Goldman Chairman: The Planning Board mecting for September 10,2024,was called to order at 7 p.m. 6 7 BOND RELEASE 8 Woodlea Village,Michael Tanereti,as Trustee of Woodlea-Andover Trust(Developer)and Kathleen Donovan as 9 Trustee of Woodlea Village Homeowner's Trust (Homeowners): Request for release of$14,300 in bond funds plus all 10 accumulated interest.Bond funds to be released in accordance with the Agreement and Assignment of Bonds and Security. 11 J. Enright: This was a petition at Town Meeting for street acceptance;the required Conservation Restriction has been signed 12 by the Select Board, Conservation Commission and the State. The recorded copy is in the meeting packet along with the 13 recorded street deeds,street layout plan and trustee certificate.The request is for release of the remaining bond funds plus 14 accumulated interest.There is an agreement related to the bond release that Attorney Kate Bargnese will speak to. 15 K. Bargnese,Smolak&Vaughan:The developer for this project who built this project in 1996 never completed the 16 subdivision for street acceptance so the homeowners came to us last spring and asked us to usher this through the process. The 17 developer wasn't interested in participating or fronting the costs and agreed to assign over half the bond money to allow the 18 homeowners to overtake the work. The only caveat is the developer wants the bond released to a different entity that lie now 19 operates and the homeowner's trust is named Woodlea Village Civic Association which is how it was set tip when it was 20 created and how the checks will be made. 21 MOTION: S. Kevlahan made a motion to approve the release of$14,300,plus interest for the bond for Woodlea Village in 22 the manner as discussed tonight.J. Simons seconded the motion.The vote was 5-0,unanimous in favor. 23 24 I270 Turnpike Street,David Sampson: Request for the release of a$5,000 performance bond associated with the 25 December 15,2020 Site Plan Review Modification Special Permit,which allowed for tine addition of nine parking spaces as 26 well as additional site improvements to the rear of the existing building; including a fence,regrading, loam and seeding and 27 adding a new retaining wall to improve accessibility to open space.The property is located in the Village Commercial zoning 28 District, 29 J. Enright: The SPR special permit was granted December 15,2020,which allowed for the applicant to re-stripe parking 30 spaces,add nine new spaces and additional site improvements to the rear of the existing building. Improvements include 31 adding a fence,regrading, loam and seeding and adding a new retaining wail improving accessibility to open space. The as- 32 built plan,site photos,and approved Decision are included in your meeting packet. The Conservation Commission has issued 33 a Certificate of Completion. Showed site photos of completed improvements. 34 MOTION: S. Kcvlahan made a€notion to release the$5K performance board plus interest for 1270 Turnpike St.J. Simons 35 seconded the motion.The vote was 5-0,unanimous in favor. 36 37 125 Flagship Drive,American Towers,LLC: Request for release of surety bond posted for discontinuance/abandonment of 38 a wireless facility. The facility was not constructed. 39 J. Enright:This was permitted in April of 2011 allowing for the construction of a wireless communication facility consisting 40 of a 140' multi-carrier monopole. At tine time,a$10K bond cash performance bond was posted. That bond was released in 41 June 2013;the facility was never constructed. In addition to the cash bond, Florida Towers Partner posted a surety bond in the 42 amount of$1 OK which is required per the bylaw in the event of abandonment/removal. In 2014,American Towers assumed 43 the property lease,the Florida Towers surety bond was cancelled and American Towers established a$10K surety bond for 44 the Tower/Structure Removal Bond. American Towers has renewed this surety bond for ten years and has now requested 45 approval to cancel the bond. The special permit has expired. 46 MOTION: S.Kevlahan made a motion to allow the release of the surety bond for 125 Flagship Drive, C. Application for a Watershed Special Permit 67 under Article 4 Part 5 t95-4.19.0 and Article 10 195-10.7 of the Town of North Andover Zoning Bylaw. Applicant proposes 68 site improvements including demolition of the existing bituminous concrete boat launch,retaining wall,and gravel parking 69 area. The work includes construction of a new hand carry boat launch,Mechanically Stabilized Earth block wall,permeable 70 paver parking area and driveways,two bioretention areas, and tree plantings.The property is located in the Residential I (R-1) 71 zoning district. 