The undersigned hereby applies for the approval of said DEFINITIVE plan
by the Hoard, and in furtherance thereof hereby agrees to abide by the Doardrs
Rules and Regulations. The undersigned hereby furthor covenants and agrees
with the Town of North Andover, upon approval of said DEFINITIVE plan by the
Board:
1. To install utilities in accordance with the rules and regulations of the
Planning Hoard, the Public Works Department, the Highway Surveyor, the
Board of Health, and all general as well as coning by—laws of said Tows;,
as are applicable to the installation of utilities within the limits of
Kays and streets;
2. To complete said construct the atroots or ways and other %provements shown
thereon in accordance with Sections Iv and V of the Rules and Regulations
of the Planning Board and the approved DEFINITIVE plan, profilers and cross
sections of the same. Said plant profiles, cross sections and construction
specifications are specifically, by reference, incorporated herein and made
a part of this ,application. This application and the covenants and agree-
ments herein shall be binding upon all heirs, executors, administrators,
successors, grantees of the whole or part of said land, and assigns of the
undersigned; and
3. , To complete the aforesaid installations and const:ructi.on within two (2)
years from the date hereof.

a "covenant running with the land", or otherwise provide security for the con-
struction of ways and the installation of municipal services within said sub-
division, all as provided by G.L. c. 41., S. 81--U.

Dear Planners
Please find attached a submittal of the above-referenced Definitive
Plan together with forms and the required support information.
Please schedule a technical review committee meeting and a Public
Hearing at your earliest convenience so that the plans can be
presented.
Please accept the following waiver requests to your Rules and
Regulations
1. Right incoming rounding radius is 4 .99 feet instead of
30. 00 feet. This is necessary in order to eliminate the
wetland impact at the beginning of the roadway. The pavement
radii are normal, creating no actual impact.
2. Shoulders shall be loamed and seeded and shall be 51011 wide
instead of 1216" wide. This provision shall insure that
minimum tree clearing shall be done in accordance with the
Board' s Preliminary Decision.
3. The cover over the drainage at the entrance of the roadway
is 0. 88 feet. The minimum required is 30" . Ductile Iron Pipe
shall be used which has adequate strength. The existing
grades at the intersection prevent typical pipes to be
installed with sufficient cover.
4 . The cul-de-sac has been super-elevated, left to right, and
not crowned, in order to accommodate drainage flow without the
need for additional drainage.

5. Deep hole observation test pits have been performed. Now
that Conservation issues are resolved additional pert tests
have to be conducted. Tests will be conducted within 3 weeks.
6. Due to the size of this project the applicant is requesting
a waiver from preparing an environmental impact statement.

WHIPPOORWILL PARK, DEFINITIVE SUBDIVISION
CONDITIONAL APPROVAL
� . In accordance with Massachusetts General Law, Chapter 41,
Section 81W, the applicant has submitted a request for
rescission of the original Definitive Subdivision
application as approved on March 21, 1978 , and recorded in
the Essex North Registry of Deeds as Plan No. 7842 , entitled
"Scott Circle" . As part of this conditional approval the
Planning Board herein grants the recision as referenced
above. The conditions as listed in this document shall
supersede any previous requirements in the 1978 approval for
"Scott Carole" . EI'
2 . The applicant will be required to set aside certain land as
"Open Space: Conservation Land" . This land shall not be built
upon except as allowed by the Planning Board. The exact
amount of the conservation land being 3 . 37 acres and located
as shown on the Definitive Subdivision Plan entitled
"Whippoorwill Park" Dated November 14 , 1990 and revised
February 15, 1991 drawn by Thomas Neve, Registered
Professional Engineer. All documentation of said "Open Space
Conservation Land" shall be as approved by the Planning
Board prior to the endorsement of the record plans, and
shall be incorporated into the deed for each lot so
affected.
3 . The Board considers this roadway to meet the definition of a
Minor Street as found in the Rules and Regulations Governing,
the Subdivision of Land, Revised 1989 . The applicant will be
required to conform to all specifications for Minor Roadway
construction.
4 . The Planning Board herein grants the following requested
waivers to the Rules and Regulations Governing the
Subdivision of Land:
A. Right incoming rounding radius at 4 . 99 feet. The actual
pavement radii shall remain normal . This waiver is
granted in an effort to minimize the roadways impact to
the wetlands.
B. Shoulders at 5 . 00 feet in width. This waiver is also
granted in the best interest of the wetlands found
adjacent to the roadway.
C. The amount of cover over the drainage at the roadway
entrance to 0. 88 feet in depth. Ductile iron pipe which
has adequate strength shall be used
D. Super-elevation of the proposed cul-de-sac, Left to
right and not crowned. This waiver is granted in an
effort to accommodate drainage flow with the need for
additional drainage.

