Pursuant to Section 5,D of the North Andover Rules and Regulations Governing the Subdivision of
Land, it is hereby requested that the following items be waived for the Definitive Plan of East
Pasture Estates (formerly Sunrise Estates).
1. Request that the Statement of Environmental Impact required by Section 3,C,4 not be required
due to the limited impact of the buffer zone project for the construction of the new homes and
a new roadway approximately 402.7 feet long. Information is being provided in the Mitigative
Drainage Analysis, Erosion Control Plan and Notice of Intent submittals to insure minimal
impacts from the proposed development. It is also important to note that the entire site has
been used and/or disturbed in the past.
2. Request that the requirements of Section 7,A,2 -Width C and D, be modified to provide an
outside cul-de-sac diameter of 120 feet, with an island width of 40 feet and a pavement width
of 30 feet, as requested by the Planning Board action on the Preliminary Plan.
3. Request that the requirements of Section 7,13 - Streets and Roadways 4, be modified to
provide a normal pavement width of 24 feet, as required by the Planning Board action on the
Preliminary Plan, and as requested by the North Andover Department of Public Works.
4. Request that the requirements of Section 7,C - Shoulders 1, be modified to provide an eight-
foot shoulder, eight inches higher than the edge of pavement grade, and that a grade
adjustment be allowed with 2:1 side slopes within the right-of-way. This request will assist with
the roadway grading and allow some existing mature trees to be saved, as shown on the plan.
5. Request that the requirements of Section 7,D - Sidewalks 1, be waived to allow sidewalks only
on one side of the roadway, as shown on the plans, and as requested by the Planning Board
Action on the Preliminary Plan.
6. Request that the requirements of Section 7,G - Utilities 1, be waived so as not to require
utilities to be installed underground, due to the short length of the street and due to the fact
that all adjacent homes are serviced by overhead utilities.
7. Request that the requirements of Section 7,M,1 be waived so as not to require installation of
dry sewers, and that the Division of Public Works, under Section 7,M,6 render an opinion that
municipal sanitary sewer mains will not be available within a reasonable time,
