Based or 'the'information available to the NACC at this time, the NACC has determined that the area on which the proposed work is to be done is significant to thelViowing Interests In accordance with the Presumptions of Significance set forth in the regulations for each Arc-,a Subject to Protection Under the Act(check as appropriate): ❑ Public water supply ! The .. NACC orders that all work shalt be performed in accordance with said conditions and with the Notice of Intent referenced above. To the extent that the fol- lowing conditions modify or differ from the plans, specifications or other proposals submitted with the Notice of Intent, the conditions shall control. General Conditions 1 . 1'ailuro to comply with alf conditions stated herein, and with all relaled statutes and other regulatory meas- ures, shall be dcerned cause to revoke or modify thin Orcicar. 2, This Order does not grant any property rights or nny exclusive privlloges;.it does not authorize any injury to private property or invasion of private rights.. 3; This Order does not relievp the permittec or any other person of the neca;ssity of complying with all ' other applicable feddr'al, slaty or local statutes, ordinances, by-laws or regulations. 4. The work authorized hereunder shall be compteted within three years from the date of this Order unless either of the following apply: (a) toe work is a maintenance dredging project as provided for in the Act, or (b) the Limo for completion has been extended to a specified date more than three years, but less than, live years, frorn the date of issuance and both that dote and the special circumstances warranting (tic extended time period are set forth in this Order. a. This, Order may be extended by the issuing aulhorily for one or more periods of up Irathree years each . upon application to the issuing authority at least 30 clays prior to the expiration date of the Order. G. Any fill used in connection with this project shall be clean fill, containing no trash, refuse, rubbish or de- bris, including but not limited to lumber, bricks, plaster, wire, lath, paper, cardboard, pipe, tires, ashes, refrigerators, motor vehicles or parts of any of the foregoing. 7: No work shall be undertaken until all administrative appeal periods,Rom.tllis Order have elapsed or, if such an appeal has been filed, until all proceedings before the Department have been completed. 8. No work shall be undertaken until the Final Order has been recorded in the Registry of Deeds or the Land Court for the district in which the land is located, within the chain of title of the affected property. In the case of recorded land, the Final Order shalt also be noted in the Registry's Grantor Index under(tie name of the owner of the [and upon which the proposed work Is to be done, In the case of registered land, the, Final Order shall also be noted on the land Court Certificate of Title of the owner of the land upon which the proposed work is (o be done. The recording information shall be submitted to the NACC r on the form at the end of this Order prior to comrbencement of the work. 9. A sign shall be displayed at the site not less than two square feet or more than three square feet in size bearing the words, "Massachusetts Department of Environmental Quality Engineering, Filo Number 242-350 10. Where the Department of Environmental Quality Engineering Is requested to make a determination and to issue a Superseding Order, the Conservation Commission aha11 be a party to call,agency proceedings and hearings before the Department. . 11. Upon completion.of the work described heroin, the applicant shall forthwith request in writing that a Certificate of Compliance be issued stating that the work has been satisfactorily completed. 12. The work shall conform to the following pinns and special conditions: r - 3 - ORDER OF CONDITIONS CRANBERRY LANE DEQE File #242-350 12r' All work shall conform to the following described Notice of Intent, Plans and additional. conditions : a) Notice of Intent of Flintlock Realty Trust pre- pared. by DiPrete-Marchionda & Assoc. , Inc. 185 New Boston Street, Woburn, Mass . 01801 Dated April 24, 1986 b) Plans titled "Site flan of Land" prepared for Flintlock Realty Trust entitled Subdivision Plan of Land in North Andover Prepared by DiPrete Marchionda & Assoc. , Woburn, Mass . , consisting of two (2) sheets 4 of 8, 5 of 8 , dated March 14, 1986 13. No wetlands resource areas as delineated on the submitted plans shall be filled on any lot in this subdivision. 14. Prior to any construction on the site, a continuous row of Staked Hay Bales shall be installed between all con- struction work and the Wetland areas . This Row shall be installed as shown on above referenced plans . 