During that meeting several concerns were raised and they
included
All of the DPW concerns which were raised at the T11C
meeting of June 79 1989 must be properly addressed.
Locus map mint be revised to include Wo odbl.Iry Lay-1e.
* The slope of the shoulder must be re-designed sr s to
conform with the rules and regulations of the Planning
Board.
A site visit was scheduled for June 17, 1989. Upon receiving
input from the Manning Board, I will contact year with any
further concerns prior to your next Public Hearing.

11, 1991 planning board agenda for the purpose of establishing the
bond amount required by the Town at Binder Coat, in order to release
the lots from covenant for construction purposes. For reference
purposes, this is subdivision plan #11878 recorded on January 23,
1991 at N.E.R.D.

The Division of Public Works has reviewed the progress of
work on English Circle. The contractor is currently finish
grading the roadway in preparation for the application of the
binder coat of pavement. All construction has been completed
except for paving and loaming and seeding of the shoulder areas.
Since the subdivision is so clone to interim completion, we
recommend release of the lots, subject to posting of the
$J% 000. 00 brand and approved completion of paving and shoulder
grading. if you have any further question, please advise.

Dear Mr. Thompson
On September 26, 1991 the North Andover Planning Board voted
to accept the Form H, Performance Secured by a Bank Passbook,
presented by Mr. Thomas Laudoni for the above referenced
Definitive Subdivision.
As a part of that motion the Board voted to "abolish the
original Form K, Performance Secured by Lender's Agreement, dated
April 18, 1991, upon the applicant presenting a passbook in the
amount of $ 19, 000. 00 made out to both R.M. P. Properties and the
Town of North Andover, along with two withdrawal slips signed by
the applicant. "
Should the applicant fail to present a Bank Passbook to the
Planning Department with the appropriate withdrawal slips, the
April 18, 1991 Tri-Party agreement shall remain in full force and
effect,

This agreement shall remain in full force and effect until
the applicant has fully and satisfactorily performed all

The interest of the town in such funds retained by the leaide-1,

applicant should fail to complete any stage of construction of
ways and installation of municipal services as specified in this
agreement and within the time herein specified, any funds
remaining undisbursed shall be made availabld in whole or pai-t- ,
by the lender to the Planning Board for the benefit of the Town
of North Andover to the extent of the reasonable cost:
to the town of completing such construction or installation
specified in this agreement. Any unused portion of such funds;
will be released by the planning Board and may be disbursed by
the lender to the applicant upon completion of the work by said
town.
The lender hereby agrees that none of the funds retained aF;
security, as specified herein, shall be disbursed to tiv,
applicant without prior written release of said funds by tho
Planning Board.
Any amendments to this agreement and/or to the aforesaitr,
security shall be agreed upon in writing by all parties to 'this
agreement.

Re: English Circle - Roadway Bond Release
Dear Mr. Laudani,
The Planning Board met this week and discussed the release
of the roadway bond for English Circle. The Planning Board
agreed by consensus to release all but $500 of the remaining
funds. The Board will retain this amount for one year to ensure
the survival of the street trees that were recently planted.
