Merrill, Conservation Assocla RE: Winter Street Development,(Map 103; Lot 120)DEP File 0242-12_& 242-12_ Hi Jack&Tim: I have finished my preliminary review for the two(2)Notice of Intent(NOI)application accompanied by site plans entitled,"Plan to Accompany a Notice of Intent", Sheets 1 &2,prepared by Pembroke Land Survey Co.,dated February 10, 2005 (Stamped&signed by Joseph Serwatka,P.E.),and waiver request form, dated February 25,2005 for the construction of a roadway/driveway with utilities, and the construction of a single-family house with appurtenances. As requested, I offer the following comments 1 recommendations that will be forwarded to the North Andover Conservation Commission(NACC)for the public hearing: ➢ At this time DEP has not issued a comments for either NOI filings. Subject lot is outside of estimated habitat for endangered species. ➢ The applicant is proposing to extend and improve Winter Street to accommodate the necessary appurtenances(sewer tie-in,water, underground TEC)for the SFH, Approximately 465 linear feet of driveway/roadway(Winter Street) is will extend from the existing dead end of Winter Street.The 12' wide private driveway is proposed within the limits of a previously disturbed (cleared)woods road. ➢ The BVW line was approved by the NACC through an ORAD,which was issued May 28,2004. ➢ I questioned whether there was Bordering Land Subject to Flooding(BLSF)associated to the adjacent pond/BVW. In-house FEMA maps depict this are to be in the Zone X500;the sewer installation project indicates BLSF is associated to beaver pond,but does not identify it, and the 3-lot subdivision off Great Pond Rd(DEP File#242-777) identifies BLSF at el. 127.9. The proposed pa Y utilize existing site conditions,requiring minimal grade change. In addition,a 5' wide x 2' deep crushed stone runoff control system will be installed along the side of the driveway to provide runoff treatment prior to entering the groundwater and 1 or the adjacent BVW.This work is proposed within the 25' No Disturbance Zone(NDZ)&the 50'No Build Zone(NBZ),as regulated under the NA Wetlands Protection Regulations. ➢ The applicant's representative(J.Serwatka)submitted a waiver request(2-02-2005)relative to the 25'NDZ&50'NBZ, stating the applicants are limited by the existing layout of Winter Street due to the existing field stonewall(property lines),and the requirements governed by the DPW and Planning Board.As part of the waiver requirements outlined in the NA Wetlands Protection Bylaw Regulations,the applicant shall demonstrate an alternative analysis showing that there are no other feasible alternatives that will have a lesser impact to the wetland resource areas.The engineer's alternative analysis: accessing this portion of Winter Street via Bridal Path.This alternative would result in crossing an intermittent stream&BVW(immediate tributary to the Lake). In my opinion,this option would have a greater impact to this resource area. ➢ Under Waiver Provisions&Alternatives Analysis Requirements: §5.1 (NBZ) it states, "the Commission may grant a waiver from these regulations for the construction and maintenance of a new roadway or driveway of min. legal and practical width consistent with PB Dimensional standards, where no alternative means of access from an existing public or private way to upland area of the same owner is available."Mr. Serwatka asserts this example is consistent with site conditions on said property. I would agree that using the existing woods road would have a lesser cumulative impact to the BVW and its Buffer Zone,and would also avoid the nee& for tree removal from this immediate.However,the waiver&site plan lack any mitigation information, as required under our Regulations. Furthermore,the submitted plans fail to depict the amount of area within the 25'NDZ(in s.f.)and potential BLSF to be altered.On February 28,2005, I met with Mr. Serwatka to discuss that the proposed impacts to the NDZ,and required mitigation(2:1 ratio)must be shown on the plan. We even discussed ways to mitigate and where.To date, revised plans have not been submitted. ➢ The applicant must submit a revised plan showing the impacts to the 25'NDZ in s.f.;and show mitigation. ➢ The limit of work(LOW) and water main are proposed along the wetland boundary, upslope of wf A-5 through A-7. In order to prevent inadvertent impacts to the BVW, the erosion control (EC)should be moved further in sizet and stilt filter ruron of the existing noff adequately?onewall,Could the 5' wide crushed stone filter strip g decreased Y r ➢ The engineer should explore the option of installing the water main on the opposite side from where it's currently proposed, still maintaining the 10 minimum requirement between the sewer &water lines. Since the underground TEC do not have setbacks to these utilities, relocating them should not be an issue.I spoke wf Jack Sullivan,P.E.,NA Engineering Director,about the possibility of relocating the water main on