We have a serious concern regarding flooding. As you know by looking at the plans for this project, Boston Brook runs behind all the abutters' homes on Salem Street. During heavy rains and melting snow, the brook overflows to the point where it encroaches upon our home. Our concern is that any changes in grades to this land will cause more water to flow into our property and quite possibly even into our home. We would like to request that a site visit be made by the Conservation Commission to see how serious this problem could become. Also of concern is a privacy issue. MA 01852 Re: Landscapingat Evergreen Estates Dear Mr. Couillard, As the roadway at Evergreen Estates is now complete to the binder stage, I request that you plant the landscaping screen between the roadway and the boundary with land owned by Ian and Denise Dannis as required by Condition 7(a) of the subdivision approval, This condition requires you to screen this property per agreement with the Dannis' as approved by the Town Planner. Please let me know when you have agreed upon a landscaping design with Mr. and Mrs. Dannis and when you will begin the work. I would like to have the work completed as soon as possible, and at a minimum completed by the end of this growing season. If you have any questions please call me at 688-9535. From my understanding, the biggest concern is as to when the final coat of the road will be completed. Can you please provide me with a construction schedule as to when this work will be completed by June 30, 2000 so that I may update both the neighbors and the Planning Board as to the status of completion of this subdivision? The development has the final two houses nearing completion and myself and many of my neighbors feel it is time to complete the construction of the roads and sidewalks in our neighborhood. The sidewalks have been damaged via the construction projects in the neighborhood and they present a safety hazard to the numerous children in the neighborhood that use them. The curbing is also in need of repair in numerous areas. The road and sidewalks need a finish coat of asphalt to finish the project. I was told to write you this letter to begin the process that is needed to bring the Evergreen Project to a completion. I am willing to meet with you and the contractor on site if necessary to move this process along. My phone number is 725-9412, I appreciate your help in bringing this matter to conclusion and look forward to hearing from you when you have some answers as to when this project can get moving towards completion. At the end of the meeting,Mr, Coulliard indicated that he would be pursuing the completion of the subdivision in the next few weeks,including fatal paving, He also indicated that he would be seeking road acceptance this fall; however, I feel that the Town Meeting in spring 2001 is a more realistic date for road acceptance: I have written this memo in response to questions raised by residents within the Evergreen Estates Subdivision. The.residents have expressed concerns over the lack of progress and the answers they are receiving from this office and Planning. Apparently,Mr. Coulliard has not been doing any work since the meeting of September 11. The remainder of work will be completed in mid June 2001. This information is being forwarded to the residents to alleviate their concerns regarding the subdivision. The Planning Department looks forward to receiving the documentation for street acceptance in the near future. The original subdivision approval of I994 required a no cut zone of 25' alorig'the rear and- ' side of your property. At some point in the past,this area was cleared. It appears that no enforcement action was taken at the time and no mitigation has occurred. As a result there is no plant life to cut,presumably other than grass. Your request involves the installation of a tennis court partially within this 25-foot no cut zone. While a tennis court will obviously prevent the restoration of forestry, the time periods involved and natural processes rcquired to bring back mature forest flora are beyond most modern landscaping efforts. From a strict interpretation of the decision,your proposal involves no"cutting". In addition,the restoration of forested areas to the site would take generations. As such,your current proposal does not violate the approval condition and your offer to provide a minimal buffer with new landscaping actually improves the existing situation. I request that you try and provide as much distance as possible to the property boundary to allow for reasonable planting opportunities, Such an effort provides for a more balanced solution. Although I support this issue from the Planning Department's perspective,I am unable to comment on any language that may be present in your deed or privately placed restrictive covenants that may relate to your project,which is a private real estate matter. As Clay requested, I have diagrammed where the tennis court will be located on the property and have agreed to landscape around the perimeter of the court abutting the State Forest in order to prevent any erosion.
