The North Andover Planning Board has voted to APPROVE 'said plant subject to the
following conditions:
1. That the record owners of the subject land forthwith execute ,and record
a "covenant running with the land"t or otherwise provide security for the con-
struction of ways and the installation of municipal services within said sub-
divisiont all as provided by G.L. c. 41# S. 81-U.
2. That all such construction and installations shall in all respects
conform to the governing rules and regulations of this Board.
3. That, as required by the North Andover Board of Health in its"report to'
this Boards no building or other structure shall, be built or placed upon Lots
No. as shown on said Plan without the prior
consent of said Board of Health.

In the event that no appeal shall have been taken from said approval within
twenty days from this date, the North Andover Planning Board Will forthwith

Conditional Approval
The following information shall be placed upon the plans prior to
the Planning Board signatures and filing with the Registry of Deeds
Office:
1 . The Planning Board hereby grants the waiver request for the
length of the dead-end roadway. ( 500 ' required, 1, 350 ' shown) .
The Board grants this request for the following reasons :
a) Proposed roadway runs up to a property line future extension
is possible.
b) Subdivision is located in an R-1 ( 2 acre) Zoning District
which requires 175 ' of roadway frontage. A hardship would
be imposed upon the applicant if only 500 ' were allowed.
c) The location of a large utility easement ( 200 ' wide) further
limits the available frontage for a house lot: Since no
structure can be placed within the easement .
d) The shape of the parcel precludes a looping roadway system.
In addition no wetlands or steep topography exists on the
site which would warrant altering or shortening the roadway.
2 . Bruin Hill Road shall be realigned in order to provide 50 ' of
frontage to the land of Lewis . This will enable the roadway to
be expanded and provide access into the land of Lewis in the
future . A deed shall be filed with this subdivision plan to
°grant access to the roadway to land of Lewis .
3 . Landscaping shall be shown on sheet 7 for Lot 0 along the roadway
and side property line which abutts land of Dellorfano which shows
two .rows of alternating evergreens 4 ' high planted 20 ' on--center .
The plantings shall be shown along the entire length of the lot
lines .
4 . The Board refuses to waiver the requirements calling for a side
walk to be placed within this subdivision. The plan shall clearly
indicate that a sidewalk shall be placed along one side of the
roadway.
5 . Proof of notification to Town officials in Boxford that this
development has been approved by this Board, which would allow
a roadway connection to a potential development on land located
in that Town.
6 . '' Revised drainage calculation which shows the mitigation of runoff
for this subdivision in accordance with the subdivision rules and
regulations .

The following information shall be placed upon the c(N,@bIII AH-t E%f
the subdivision plans filed with the Registry of Deeds Office-

1 . The: 100 year flood elevation and wetland boundaJu�ry to be indicated
on the subdivision plan, as approved by the Conservation Commission .
2 . All septic system designs be approved by the Board of Health
prior to a building permit being issued for any lot within this
subdivision.
3 . That all homes located in this subdivision be residentially
sprinklered in accordance with the NFPA 13D and the requirements
of the North Andover Fire Department.
4 . Any changes on the plans required by the North Andover Conservation
Commission may be subject to modification under Chapter 41 by the
Planning Board .
5 . All gate valves shall comply with AWWA Specifications L500 52T
supplied with 100 lb. sliding type gate box marked "WATER" .
6 . The applicant shall supply the Town with two t2 ) traffic signs
in conformance with Uniform Traffic Control Manual page 6B--19
which say: "Caution Construction Vehicles in the Area" . These
signs shall be posted during the construction of this subdivision
by the North Andover Police Department.
7 . All lot numbers shall be posted during construction.
8 . Permanent house numbers shall be posted on the dwelling prior to
occupancy.
9 . Prior to occupancy of any homes in this subdivision a binder coat
shall be applied to the roadway.
10 . Prior to releasing any security, all drainage and detention ponds
shall be installed, loamed and seeded, and certified from the
design engineer with As-Built Plans detailing that all drainage
is in conformance with the Definitive Plan.
11 . Tree cutting shall be kept to a minimum throughout the project
in order to minimize erosion and preserve the natural features
of the site. Accordingly, the developer shall submit a tree
cutting and reforestation plan to be reviewed by the Planning
Board. This plan shall explicity include specific trees to be
retaianed . Also, the developer shall inform the Town Planner
when significant tree cutting is to occur in order that the
Planner may determine the need to be present. A $20 , 000 bond
shall be placed on this subdivision to insure that this condition
is adhered to by the developer .

13 . The contractor shall contact Dig-Safe at 1-800-322-4844 at
least 72 hours prior to commencing any excavation.
14 , . Gas , telephone, cable and electric utilities shall be installed
as specified by respective utility companies .
15 . All catch basins shall be protected with hay to prevent
siltation into the drain lines during road construction.
16 . No open buring is to be done except as is permitted during
buring season under Fire Department Regulations .
17 . No underground fuel storage facilities will be installed except
as may be required by Town Regulations .
18 . The Town' s Phase Development Bylaw applies to this subdivision
(Section 4 . 2 of zoning Bylaw) . The house lots closest to Winter
Street shall be developed first..
19 . School bus stop signs shall be established at the intersection
with Winter Street should the School Department require a bus
stop at this location.
20 . The following standards and requirements of the DPW shall apply
to this subdivision:
a. The water main on Bruin Hill Road shall be 8" pipe installed
10 feet left of the centerline of the road from the existing
water main in Winter Street to the end of the cul-de-sac .
b. An 8" tapping sleeve and valve shall be installed at the
connection to the existing water main on Winter Street.
Eight inch gate valves shall be installed at station 17 + 0
and 13 + 30 of Bruin Hill Road.
C . Hydrants are to be installed at station 4 + 30 , 8 + 25, and
13 + 25 .
d. No certificate of occupancy shall be issued for any structure
built within this subdivision without the approval of the DPW.
Such approval will include as a minimum that the roadway can
be serviced in the winter months and that the water facilities
are connected and can . be used.
e. There shall be no driveways placed in the location where catch
basins or stone bounds are to be installed. ' It shall be the
developers responsibility to insure against such instance
even if lots are sold to others after lot releases .
f . Adequate public liability and property damage insurance as
well as a street opening bond in an amount satisfactory
to the Division of Public Works must be provided for any
work in Winter Street. The applicant shall obtain a water
main extension permit prior to making the connection to the
town water system. No permits will be issued until a complete
set of signed plans showing up to date revisions is on file
at the Division of Public Works .
The following plans are deemed approved by this decision:
