Open hearing Certificate to Alter 54 Elm St., open T. True, 2nd B. Zelitch# unanimous
This concerned Nelson Espaillat and Stephanie Viera project to replace 19 windows at 54 Elm
St.
Stephanie was present and explained she asked the contractor if permits were taken out.
On the basis of the contractor's paperwork, they got approval for loan.
After a few months, she said when the windows ready, she was told the permitting was in place.
However, she said, she found out that didn't do permitting because she called town hall to make
sure that the permitting done.
There was a dispute over payment. She said would not pay until the permits are cleared.
She met with Paul Hutchins, building department.
She said the contractor said he would sue and see in court.
Then, the lean was disapproved, she said.
T. True said there were a lot of legal issues we can't address as a commission.
He said they changed 18 in front. The one in back which is not a consideration of the
commission.
J. Lafond said he was concerned about the two stained glass windows that were replaced which
were historic.
He said probably there were a handful of replaced and original windows. outside the stained
glass windows, he said, he probably would have accepted the plan. All of the larger windows
are 6 over 1, he said, and the smaller are 4 over 1, so everything is mostly matching now.
T. True said he was bothered that the contractor did not do what supposed to be done.
But for the sake of the homeowner: looks as original as it could be done.
B. Zelitch said he would not force the letter of the law.
J. Lafond said we can can ask for all windows to be replaced. But if went to start, would we
actually have done much differently' Most we could have done is replace like with like,
replacement with like, then have a mismatch. As is, they are congruent. He met with town
counsel and the contractor is responsible for permitting.
He advised a continuance with an invitation to the contractor to come to the meeting. If
contractor does not want to reimburse for stained glass, can ask state to revoke license.
B. Zelitch said it might he hard to find stained glass windows.
J. Lafond said he will provide information on the Amesbury company that does stained glass.
