Waiver Requests
Dear Board Members:
On behalf of my clients, Claude&Laura Elias, I hereby request waivers from
sections 6.7, 6.8, 6.9, 6.11, 6.14 and 6.21 of the Subdivision Regulations. Based on
discussions with the Board, DPW and Conservation, we propose to improve Winter
Street with 12' of pavement and crushed stone shoulders. Utilities include the existing
sewer line, a proposed water main and hydrant, as well as proposed underground
elec/tel/cable service. It is my client's intent to maintain-this section of Winter Street
including plowing/sweeping. Other than providing for water and sewer service, we would
request that the Town provide trash pickup at the end ofthe-existing Winter Street
pavement. Since this driveway willnever serve more-than the one proposed dwelling, I
believe that granting of the waivers is appropriate. I look forward to meeting with the
Board to discuss these waiver-requests.

Lincoln,
Joe Serwatka, P.E. dropped off a plan for Winter Street showing a proposed single family dwelling to be constructed on
an"un-improved" public way. He is proposing to construct a paved, private driveway to service this lot and it"appears" it
would not be possible for future development of the surrounding properties due to existing development and wetland
issues. This project came before DPW in the past and we asked for a cul-de-sac to be constructed at the existing end of
pavement to allow for the turnaround of DPW vehicles(trash, recycling, etc...) and emergency vehicles.
The new plan submitted would need to be conditioned so that a"Private Driveway"sign would be posted at the beginning
of the driveway to avoid snow plows and trash trucks from entering. Also, it should be noted that there is an existing
sewer main wl manholes constructed along this section of Winter Street. DPW needs to maintain access to these
manholes for periodic maintenance.
If there is no TRC for this project, please copy DPW on all correspondence associated with the Planning Board and the
Con. Comm. comments.

In talking With Tim Willett, Winter Street is a private way (paper street)with a utility easement for water& sewer in
the proposed development area. Tim says that the last house on the left was approved through the planning board
process through an approved extension of Winter Street. The extension has never been accepted as a public way.
Prior to the previous extension of Winter Street, the remaining section of Winter Street to South Bradford Street is
public.

One more thing about Winter Street...
Since the proposed driveway construction, drainage trench, house construction, site driveway, grading, etc....will be
disturbing greater than 1 acre of area a NPDBS Phase II Notice of Intent and Stormwater Prevention Pollution Plan is
required.
Joe Serwatka e-malled me this morning asking if I was reviewing the project. I let him know that we had a meeting this
morning to discuss the project. I told him that with just a quick look at the plan the following issues were raised by me:
1) Disturbance is> 1 acre....NPDES Phase II NOI &SWPPP required
2) I would like to see some stormwater pretreatment(catchbasin, 4`sump, gas hood) at low point In "driveway" prior to
outlet to infiltrators
3) Need to see proposed grading of"driveway".
I did not get into the major site issues(roadway standards, wetland issues, etc...}
Lincoln....when you have finalized your comments please copy me on the e-mail...I will co-sign the memorandum to the
Planning Board if you think that is a good idea.

Dear Commission Members:
We have submitted revised plans for Winter Street dated March 30, 2005. The
revisions are based on our last meeting with you, and comments from Jack Sullivan. The
revisions are as follows:
1. The water line has been relocated to the north side of Winter Street to keep the
construction activity further from the wetlands.
2. The crushed stone apron has been removed from the middle portion of the
driveway/roadway. We have bermed this portion of the roadway, and directed
runoff to a sediment/oil separator, with an infiltration trench.
3. A 1,400 s.f. mitigation area has been shown adjacent to the grassed basin to
account for proposed activity within the 25' no-disturb zone. We will be
happy to entertain planting requirements for this area from the Commission,
bearing in mind that it is an upland area.
4. Proposed spot grades have been shown along the roadway to demonstrate that
any grade changes will be very minor.
5. The Commission was waiting to see the reaction of the Planning Board to the
proposed roadway/driveway. We met with them on April 5;1'and it appears
that they are willing to accept the current proposal so long as the Fire Chief
submits a second letter stating that he has no opposition to the proposed width
and grades. Note that he has already reviewed the plan, and his only comment
was to require sprinklers within the dwelling. It should also be noted that no
review agent has expressed any opposition to the current plan.
We look forward to meeting with the Commission on April 13°i to discuss this

Thank you so much for talking with me today and for all the information attached below. It is definitely helpful. Here is a
quick recap.....
Request#1: This request is to remove the small strip of stone and a section of the pavement at the"turn around" in
front of the house and replace It "permeable pavers". This would allow for more (and improved) drainage, a better area
for large trucks/vehicles to tum around without driving on our lawn, and it would stop the stones from being ricocheted
into the lights or windows of our house (as it has happened before). We would like to use pavers that would be set far
enough apart AND with enough drainage underneath (and of course, NO use of stone dust). The area is beyond 100ft
restriction line (as measured by Jennifer today during the site visit).
Request #2: We would like to add loam and seed to the front of the house in front of the wall. The wall really needs
repairing since the stones are falling off the top and sides, and it is unsafe. Adding the sloped area of grass in front of
the house would be a safer option, especially for my children who play in that area often. We would NOT be cutting
sown any trees in order to make this happen. We could also add appropriate shrubs and trees that are natural to this
area as deemed necessary.
Again, thank you for your time. I am assuming that the next step is for us to wait to hear from you again regarding the
permit, correct? If not, please let me know what my next steps should be in order for this to move along. Thank you

Tanya: I attached the Watershed Special Permit and the Subdivision approval for the property. I also
attached the approved Plan.As you can see the crushed stone in the back is a Stornxwater Mitigation aspect
for the lot.Additionally, the proposed area in the front is within the 15o Conservation Zone. I attached the
Zoning Bylaw section for the Watershed for your review,and doing anywork may require a permit. I am
going to have to speak to the Planning Director aboutyour request and getback to you.The more
information revealed in the file makes things a little move complicated.

Hi Rebecca,
In my opinion it is a driveway, not a roadway built to Town Standards.
We have water and sewer easements in that area, but all the surface infrastructure is private from my perspective. So I
would be oit with cobblestone installation.
Of course you may have a different view as the Planner and the reps you oversee,
