Special Meeting - 2 Hearings
The BOARD ~F APPEALS held a Special Meeting on Monday evening, March 18, 1968
at 7:30 P.M. in the Town Office Building Meeting Meeting Room. The following
members were present and voting: Daniel T. 0'Leary, Acting Cheirm~, Arthur Dru~aond,
Secretary, John J. Shields, Donald J. Scott and Associate M~_mber Robert J. Burke.
Chairman Deyo vas unable to attend due to illness.
There were 14 people present for the hearings.
1. ROY R. FARR:
Mr. Dr~--~nd read the legal notice in the appeal of Roy R. Fart who requested
a Special Permit under Sec. 4.7 of the Zoning By-Law so as to permit the
struction of fifteen garden type apartment buildings, each containing not more than
t~elve dwelling units, as shown on site plan filed herewith, and conformtml with the
provisions of S. 4.73 of said By-Law and such conditions as may be t .reposed by the
Board; on the premises, located at the west side of Chickertng Road as shown on the
Site Plan filed.
Atty. Stephen LoPiano, Jr. represented the petitioner. The engineer was also
present. Atty. LoPiano explained that this wot~ld be extending a~ area that has
already been developed into apartments. The proposed apartments would be of the
same type as the ones already constructed. The town would benefit greatly because
the developer would be paying approximately $45,000 in additional taxes per year.
Mrs. Devine and Richard ¢o0o were recorded as being opposed.
The Board ~bers recon~nended that certain chA~es be made on the plans so that the
layout of the bntldtn~s and parking spaces would be more in conformity with the
layout and size of the lots.
Mr. Burke made a motion to take the petition under advisement. Mr. D~.~ond
seconded the motion and the vote wes unanimous.
2. VILLAGE LAND COMPANY:
Mr. Dlwe~-ond read the legal notice in the appeal of Village Land Co~paUy
requesting a variation of Sec. 6.2, 6.41 and 7.3 of the Zoming By-Law so as to
permit .the division of land with existing buildings thereon for the purpose of
conveyance, on the premises, located at 2-16 Bixby Ave., 3-33 Bixby Ave., 25 & 27
Clarendon Street, 14-46 Pleasant Street and 25-113 Pleasant Street.
Arthur Morrow represented Village Land Company, who explained that the houses had
been in existence for many years prior to zoning on land owned by Village Land
Company. Now the company desires to divide the land with the existing houses into
separate lots for the purpose of conveyance. Tn ma~ instances, the houses would
be conveyed to present tenants. ~oseph Esposito, Registered Land Surveyor, was
also present and further explained the division of the land. There wes no
opposition to the petition.
Mr. Shields made a motion to take the petition under advisement. Mr. Burke seconded
the motion and the vote was unanimous.
The Board then discussed and voted on the petitions.

1. Village Land Company:
.The Board discussed and voted on the petition. Mr. Shields made a motion to
GRANT the variance. Mr. Drummond seconded the motion and the vote was un~.' us.
The reasons for approval are as follows:
1. Approval will in no ~ay he detrimental to the character or adversely influence
the neighborhood.
2. Approval of the application does not derogate from the intent and purpose of
the Zonim~ By-Law.
3. Denial of said application would result in hardship, both financial and
otherwise, to the applicant.
4. There were to be no physical cha~ges to the properties or buildings in question.
The B~ard signed the necessary pla~s.
