The applicant provides a certified copy of the recorded easement granting the cul-de-sac to the Town of North Andover and the easement be reviewed to ensure there are no potential problems. 2. The spot elevations and existing C.R. rim elevation, at the end of the circle, do not appear on the same datum as the rest of the plan. They should be corrected. 3. The outlet for the foundation drain is very close to a property line. Will this cause a problem for the adjacent landowner? The plan does not provide any worthwhile information on the adjacent lot some detail needs to be added. 4. An as-built plan,with elevations, should be required. 5. The applicant will need the following permits to secure and fees to pay to this department: A. Driveway permit B. Water connection Permit and fee C. Sewer connection permit and fee D. Sewer Mitigation Fee If these comments are addressed we feel that the plan is satisfactory. The Planning Board requested that the applicant obtain a letter from the Building Commissioner indicating that the lot was grand-fathered. The enclosed letter fi-om the Building Commissioner e states the contrary. The applicant is going to ask the Building Commissioner to ref r the matter to Town Counsel. No subdivision approvals should be granted without written confirmation from either the Building Commissioner or Town Counsel confirming the grand-fathered lot status. The proposal entails a driveway being built off the Booth Street cul-de-sac in the roadway of Wallace Street to the lot. I believe a better configuration would be more of an angled approach onto the lot so less of the driveway would be constructed within the right of way. My concern is if Wallace Street was ever upgraded the driveway would need to be paved over. However, the lot across the street has somewhat of the same driveway configuration. The proposal includes a sewer main coming down Saville Street to provide sewer to the lot. The driveway is approximately 12' in width and will contain an 8" gravel sub-base with 2 '/2of binder coat and I" of top coat. This proposal will require a Notice of Intent as the driveway will be built within 100' of wetlands. RECEIVED 10 Ledge Road Atkinson,NH 03811 SEP 2 4 2001 RE: Wallace Street,North Andover, MA NOYA' OVDEPARTMENT Dear Mr. Thibeault: The proposed changes we reviewed today are NOT acceptable, All permits issued by this department have been based on the approved subdivision plan. If the work is not done in accordance with said approved plans it will automatically void your existing permit and put in jeopardy your privilege to work in the Town of North Andover. Also, all illegal construction work installed will have to be removed by you at your expense. These changes also effect the subdivision approval granted by the planning board. They will VOID the existing approval. I am notifying Heidi Griffin, Town Planner of the proposed changes and ask that they take appropriate action. The subdivision approval was granted on very specific plans and these plans cannot be changed on a developer's whim. Then there is the question of engineering. Are you a Professional Registered Engineer? New plans are need and they must be submitted to the Planning Board for their approval and also submitted to this Department for review and approval. A new road-opening permit will be needed and the existing one voided. Please remember that the existing permit is valid for the existing approved work only, If you have any additional questions please call.
