall be submitted . The proposed sewer line shall be installed as deep as possible to the intersection of Appleton Street . Five inch "Y" branches and stubs to the property line shall be installed during construction of sewer line on Dale Street to service existing dwellings , with the exact locations to be determined by the Board of Public Works . p ) The proposed 12 inch V . C . sewer on Appleton Street shall i i 1 l li "Bear Hill " -4- Decision be installed in the center line of the street and a profile shall be provided . The sewer shall be installed as deep as possible . The sewer on Appleton Street may be installed off the centerline of the street only if 5 inch stubs are run to the property. line for each existing dwelling . Two inch "Y " branches and stubs to the property line shall he in-- stalled during construction of sewer line on Dale Street to service the existing dwellings , with the exact locations to be determined by the Board of Public Works . q ) A profile of proposed 8 inch V , C sewer in the utility easement on Lots 5 and 7 shall be provided . A profile shall be provided for the proposed 8 inch sewer on Roadway A and shall be installed in the centerline of Roadway A with two sewer manholes at roadway curvatures to eliminate the crossing of other utilities . r) The proposed 8 inch V . C . sewer on Roadways B and C shall be installed along the centerline of the streets with two manholes at the curve of each street to eliminate the crossing of other utilities . profiles of the 8 inch V . C . sewer on Roadways B and C shall be provided . 12 . In accordance with the Tree Warden ' s letter dated June 1 , 1982 a ) A bond in the amount of $29 ,000 . 00 shall be posted to insure compliance with the Subdivision Control Law governing street trees requirements , subject to inflation adjustments . 13. In accordance with the Highway Surveyor ' s recommendations and letters dated September 25 and 28 , 1981 and June 7 , 1982 : flRoadway profiles shall be submitted for all streets . A detailed drainage analysis shall be s;pbmitted , including calculations of entire drainage area , problem areas on Dale Street , Appleton Street , Marbleridge Road , and the final destination of drainage discharge shall be analyzed. Drainage calculations shall prove a zero increase in peak discharge as drainage exists at all points in said subdivision . c) Any necessary changes in existing street drainage , culverts , or pipe sizes shall be identified and corrective measures shall be the responsibility of the developer . d) The drainage culvert on Dale Street proivided by the Morley property drainage easement shall be fully upgraded . e ) Construction of detention ponds shall be detailed on plans . f) A 50 foot future roadway easement and slope easement shall be protherlyeside of RoadmAttoylandtion€�/ F of Simon ; Road from eC shall southerly be redesigned and an additional road shall be constructed to land N/ F of Borth Andover Associates at the easterly portion of the subdivision . Road widening easements shall be provided along the lots fronting Appleton Street for the limits of the Johnson property to accomodate a 50 foot right- of-way for Appleton Street . Final locations to be approved by the Highway Surveyor . g) A drainage easement from where drainage empties from the 5 1 "Bear Hill " -5- Decision 24 inch pipe on Appleton Street and runs to the old rail - road bed area . h ) Road improvements and widening easements shall be provided and deeded to the Town of North Andover and be recorded by the developer prior to the sale of Appleton Street lots . i ) A detailed siltation and erosion plan including a maintenance plan shall be submitted prior to construction . Said plans shall include all lot grading for proposed dwellings as well as for street slopes and retention areas . j ) Installation of sloped granite curbing on all slopes exceeding 6% . k ) Contingent upon final granting of Dale Street drainage easement on Rand property , the applicant shall purchase four structures consisting of two manholes and two catch basins including required 18 inch reinforced piping to replace existing drainage to headwall . The Highway Department shall file Notice of Intent to Conservation Commission and be responsible for installation of aforementioned materials . 14. The 12 inch water main shall be extended easterly along Dale Street for an additional 950 feet . 15 . The following drainage system shows pipes on slopes creating an excessive flow of 20 feet per second and shall be corrected to reduce velocities to below 10 feet per second : a ) 24 inch drain -- Lot 24 b ) 12. inch drain -- Lot 63 c) 12 inch drain - Lot 21 d) 15 inch drain - Lot 28 e ) Di tch - Lot 24 16 . Sub drains will be installed in all cut areas of 8 feet in height or at locations Highway Surveyor determined necessary if conditions are found to be different than on said plans . 17 . Any drainage tying into existing street drainage and/or culverts shall require written approval from the Highway Surveyor and submitted to the Planning Board prior to commencement of sub- di vi s i on work . 18. Require that drain from catch b.asi.n on toad A at Station 28 + 0 and drainage from Road A at Station 44+30+ be diverted into retention area on Lot 61 . Calculate flood line on Lot 61 to insure flooding of roadway does not occur . 19 . Require that drainage from catch basin on Road C at Station 1 + 50 be diverted into retention area on Lot 64 . 20 . Mitigate increased flows f)^om Road C area to zero at property line . "Bear Hill " -6- Decision 21 . The proposed utilities to be constructed on Dale Street and Appleton Street shall be shown with topographic detail on a 40 scale plan for approval by the Planning Board to allow the Planning Board , Board of Public Works , and the Highway Surveyor to ascertain if all proposed construction will not interfere with existing facilities including but not limited to public safety and access/egress to private homes . 22 . Required street profiles shall be on the same sheets as detail plans in item # 23 . 23 . Lots 32 to 37 inclusive shall be revised to provide the 40 foot utility and right-of-way easement from approximately Station 36 + 0 to land of the Town of North Andover. 24 . Specify on said plans that the 20 foot access/egress easement across Lot 26 to land of the Town of North Andover is for the benefit of the town . 25 . Delineate the access/egress easement to Frank Kozdras as such and fully dimension such on the plan . Notation to be on plan for recording that specified lots have said easement for the benefi t of Frank Kozdras . 26 . All easements , including the cut -de-sac on Lot A , shall be fully dimensioned on the plan ' and submitted in recordable form deeded to the Town of North Andover. 27 . Lot A shall have sufficient area to meet the Zoning By Laws in the event the cul -de-sac should become permanent . 280 • Pavement width on Appleton Street from Dale Street easterly to and including Lot A shall be 26 feet . 29 . Submit complete design specifications and grading plan of Duplex Pump Station on Lot 25 for approval by the Planning Board . Specifications and design shall be in accordance with the Board of Public Works requirements and applicant must submit approal of Board of Public Works to P(Inning Board . 30 . Applicant shall submit a written request for Planning Board waiver of Rules and Regulations for the length and grade of Road C . Applicant shall show written authorization to do construction: work on property of North Andover Associates at the end of Road C . Show relationship on locus plan to other roads that may connect to Road C . 31 . A notation shall appear on the plans to be recorded , along with watershed line , that , "so much of the land that falls within the watershed zone , Section 4 . 133 of the Town Of North Andover Zoning By Laws is subject to Board of Appeals approval " . a a i "Bear Hill " -7- Decision 32 . All areas between the extension street lines and the curb lines of the roadways shall. be graded , loomed , and seeded or paved in toe occurance of a driveway so that the finish grade at the exterior street line shall be 8 inches higher than the edge of pavement , 33 . The use of 6 inch bituminous curbing shall be required on all street grades exceeding 4% and said curbing shall encompass any catch basin so that flow is directed into such catch basin . 34 . Deliniate the lotting sheets of index map . 36 . If proposed subdivision is to be completed in phases , separate completion dates shall be imposed for each phase as they are initiated . 36 . Binder coat shall be applied no later than _ 37 . All improvements in said subdivision shall be completed no later than
