EASEMENT DEED
I, Patrick S. Cone, as I am Trustee of LACY STREET REALTY TRUST under Declaration
of Trust dated February 13, 1981 and recorded in North Essex Registry of Deeds,
Book 1488, Page 23, of 202 Lacy Street, North Andover, Essex County, Massachusetts,
grant to THE TOWN OF NORTH ANDOVER, a municipality duly established under the
laws' of the Commonwealth of Massachusetts and having its town offices at 120
Main Street, North Andover, Essex County, Massachusetts, with quitclaim covenants,
a certain right and easement in and over the following described parcels of land
so that the said Town of North Andover, the Grantee hereunder, its agents, servants,
successors and assigns, may construct, maintain and keep in repair a drainage
system including both an open ditch drain and a tile drain,; or such other drain-
age system as the said Grantee, its agents, servants, successors and assigns, may
deem advisable, over and across the easement areas hereafter described, of such
size as may be deemed proper to effect an adequate drainage system for the within
described property.
The Grantee, its agents, servants, successors and assigns, may establish such
drainage as- aforesaid upon the lands of the Grantor, his heirs, successors in
title and assigns, so as to.suf'fic?ently drain the area known as "Colonial Acres"
as shown on plan hereinafter mentioned, in such manner as the Grantee, its agents,
successors and assigns, may deem advisable.
In addition., the Grantee, its agents, servants, successors and assigns, has
the right to enter upon the easement areas- hereinafter described for the purpose
0 of maintaining and repairing the said drainage system established thereon,
provided that said Grantee, its agents, servants, successors and assigns, shall
W return the area affected thereby to its former condition of repair or better.
The areas upon which this easement is granted are more particularly shown on a
plan of land entitled, "Modification. Plan 'Colonial Acres' North P.nd.over, Mass.
Prepared for Lacy Street Realty Trust", Scale: I" = 40' , Date: April. 21, 1981,
Rev. June 30, 1981, by Andover Consultants, Inc. , said Plan being recorded in
Gsaid North- Essex Registry of Deeds as Plan No. ' ' and said easement areas,
r. being two (2) in number, are more particularly described as follows, according

Ca PARCEL 1. Being a strip of land twenty (20) feet in width and bisecting Lot 27,

on said Plan, and being shown as "20' WIDE DRAIN EASEMENT" thereon; and
PARCEL 2. Being a strip of land twenty (20) feet in width and located along
.� the Southeasterly lot lane of Lot 23 as shown on said Plan, and being shown as
rjo "207 WIDE DRAIN EASEMENT" thereon.
-a Reference may be had to the Plan hereinbefore mentioned for a more particular
description of the areas included with the easements herein granted.
