Dear Sir: The following petition was heard at a me . f the Planning Board on Monday evening, March 1 , 1976 at 7:30 P.M. in a Office Meeting Room. The followdng members were present and voting: _ _11 ,, iam Chepulis, Chairman; Fritz Ostherr, Vice--Chairman; William N. Salemme, Clerk; and Paul R. Lamprey. Scott Follansbee and Frank C. Colinas represented Scott Properties, Inc. and petitioned for a subdivision of a parcel of land containing approximately 2-pt acres situated near Boston St., to be subdivided into 2 lots and to be known as "The Andovers". Plan: were presented to the Board by Mr. Gelinas who stated that Lot A is not con e -,ered a building lot in North Andover, but will probably be considered such in lu►dover. Lot B has the proper frontage. They propose to put in a small oul de sac which will be in conformance with the rules of the Town.-of North Andover. The slope of the land is 6% near Boston St., there is no water or sewerage and the drainage improvements are provided for on the plan. Mr. Gelinas stated that there is a 10--12 ft. clearance between existing property lines. According to Mr. Follans— bee, the property was purchased in November or December of 1975. The plan that he was shown is an exact copy of the one recorded at the Registry except that the plan at 1?:,; Registry noted that Lot A was not a buildable lot. Charles Foster, Building Inr,pei.tor, vouched for the accuracy of that fact. C. Dunn, an abutter, was concerned about the proximity of the cul de sao to his property and felt it would decrease his property value. At a meeting held on March 22, 1976, a motion was made by the Subdivision Control Sub— committee to disapprove the proposed subdivision for the following reasons: 1 ) that the subdivision route taken is an obvious attempt to subvert the Zoning By—Law and 2) the turn-around does not meet the radius requirement.