15. Upon completion of construction and grading, all disturbed areas shall be stabilized permanently against erosion. This shall be done either by sodding or mulching according to Soil Conservation Service (SCS) Standards , or by foaming and seeding. If the latter course is chosen, stabilization will be considered, once the surface shows complete vege- tative cover has been achieved. 16. All erosion prevention and sedimentation protection measures found necessary during construction by the North Andover Conservation Commission (NACC) trill be implemented at the direction of the NACC. 17. Any changes in the .submitted plans , Notice of Intent, or resulting from the aforementioned conditions must be sub- mitted to the NACC for approval prior to implementation. If the NACC finds , by a majority vote, said changes to be significant and/or deviate from the original plans , Notice of Intent or this Order of Conditions to such an extent that the interests of the Wetlands Protection Act cannot be protected by this Order of Conditions and would best be served by the issuance of additional conditions , then the NACC will call for another public hearing within 21 days , at the expense of the applicant, in order to take testimony from all i.ntQrested parties . Within 21 days of the close of said public hearing, the NACC will issue an amended or new Order of Conditions . -4- ORDER OF CONDITIONS CRANBERRY LANE DEQE File #242-350 18. Any errors found in the plans or information submitted by the applicant shall be considered as changes and pro- cedures outlined for changes shall be followed. 19. The provisions of this Order shall. apply to and be' binding upon the applicant, its employees, and all successors and Asssigns..°in interest or control . 20. Prior to the issuance of a Certificate of Compliance, the applicant shall submit a letter to the NACC from a Registered Professional Engineer certifying that the work is in strict compliance with the plans referenced above and -the conditions stated. 21. Members of the NACC shall have the right to enter upon and inspect the premises to evaluate the methods used in the procedures to comply with this Order of Conditions . 22 . Accepted engineering and construction standards and procedures shall be followed in the completion of the project. 23. Issuance of these Conditions does not in any way imply or certify that the site or downstream areas will not be subject to flooding, storm damage, or any other form of damage due to wetness . 24. A surety performance bond or letter of credit running to the Town of North Andover shall be provided in the amount of 10 000.00 . , which shall be in all aspects satisfac- tory to Town Counsel and the North Andover Conservation Commission and shall be posted with the Treasurer of the Town of North Andover before commencement of the work. Said bond or letter of credit shall be conditioned on the completion of work. Said bond or letter of credit shall be conditiond on the completion of all conditions hereof, shall be signed by a party or parties satisfactory to the Conservation Commission and Town Counsel , and shall be released after completion of the project, provided that provision, satisfactory to the Commission, has been made for performance of any conditions which are a continuing nature. The work shall conform to the following plans and additional Conditions: a. Notice of Intent submitted by Flintlock Realty Trust, P.O. Box 531, North Andover, Mass. ,prepared by New England Environmental, P.O. Box 451, Amherst, Mass. , dated May 19, 1988, revised on June 28, 1988 and received by the NACC on May 31, 1988, b. Plans entitled "Notice of Intent plan, Cranberry Lane", prepared for Flintlock Realty Trust by DiPrete Marchionda & Associates, 80 Maple Street, Stoneham, 14A 02180 c. The previous filing #242-350 for the Cranberry Lane Sub- division including the Order of Conditions issued under this filing and the associated material reference in this Order of Conditions. d. A letter from DiPrete Marchionda & Associates to the NACC dated July 8, 1988 and received on July 19, 1988 regarding correction of standing water problems in the detention pond on Lot #6. GENERAL CONDITIONS: 13. The following wetland .resource area is affected by the proposed work: isolated land subject to flooding. This resource area is signifi- cant to the interests ,of the Act and Town Bylaw as noted above. The applicant has' not attempted to overcome the presumption of significance of the resource area to the identif ied. interests. 14. - She NACC generally agrees with the extent of the wetland resource areas delineated by the applicant on Lots 4 & 5. 