CONTINUED PUBLIC HEARINGS
335 Salem Sheet,JCE Property Development,LLC: Continued to 10/15/2024.Application for a Watershed Special
Permit under Article 4 Part 5 and Article 10 Section 195-10.7 of the Zoning Bylaw to authorize construction of a new single-
family house, infrastructure, and site grading on an undeveloped lot within the Non-Discharge Zone and subsurface drainage
within the Non-Disturbance Zone of the Watershed Protection District. The property is located in the Residential 3 zoning
district.
1250 Osgood Street, 1250 Osgood St LLC: Continued to 10/15/2024.Application for a Limited Site Plan Review Special
Permit,and Site Plan Review and Parking Special Permit Wunder Article 8 Supplementary Regulations, Part 3 Site Plan Review
[Site Plan Review],Article 8 §195-8.17.1 [Limited Site Plan Review],Article 8,Part 1, §195-8.8 [Parking Special Permit],
and Article 10 Administration §195-10.7 of the North Andover Zoning Bylaw.The applicant proposes razing of existing
building and related improvements,and the redevelopment of the property into a 2/3 story building of approximately 21,145
SF in size.Now building to be used for a child care facility and associated play areas, along with medical office uses and other
uses as may be allowed under the Zoning Bylaw.Property is located in tine Industrial 2 zoning district.
Great Pond Road (across from 1936 Great Pond Road),Jamie Veillette, Environmental Partners on bel€alf of the
Town of North Andover: Continued to 10/1/2024.Application for a Watershed Special Permit under Article 4 Part 5 195-
4.19.0 and Article 10 195-10.7 of the Town of North Andover Zoning Bylaw. Applicant proposes site improvements
including demolition of tine existing bituminous concrete boat launch,retaining wall,and gravel parking area. The work
includes construction of a new]land carry boat launch,Mechanically Stabilized Earth block wall,permeable paver parking
area and driveways, two bioretention areas,and tree plantings.The property is located in the Residential I (R-1)zoning
district.
DISCUSSION ITEMS
1101 Turnpike Street,Michael Mullaney,VP Mckenzie Engineering o€€ behalf of National Grid: Request for Waiver of
Site Plan Review in accordance with§195-8.11.D to allow for construction of a"pole barn"(accessory structure)at National
Grid's Electric Operations Center. A"pole barn" is a three-sided,roofed structure and the purpose is weather protection for
electric service bucket trucks.
J. Enright: The proposed location is tine westerly property border at an existing paved area where bucket trucks currently park
when not on service calls. There would be no change to in use or operations at the site resulting from tine pole barn once
constructed. Utility service vehicles would continue to circulate around the site in the same manner and park in the same
location.There should not be any impact within the site and in relation to adjacent properties and streets,on pedestrian and
vehicular traffic, public services, environmental,or community needs.Tile proposed location is approximately 700 feet from
Rt. 114,and not visible from roadway.There is an existing mature tree buffer approximately 135' at the rear of the site.The
project has been permitted through the Conservation Commission,which issued all Order of Conditions that address
stormwater management and erosion control. A variance request for rear setback and landscape relief will be heard at the
October 8th ZBA meeting.The site is located in the Industrial 1 zoning district and abuts the Residential 2 zoning dist:ict.
They are frilly permitted through Conservation for the stormwater piece of it because it's within riverfront.They subsequently
filed for a real,set back variance with ZBA. Where the proposed structure is only 3-sided,I questioned whether this would be
considered gross floor area.Tile Zoning Enforcement Officer's response was that structure consists of 3,060 s.f. of gross floor
area. Any structure over 2,000 s.f of gross floor area requires Site Plan Review of a Waiver of Site Plan Review.
E. Goldberg: Stated that the structure appears to be a carport and that it seems a waiver is appropriate,

MOTION: S. Kevlahan made.a motion to approve the Waiver of Site Plan Review for the pole barn. We find it meets the
criteria;there is no change in use or circulation,no added parking,no additional pedestrians and no impact to neighbors. J.
Simons seconded the motion.The vote was 5-0, unanimous in favor.

1101 Turnpike Street, Metrowest Realty, LLC: Application for a Land Disturbance Permit in connection with proposed
construction of a parking lot expansion at the Merrimack Valley Operation and Maintenance Facility(National Grid).The
project consists of repaving and restriping of an existing parking area,a parking lot expansion,stormwater and ancillary
landscape improvements retaining wall,and utility improvements to support its use. The property is located in the Industrial I
zoning district.
J. Enright: Based on concerns raised at the 9/10/24 meeting the plans were revised/updated(Sheet C4.01)to reflect Grading,
Drainage&Utility Plan to add a 2-3 ft.berm between Turnpike St,and the new parking area and has revised(Sheet L1.01)
Planting Plan to add an additional nine Eastern Red Cedar and six additional White Spruce to improve the landscaped
screening of the Site improvements.Storrnwater review is complete.The draft decision conditions additional test pits in the
basin. The peer reviewer asked the Board discuss with the applicant the proposed removal of potential ledge if large areas
require removal to install the gravel wetland. Showed the new bean and additional plantings.
J. Simons: Questioned the process in place for dealing with ledge, if encountered in the field.
K. Staffier: If ledge is encountered,it will need to be removed. If it cannot be removed by mechanical means and has to be
blasted,we would have to go through the processes set forth by the town; doesn't anticipate this.
E. Goldberg: Suggested a condition be included in the decision.
J. Enright: Suggested they'll have to meet code and Building Commissioner requirements pertinent to ledge removal.
MOTION: S.Kevlahan made a motion to close the public hearing for 1101 Turnpike Street,Metrowest Realty,LLC. J.
Simons seconded the motion.The vote was 5-0,unanimous in favor.
MOTION: S.Kevlahan made a motion to approve the Land Disturbance Permit,as amended. J. Simons seconded the motion.
The vote was 5-0,unanimous in favor.
MELTING MINUTES: Approval of September 10,2024 meeting minutes.
MOTION: P.Boynton made a motion to accept the minutes for September 10,2024, S.Kevlahan seconded the motion.The
vote was 5-0,unanimous in favor.
Auroral Lake ClearlUp Day:
J. Enriaht: Annual lake cleanup is scheduled for next weekend 10/5/24 at 9:30 a.m.;meet in the Steven's Pond Parking lot.
P.Boynton: Residents with boats are especially helpful with cleanup of the lake shorefront.
ADU update:
E. Goldberg.: Questioned when ADUs will be discussed.
J. Enright: Recently attended two webinars where a representative from KP Law presented;invited this attorney to attend the
10/15/2024 Planning Board meeting for discussion;requests Board watch webinar recording prior to that meeting.
E. Goldberg: This came up at the MVPC meeting;encourages public to submit questions.
J. Enright: The Housing&Livable Community Group is establishing a website with frequently asked questions. It's probable
they will issue guidelines. Law goes into effect February 3,2025;people can submit building permits as of that date.As long
as we advertise the public hearing for an ADU bylaw any building permit issued prior to Town Meeting approval is subject to
the approved bylaw(assuming Town Meeting approves of it). My understanding is that the Building Commissioner can
require retroactive compliance with the bylaw.The advertising target date is mid-January 2025,allowing this Board to open
the public hearing at the 2/4/2025 Planning Board meeting.
E. Goldberg:That gives us three months to craft something concrete.