72 73 DISCUSSION ITEMS 74 149 Main Street114 Second Street Cres o Develo ment: Request for Insubstantial Modification to approved site plan and 75 special permit to slightly adjust the common lot line boundary between the Applicant's property and property owned by 76 Spencer(159 Main Street)and MacGregor(161 Main Street). 77 John Smolak,Smolak&Vaughan: As you recall from our last meeting before the Board in April there was a question raised 78 by one of the abutters, Karen Spencer, 158 Main Street, in terns of the survey adjacent to her property because the survey was 79 so close to her house.To her credit after that time,she retained a surveyor who determined a different boundary line. We had 80 her surveyor confirm with our surveyor and then hired a third surveyor to check the work that was done. It turns out the 81 survey resulted in the need for slight adjustments to the common property boundary. There was an approximate 18"variance 82 at the corner of Main Street and 158 Main, tine Spencer property.Noted the differences on the plan(red being the original 83 boundary and blue revised);The variance tapers to 0 at the end of the property boundary.Because we built flexibility into the 84 site plan,we were able to maintain the required 5 ft.parking setback along the common boundary,maintained same number 85 parking spaces,size and aisle width keeping the building square footage the same.The only difference in terms of square 86 footage for the lot is 124 SF. Fortunately,we were able to make minor adjustments so the site layout remains substantially the 87 same as presented and approved in tine past. 88 E.Goldberg: Questioned what discussions have been had with Ms. Spencer and the McGregor family since the surveys were 89 done. 90 J. Smolak: Has not had a direct discussion with Ms. Spencer but has spoken with her attorney who has confirmed that she's in 91 agreement with the boundary change. Reached out to the McGregor's; has not yet had an on-site meeting to discuss it. Hasn't 92 heard any objections. A couple of on-site meetings were scheduled yet postponed by one of the abutters. 93 E. Goldberg:Questioned whether the fence and screening still maintained as it was in tile original plan. 94 J. Smolak: Moved the fence away from the Spencer home for them to maintain that area,believes that adjustment is fine. May 95 need to adjust by a couple of inches yet prefers to have that discussion in the field to make sure homeowners are satisfied. 96 S.Kevlal)an: Questioned whether the swept path analysis for the site was affected. 97 J. Smolak: All aisle widths were maintained. 98 J. Simons seconded the 100 motion.The vote was 5-0,unanimous in favor. 101 102 ANR PLAN 103 149 Main Street/14 Second Sheet, Crespo Development: As per condition#53 of the approved March 21,2023 special 104 permit decision the applicant requests endorsement of an ANR Plan to combine both true 149 Main Street and 14 Second 105 Street lots into a single lot. 106 MOTION: S. Tine vote 113 was 5-0,unanimous in favor. 114 115 1101_Turnpike Sheet,Metro vest Realty,LLC: Application for a Land Disturbance Permit in connection with proposed 116 construction of a parking lot expansion at the Merrimack Valley Operation and Maintenance Facility(National Grid),The 117 project consists of repaving and restriping of an existing parking area,a parking Iot expansion,stormwater and ancillary 118 landscape improvements retaining wall,and utility improvements to support its use. Tire property is located in the Industrial I 119 zoning district. 120 J.Enright: At the previous meeting the applicant requested a continuance to the 9/10/24 meeting and signed an Extension of 121 Time to render a decision until9/26/24 24(2 days after the next hearing).Applicant provided a table of Use and existing 122 conditions parking analysis(325 existing vs.224 required). Building Inspector confirmed the actual spaces provided exceeds 123 true amount required. Applicant has provided perspective renderings from Rt. 114,confirmed MEPA review is not required, 124 and that a National Grid representative would attend this meeting. Department review comments have been received from 125 Health and DPW Operations;no concerns were communicated. Stormwater letter was responded to; all comments have been 126 sufficiently addressed.There is potential to encounter bedrock during construction of the gravel wetland.A placeliolder for 127 additional test pits has been conditioned in the draft decision. Peer review suggested the Board may want to discuss with the 128 Applicant the proposed method of removing the ledge, if large areas require removal to install gravel wetland. Applicant has 129 filed a Notice of Intent with the Conservation Commission. 