15. This Order of Conditions is issued in addition to those issued under File #242-350. This Order is for the proposed work on Lots 4 & 5, plus corrective action for the detention pond on Lot 6. PERFORMANCEI,DESIGN STANDARDS/CHANGES: 16. The proposed filling of 2900 square feet of wetlands is allowed provided that a similar replacement area be provided as shown on the plans ref- erenced above and 'described in the wetland replacement plan. The. replace- merit area shall be completed by the applicant, then inspected and approved by the NACC, prior to any work on Lots 4' & 5. 17.' The detention pond area located on Lot 6 shall be regraded as proposed to eliminate the continued ponding which is now occurring in this area. The regrading and stabilization of this area shall be completed by the applicant and approved by the NACC before any work begins on Lots 4 & 5. Y Page -4- ORDER OF CONDITIONS LOTS 4 & 5 Cranberry Dane DEQE ##242-469 18. No earthen embankment in the buffer zone shall have a slope steeper than 2: 1. Any slopes of steeper grade shall be rip-rapped to provide permanent stabilization. 19. Any changes in the submitted plans, Notice of Intent, or resulting from the aforementioned conditions must be submitted to the NACC for approval prior to implementation. If the NACC finds, by majority vote, said changes to be significant and/or to deviate from the original plans, Notice of Intent, or this Order of Conditions and would best be served by the issuance of additional Conditions, then the NACC will call for another public hearing within 21 days, at the expense of the applicant, in order to take testimony from all interested. parties. Within 21 days of the close of said public hearing, the NACC will issue an amended or new Order of Conditions. 20. Any errors found in the plans or information submitted by the applicant shall be considered as changes, and procedures outlined above in Condition ##19 for changes shall be followed. 21. The NACC shall be notified in writing of any lot line or lot number changes with a copy of a plan showing these changes prior to any work on these lots. 22. The applicant shall submit to the NACC a signed statement by the buyer that he is aware of an outstanding Order of Conditions on the development, has received a copy of this Order of Conditions, and has received notice about Condition ##41 below. 23. No underground storage of fuel oils shall be allowed on any lot within one- hundred (100) feet of any wetland resource area. This Condition shall survive this Order of Conditions, and shall run with the title of the property. 24. fertilizers utilized for landscaping and Lawn care shall be of the low--nitrogen variety, and shall be used in moderation. Pesticides and herbicides shall not be used on any lot in the subdivision within 100 feet of a wetland resource area. DURING CONSTRUCTION 25. In advance of any work on this project the applicant shall notify the NACC, and at the request of the NACC, shall arrange an on-site conference among the NACC, the contractor, and the applicant to ensure that all of the Conditions of this Order are understood. This Order also shall be made a part of the contractor's written contract. 26. The applicant, or its successors, shall notify the NACC in writing of the identity of the on--site construction supervisor hired to coordinate construction during the work on the site and to ensure compliance with this Order. Commencing with the issuance of this Order, and continuing through the existence of same, the applicant shall submit to the NACC a written progress report every four (4) months detailing what work has been done in or near resource areas and what work is anticipated to be done ovEr the next period. 28. -All construction work shall conform to the Erosion Control Plan and Construction Sequence/Schedule noted above in Condition #12a. 29. Prior to any activity on the site, a double row of staked hay bales shall be placed between all construction areas and wetland areas per Soil Conservation Service or D.E.Q.E. Standards. This barrier shall be inspected and approved by the NACC prior to start of construction. - This double row of hay bales shall remain intact until all disturbed areas have been mulched, seeded, and stabilized to prevent erosion. 30. The applicant shall have on hand at the start of any soil disturbance, removal or stockpiling, a minimum of thirty (30) hay bales and sufficient stakes for staking these bales. Said bales shall be used only for the control of emergency erosion problems, and shall not be used for the ' normal control of erosion, as described in the Erosion Control Plan submitted with the Notice of Intent or the hay bale barrier described in Condition #29. 