RE: Evergreen Estates Definitive Subdivision
I have reviewed the definitive subdivision for Evergreen
Estates dated December 28, 1994 and have determined the
following:
Those lots which have sufficient testing, (ie, two
acceptable deep holes and two passing percolation tests per lot)
are lots 1, 2, 19, and 14 . Lot 16 would also have adequate
testing if the lot line between 16 and 15 were moved.
There has been a great deal of soils testing on this site.
The low number of acceptable lots is due primarily to a huge
amount of large rocks and boulders which renders the areas
unsuitable for septic systems. In addition, some of the test
pits located on this definitive plan are unlabelled, so it is
impossible to determine what the soils information is for those
pits.

RE: Evergreen Estates Soil Vests
There has been a large amount of additional soils
testing out at Evergreen Estates off Salem Street . Based on
the criteria of passing percolation tests and four feet of
parent material observed in the deep holes, the following
lots appear to be acceptable for septic system installation:
Lots 1, 2, 3, 4, 5, 7, 8, 10, 11, 14, 15, 16, 17, 18, 19,
20, 22 . 1n addition, Lots 12 and 21 look okay so far; they
need an additional passing percolation test . Lots 6 and 13
have no passing percolation tests at this point, and Lot 9
has no soil tests at all .
There is still the concert: with the large amount of
rock on the site which may interfere with the amount of
parent material available for leaching . Because of this
concern, the Board of Health must stipulate that prior to
our signoff on any Form U for any individual lot in this
subdivision, the leaching area for that lot must be
completely excavated to insure that there is the requisite
four feet of parent material present throughout the entire
location proposed for the leaching area.

RE: Lot Status at Evergreen Estates
As you are aware, I met with personnel from Christiansen and Sergi Engineering on July
26"`to discuss specific lots at Evergreen Estates relative to the proposed septic systems.
The following conclusions were reached:
• Lots 3A, 7, 8, 10, 11, and 15 can be signed off by Health at any time,
• The leaching area on lots 4, 5, 6, 14, 16A, 18, 19, and 20 must be excavated prior to
Form U signoff from the Board of Health,
• Further testing is required on lots 1, 2, 12, 13 and 21.
• Revised plans are to be submitted for lots 17 and 22, When these plans have been
approved, both of these lots can receive their Norm U signoffs from Health.

RE: Status of Evergreen Estates
As a result of further plan approvals and the excavation of two of the lots at
Evergreen Estates, the Form Us for the following lots have been signed and
approved by the Board of Health. I believe that the Planning Board's condition #4b
of the Definitive Plan Approval dated January 17, 1995 has been net for these lots.
Lots 3A, 7, 8, 10, 11, 14, 15A, 16A, 17 and 99.
Additional soil testing had been scheduled for the week ending September 140, for
Lots 1A, 2A, 12, 13 and 21.
The leaching areas for Lots 4,5, 6, 18, 19 and 20 have not yet been excavated.

Because of the logistics involved in opening septic bed bottoms and the phased-in building
development new bylaw, the Board of Health would like to request a modification of
Planning Board condition 4B for Evergreen Estates. In essence, this change should offer
the same protection to all parties as the current one and it is more easily managed. The
requested change is as follows;
There shall be a note recorded on the deed for each pertinent lot, i.e. Lots 4, 5, 18, 19, &
20, that the septic system for each individual lot shall be installed, inspected and approved
by the Board of Health in accordance with all state and local regulations before
construction of the primary building is begun. Construction includes the pouring of
foundation walls.
This statement shall be recorded on the deed for each lot and a copy filed with the Board
of Health and the Planning Board before Form"U" signoff.
Hopefully this change will simplify the process in dealing with the remaining lots of this
subdivision.

Due to the problems recently encountered on multiple lots on Evergreen Estates, the Board of Health at
their meeting on October 29, 1997 voted unanimously to require bottom of bed inspections OT full septic
system installations on each lot in this subdivision before any construction, including foundations, is begun
on that specific lot. The majority of lots already have Form U approvals from the Board of Health so it AU
be up to the Building Department to route all requests for construction approvals at Evergreen Estates to
the Health Department for proper action on the septic system issues. I suggest that once a bed bottom has
been inspected and approved(or a septic system fully installed), the attached form will be sent to the
Building office. I hope this procedure will meet with your approval,

I had occasion to be out at Evergreen Estates for an inspection today and noted that there are no
guard rails or any other type of safety barrier over the culvert that lies underneath the road into the
subdivision. The depth of the drop off is roughly 10 to 15 feet. Since there are children of school age now
living in the subdivision, this lack of a barrier appears to be a dangerous safety hazard.
As I understand it,issues of this type lie within the scope of DPW at this stage in a subdivision's
development. I am,therefore,sending you this letter in the hopes that you will respond in your usual
efficient manner and remedy the problem. Please feet free to call me if you have any questions.

RE: Wetland Replication - Evergreen Estates Subdivision (DEP #242-743).
Dear Mr. Couillard:
As you are aware, approximately 10,000 square feet of wetland replication is required for the above
referenced subdivision filing. Work specific to this area has not been carried out as of May 6, 1996. 1
offer the following comments:
• The Massachusetts Wetland Protection Act Regulations and the North Andover Wetland
Regulations each respectively require that"in-kind" replication be provided when a
resource area is scheduled for alteration. The area, as approved by the North Andover
Conservation Commission (NACC) and depicted on the approved plans referenced in the
Order of Conditions, appears to be designed primarily as a detention/retention area
versus a Bordering Vegetated Wetland (BVW). Please provide an "interim As-Built"
depicting existing grades and total square footage of the area in question. In addition,
please submit a cross-section verifying that"in-kind" grades are being satisified;
• Dependent upon the findings of the"Interim As-Built', please initiate the planting
schedule as approved by this Department, Schedule accordingly with Mr. Steve D'Urso
and myself so that proper supervision and monitoring can be provided during
construction.
Please forward the above referenced plan to this Department no later than Wednesday, May 15, 1996,