the right side of Winter Street.He said the water line could cross over the sewer line,as long as it meets DPW standards. ➢ I also spoke with Jack about a paved driveway vs. crushed stone. He expressed concerns with the homeowner bringing in more stone over time and potentially burying the SMHs, resulting in potential impacts to the SMH and maintenance access. ➢ The EC detail indicates the silt fence on the upland side backed by hay bales on the wetland side.The NACC requires the EC detail to be"flipped-flopped'.Plan detail must be revised to reflect this change. ➢ The second NOI was filed for the construction of a SFH with associated site clearing and s ithin the BZ to BVW associated to a pond.The I2.90-acre lot is grading,and appurtenances w ick Watershed. As such,the applicant is required to obtain a also within the Lake Cockwit Watershed Special Permit from rt the Planning from the edge of the a area.Only 20Ks?f. of land will be developed.Conservation Zane ➢ An inspection was conducted on.Monday,February 28,2005,so that I may review the project area. Several wetland flags were missing in the field and should be refreshed. I also noted there were a lot of recent beaver activity along the southwestern portions of this lot.Furthermore, a beaver but was observed approximately 75' from wetland flag A-20. ➢ The majority of the SFH is proposed outside of the 100-ft BZ.The limit of work is restricted to a minimum of 75, from the edge of BVW.Therefore,clearing and grading activities will not encroached into the regulated 25'NDZ&50'NBZ. ➢ The EC I LOW is proposed along the Planning Board's 75' Conservation Zone. ➢ Rooftop runoff will be mitigated by means of gutters and groundwater recharge trench. The driveway runoff will be mitigated by means of a grassed basin to allow for groundwater recharge. At this time, I have no issues with the proposed development of the SFH. I trust this information is sufficient for your needs. The NACC will open the public hearings for the above-referenced NOIs on Wednesday, March 9,2005 at 8:00pm. John (jack) Sldlhall, tAo"Tq Tc4cphow (978) 085-0950 I o r hav(978) 088-9573 WINTER STREET WATERSHED SPECIAL PERMIT ELIAS PROPERTY To: Lincoln Daley Cc: Planning Board Alison McKay, Conservation Administrator File From: Jack Sullivan, Director of Engineering Date: April 28, 2005 Lincoln; I have completed my second review of the proposed Winter Street Improvements and Watershed Special Permit Plans prepared for Claude &Laura Elias by Pembroke Land Survey Co. dated February 10, 2005 with a revision date of March 30, 2005 and offer the following comments: (Items in bold print need to be resolved) Drainage comments: • The applicant has provided a sediment &oil separator at the proposed low point of Winter Street per the recommendation of DPW. • The engineer has provided DPW drainage calculations for the proposed private driveway along Winter Street and for the general site development. Each drainage area has been designed to provide storage for the 100 year storm event. Although, the engineer does not take credit for infiltration in the design, the proposed drainage systems will offer recharge benefits to the watershed. • Spot grades were provided along Winter Street per the recommendation of DPW for construction purposes and to insure proper drainage flow. • A Storrawater Operation&Maintenance Plan was submitted to the DPW and Conservation Commission. The owner of the property must he identified as the responsible party to comply wiffi this plan, In fact, in the potential Conditions of Approval it is recommended that the Page 2 05/16/05 driveway along Winter Street, the asphalt berm, the water main, the hydrant, and drainage infrastructure will remain private and will he maintained iat perpetuity by the owner of the subject lot. Water and Sewer • The applicant relocated the proposed water main to the northerly side of Winter Street per DPW recommendation. • The sewer manholes along Winter Street must be at finish grade and accessible to DPW staff at all times. • The applicant will be required to obtain permits from the DPW prior to any water and sewer utility work. General Comments: • The Fire Chief should provide written approval for the private driveway along Winter Street to insure that the driveway provides sufficient access/egress. As long as this driveway is clearly designated as "private" and the Fire Chief does not have any issues with the driveway, then DPW will support the driveway as designed. • In the Conditions of Approval it should clearly state that Town personnel, including trash, recycling, and snow removal equipment will not enter the private driveway along Winter Street. • The design engineer should show on the plan proposed signage at the beginning of the driveway along Winter Street labeled "Private Driveway". Assuming the applicant and engineer can address these comments, the DPW does not see any other issues regarding this proposed site development plan.