31. Upon completion of construction and grading, all disturbed areas located outside -resource areas shall be stabilized permanently against erosion. This shall be done eith'sr by sodding, or by loaming, seeding, and mulching according to Soil Conservation Service standards. ' If the latter course is chosen, stabilization will be considered once the surface shows complete vegetative cover has been achieved. 32. No exposed area shall remain unfinished for more than seven (7) •days, unless approved by the NACC or ,its agent. 33. After proper grading, all disturbed areas located within a resource area which will not remain as wetland areas, shall be loamed and seeded with not less than four (4) inches of good quality loam. Before seeding, ground limestone shall be applied at a rate sufficient to bring the soil test to pH 6.5. In addition, 10-6-4 fertilizer, or its equivalent, shall be applied at a rate of fifteen (15) pounds per one thousand square feet, in accordance with Soil Conservation Service guidelines. 34. All, erosion prevention and sedimentation protection measures found necessary during construction by the NACC will be implemented at the direction of the NACC. 35. There shall be no stockpiling of soil or other materials within twenty-five (25) feet of any resource area. 36. During and after work on this project, there shall be no discharge or spillage of fuel, oil, or other pollutants into any wetland resource area. If during any phase of site preparation, construction, or clean-up, there is an unintentional spill or discharge of any fuel, oil, or other pollutant, the NACC shall be notified by the applicant as soon as practical. No vehicles are to be stored within 100 feet of wetland resource areas, and no vehicle refueling, equipment lubrication, or maintenance is to be done within 100 feet of a resource area. } -6- ORDER OF CONDITIONS LOTS 4 & 5 Cranberry Dane DEQE #242-469 37. Washings from concrete trucks, or surplus concrete, shall not be directed to, or dumped in, any drainage system or wetland resource area. 38. All waste generated by, or associated with, the construction activity shall be contained within the construction area, and away from any wetland resource area. There shall be no burying of spent construction materials on the site, nor shall any waste be disposed of on the site by any other means. The applicant shall maintain dumpsters at the site for the storage and removal of such spent construction materials off site. 39. Members of the NACC or its agent shall have the right to enter upon and inspect the premises to evaluate compliance with this Order of conditions. The NACC reserves the right to require, following field inspection, additional informa- tion or resource protection measures. 40. Accepted engineering and construction standards and procedures shall be followed in the completion of the project. OTHER CONDITIONS: 41. The provisions of this Order shall apply to and be binding upon the applicant, its employees, and all successors and assigns in interest or control. 42. Issuance of these conditions does not in any way imply or certify that the site or downstream areas will not be subject to flooding, storm damage, or any other form of damage due to wetness. 43. A proper bond or a deposit of money or negotiable securities running to the Town of North Andover shall be provided in the amount of $6,000 which shall be in all respects satisfactory to Town Counsel, Town Treasurer, and the NACC, and shall be posted with the Treasurer of the Town of North Andover before commencement of work. Said bond or deposit of money shall be conditioned on the completion of all Conditions hereof, shall be signed by a party or parties satisfactory to the NACC and Town counsel, and shall be released after com- pletion of the project, provided that provision, satisfactory to the NACC, has been made for performance of any Conditions which are of a continuing nature. The applicant may propose a bond release schedule keyed to completion of specific portions of the project for the NACC's review and approval. This Condition is issued under the authority of the Town of North Andover Wetlands Protection Bylaw. 44. Prior to the issuance of a Certificate of Compliance, the applicant shall submit a letter to the NACC from a registered professional cavil engineer that the work is in compliance with the plans referenced above and all the Conditions hereof. The NACC will not consider the wetland replacement areas as in compliance until at least two growing seasons after their initial planting.