130 Karen Staffier,VH..B: Introduced team attendees: Jeremy Stevenson,PI -JLL-Project Mgr,National Grid,and three National 131 Grid representatives: Chris Thibodeau,Danielle Prince,& Shimat Kamal.Reviewed perspectives showing existing conditions 132 and perspectives from Rt. 114 that included landscaping,stornnwater features and new retaining wall with vehicle parking. 133 P.Boynton: Besides proposed added conifers;are those broad-leafed mature trees being added? What is the planting size? 134 K. Staffier:Both are being added;deciduous trees in the parking lot and conifers along the perimeter showing deciduous trees 135 in their mature stage. The plans show 8-Red Maples,3-Black Tupelos and 5-Valley Forge American Elms;trees to be 3-3.5 136 caliper at planting and taller than 6-8 ft., consistent with new trees. 137 J. Simons:True plan looks much closer to the street than depicted in the renderings. 138 E. Goldberg:The parking lot comes around pretty close to the sign;we're not seeing those cars but true cars parked further 139 away,suggested it's more of the angle chosen. 140 K. Staffier: The parking lot pitches back toward the building which sits low on the site. Grade at the street is 227 and the face 141 of building is 223,Once grading is complete,the lot will slope toward the building. 142 J. Simons: Stated that contextually,we work very hard to maintain and manage the strectscape along Rt. 114 so that 143 everything looks attractive as you drive through town. 144 I .Goldberg: Agree this won't look exactly like this;questioned whether fencing would be better. 145 J. Simons: Based on the topography,believes this is one of those cases where we have to come up with a plan and perhaps 146 enhance the plan going forward with a few more specimens;holding it open to see what it looks like when complete. Enright: Showed where pant of the detention wetland basin extends toward the roadway,along the basin. 152 J. Simons: Questioned what is the retaining wall made out of. 153 K. Staffier: The retaining wall is made out of block. Suggested the introduction of a 2-2.5' berm on the street side of the 154 parking lot utilizing the excess material on site to provide a look consistent look to what's there now. 155 J. Simons: Liked this idea. 156 K. Stafftea: Photometric plan includes 4 no spill, light poles on the edges and new central island. Provided parking inventory 157 based on the uses in the zoning code.Used a combination of"warehouse and office" for the main buildings and"service 158 station"for the fleet repair garage as a best fit to the relative code description. Site operations are not changing;continuation 159 of the same use;site is gated access.Rough earthwork estimates and approximation of number of export trucks(net may be 160 reduced with the introduction of the berm)assuming a I6 yard per truck approx. 109 trucks during construction.Confirmed 161 no MEPA review required. 162 E.Goldberg:Asked National Grid representatives how the new parking situation will this benefit their business. 163 D. Prince: There is parking in the rear however the parking lot is maximized for daily operations,This being a storm center, 164 more people and trucks are received during preparations and outages;been this way for decades.It addresses efficiency and 165 safety which is our number one priority. 166 P.Boynton; Questioned what region this facility serves. 167 C. Thibodeau: The Merrimack Valley;strictly MA. 168 S.Kevlahan: When storms occur,National Grid calls in other utility providers and contractors. Questioned whether they will 169 use this parking lot. 170 C. Thibodeau: We typically set up staging sites at other locations. If word doesn't reach people they tend to show up at this 171 site;many arrive with personal vehicles, 172 P. Boynton: Questioned whether this is a new use of this property as a storm center or has that been the function for many 173 years. 174 C. Thibodeau: For at least 28 years it has been a"storm room"site. 175 J. Enright: An updated grading plan showing a(2-2.5 increase)can be incorporated into the draft Decision with a condition 176 for potential additional screening plantings with non-onerous language. 177 E.
