The Planning board had the following concerns and Recommendations: Show the property line along Blue Ridge Rd.- and the proposed Grapevine rd. Also show the frontage along Blue Ridge Rd. and the wetlands line throughout that entire intersection. Mr. Claudia Dupuis must receive a written agreement from Coventry Development Corp. which grants the residents of Grapevine rd. access to Blue Ridge Rd. A paving easement must be granted along lots I & 2 to establish a Cul Do Sac on Grapevine rd, until such time as Appleton St. is connected through. For safety reasons the new road will stay as named, Grapevine Road, until such time as Appleton Street is connected through. At that time Grapevine Road will revert to Appleton St. at the expense of the owners of lots 1, 2 & 3 . Lot 3 shall not be released and lot 2 shall not be further subdivided until Appleton St. is connected through to form a through road. On 2-4-87 , the Conservation Commission voted to send a copy of this letter to the Planning Board and advise them that the parties involved : ie . , The Commission, the Coventry II people and ourselves were in basic agreement that sewer/water/drainage utilities be placed under Appleton Street. We assume the implication now is that "the ball is in their court' and the Planning Board now has to act on the matter : ie. , taking an official stance on the status of Appleton Street. (We always assumed that it was 4ublic way , though a "paper" road , on which services had been discontinued in the 1920 ' s at the same time upkeep of South Bradford Street had been discontinued as well . ) What the Planning Board will arrive at, as a decision� is up to them. However , should it concur with the parties ; the Conservatiion Commission , Coventry and ourselves and declare Appleton Street to be the logical route to take and give its O.K. _ onthis ; then our position is in agreement with yours : ie. , that Appleton Street SHOULD BE "OPENED UP" , for the town to have access to � servicing any utilities going through. Laying utilities under Appleton Street would seem to confirm the official/public charaler/status of this street. Opening-up Appleton Street makes sense or the town as well ; as you' ve said before it, the short distance (less than a thousand Feet) going through our land , would provide another access to/from Coventry II thus easing traffic congestion/flow on Salem Street. i Claudia,. Anna and .I would greatly appreciate your strong re-emphasis of the necessity to open-up this street, as part of the overall Coventryll development. { Our fear is , should it not become a fully paved and serviced street, and underground SEWERAGE/WATER/DRAINAGE UTILITIES are nonetheless allowed to be put in lace; it will become a haven for A.T. V . ' s , dirt bike and "idle" passer hrough, in the Summer timeland A.T.V. ' s and Snowmobiles in the Winter time. And it will. still6an UNSAFE UNSERVICED AND UNSERVICEABLE roadwa difficult I if not impossible of access for emergency service vehicles . It will become prey to the same mischief , drinking/loitering, that has plagued South Bradford Street near our house , in recent years . The status of Appleton Street, at this end , will remain a nuisance for the town; as well as officially unsettled. The condition of this street will soon be increasingly blighted, as well . Now, at least, we don' t have this proble ecause the roadbed is grown-in, (well treed) and undefined. All this will change when it is cleared of existing trees to provide access to trench digging equipment which will lay underground utilities . We just don' t see why it just isn' t "finished off" as a permanent road , if it ' s going to be made road-like anyway . It' s only approximately 1 , 300 feet (less than a thousand of it going through our property) . Karen Nelson, Town Planner, North Andover January 15 , 1987 Mr. Guillermo "Willie" Vicens , Chairman Mr. Jack Linden, Acting Chairman Members of THE CONSERVATION COMMISSION Town of North Andover , MA 01845 Dear Messers Vicens , Linden, et al : This letter is to bring to light, for your attention, circumstances and conditions regarding COVENTRY II and the easement rights the a principals of COVENTRY II acquired from Mr. John Tuttle who ob- tained said easement , for drainage and sewer use , from Mrs . Anna Tymvakieuiz and Mrs . Claudia (Tymvakieuiz) Dupuis as part of the now extant Pines Sub-Division. The easement rights which the COVENTRY II people have obtained from Mr. Tuttle are described as 20 feet from the edge of the railroad bed, on our property , and parallell along the edge of the rail- road bed. On the edge , our side, of this railroad bed and at times within this 20 feet is a year round FLOWING STREAM which empties into Mosquito Brook near the presently existing .railroad trestle abutments . The northern most 1/3 to 1/2 length of this easement! 20 foot wide swath runs through year-round wetlands , Our "field" abutting the Pines and the Railroad bed is really a collection point/ marshy area for the aforementioned un-named brook, over which there is a stone slab culvert,near our house , dating back well over 50 years , This culvert once formed a farm crossing over this brook within or on the edge of this 20 foot easement, for SEWERAGE and drainage , now held by COVENTRY II and which they stated they intend to use if the status of Appleton Street as a potential access is unresolved. We, the undersigned, are uncertain if you, the Members of THE CON- ,, .__ SERVATION COMMISSSION, are aware of the WETLANDS NATURE of the area in question, since the COVENTRY II people might not have been required to identify "our property' s wetlands" when they identified their own wetlands . Now they stand ready to use the easement through this property' s wetlands probably unknown to the members of the CONSERVATION COMMISSION. The town has maintained a stated interest, through the Highway Surveyor in having access to any utilities laid by developers , at past Planning Board meetings . It would be difficult to have access through such a perennially wet section of land , as is the western edge of the field in question. It lies mostly underwater most of the year. It would probably make more more sense , as the Highway Surveyor, Mr. William Cyr has proposed , at Planning Board hearings from the outset; to use Appleton Street for the purpose of laying utilities.
