Kindred Re: Lot 1, Cranberry Lane North Andover, MA Bear Ban, At the North Andover Planning Board meeting of October G, 1988, the Board expressed concern relative to the development of Lot N1 and the drainage r effects from the lot. As per the boards Request, we have reviewed the drainage ' calculations for the subdivision to determine the effect of the development of Lot N1 relative to the overall drainage of the subdivision. Upon review of the subdivision plans, it is evident that a larger house than that shown has been constructed on Lot III and that the lot grading is somewhat different, A watershed divide was proposed on Lot 111. It was the intent of this divide to shed a certain portion of water to Cranberry Lane and to the Arcidiacono land. The subdivision elan shows this divide to be located closer to Cranberry Lane than the divide created by the development of Lot N1. NELSON, DIRECTOR December 2, 1988 Mr. Peter Caurso 1 Elm Square Andover , MA 01810 Re : Lot 1 Cranberry Lane Dear Peter: The Planning Board discussed the above cited lot during their December 1, 1988 meeting, relating to site improvements and their compliance with the approved subdivision. Staff has contacted Mr. Pat Cone , owner of the lot and he has stated that no abutters have discussed the problems described in my correspondence to him, with the exception of the stone wall . This was very disturbing to staff and T recommended to the Board to drop this matter since it is essentially a disagreement between private individuals which one side of the issue has not even contacted the owner of the property involved. The Board concurred with my comments and this matter is closed as far as the Planning Board is concerned. In the future, T suggest discussions take place with the individual owners of the property involved, prior to bringing the matter to the Planning Board in an attempt to mediate the dispute . This is not only a courtesy expected by the property owner, but follows staff policy that the Board should be the Last resort in these matters when all other attempts to resolve the issue fail, not the first course of action. As you remember various hemlock trees and rhododendrum shrubs were removed for the installation of a large jungle gym by the occupants of the home on Lot One. At the time this occurred I notified both your Board and the Building Inspector's office, but for whatever reason no remedial action was taken. The home is now empty and the jungle gym has been removed. In our conversation today you assured me that when the developer requests a return of his bond the Board will at that time insure that the shrubbery and trees are replaced. I have enclosed a photocopy of that portion of Cranberry Lane and have highlighted in orange the specific area in question.