E. The Planning Board will accept test pit data with the
approval of the Board of Health.
F. Due to the size of the project the applicant will not be
required to submit an Environmental Impact Report.
G. The Planning Board will not require that sidewalks be
constructed in this subdivision.
5. Prior to any Lots being released, Bonds shall be posted to
ensure construction and/or completion of roadways, site
screening and other pertinent public amenities . These
bonds shall be in an amount as determined by the Planning
Board and shall be in the form of a Tri-Party Agreement, or
Pass Book.
5. An as-built plan and profile shall be submitted for review
and approval prior to the finial release of DPW bond money.
An interim as-built, certified by the design engineer,
verifying that all utilities have been installed in
accordance with the plans and profile shall be submitted
prior to the application of the binder coat of pavement. In
addition, all required inspection and testing of water,
sewer, and drainage facilities shall be completed prior to
binder course paving. To insure compliance with this
condition, a bond in an amount to be determined by the
Division of Public Works shall be posted prior to the
release of any lots within this subdivision.
7 . Any changes on the plans required by the North Andover
Conservation Commission may be subject to Modification under
Chapter 41 by the Planning Board.
8 . There shall be no driveways placed where stone bound
monuments and/or catch basins are to be set. It shall be the
developers responsibility to assure the proper placement of
the driveways regardless of whether individual lots are
sold. The Planning Board shall require any driveway to be
moved at the owners expense if such driveway is at a
catch basin or stone bound position. Certification by a
Registered Professional Engineer will be required prior to
the issuance of a Certificate of Occupancy.
9 . Throughout the Right of Way, tree cutting shall be kept to a
minimum in order to reduce erosion and preserve the
natural features of the site. Accordingly, a no cut line
shall be placed on the Definitive Plans and approved by the
Planning Board. The developer in conjunction with a
registered arborist, or other professional as approved by
staff, shall, submit a tree cutting and reforestation plan
consistent with the provisions of Section 5 . 8 of the North
Andover Zoning Bylaws ( The plan is for areas of substantial
cutting and .filling ) to be reviewed by the Planning .Staff
prior to the applicant receiving a permit to build on any

lot within the subdivision, This Plan shall explicitly
include specific trees to be retained. Also, the developer
shall inform the Town Planner when any tree cutting is to
occur in order that the Planner may determine the need to be
to be present.
10. In no instance shall the clearing of trees for the driveway
access to any lot be in excess of twenty (20) feet. The
driveway access area shall be flagged prior to construction
or site preparation for each individual :Lot and verified by
the Town Planner. Any excessive clearing shall be subject to
the provision of Section 5 . 8 of the Zoning Bylaw and
reforested prior to the issuance of a certificate of
Occupancy.
11. Gas, Telephone, Cable and Electric utilities shall be
installed as specified by the respective utility companies .
12 . No open burning shall be done except as is permitted during
burning season under the Fire Department regulations.
13 . No underground fuel storage shall be installed except as may
be required by Town Regulations.
14 . All drainage and sewage facilities shall be approved by the
North Andover Division of Public Works prior to the Planning
Board endorsing the record plans.
15. Prior to the release of any lot from the statutory covenant
the developer shall submit approved septic system designs to
the Planning Board and certify that the proposed grading of
said lot is in conformance with the Definitive Plan and
drainage calculations, and that said lot does not create
adverse flooding on an adjacent property.
16 . The contractor shall contact Dig Safe at least 72 hours
prior to commencing any excavation.
17 . Prior to a Building Permit being issued for an individual
lot, the following information shall be required by the
Planning Department:
A. A stop sign shall be placed at the intersection of the
proposed roadway and Forest Street. Further, temporary
signs shall be posted at 350 feet in either direction of
that intersection which read, "Caution, construction
Vehicles in Area. "
B. Lot numbers shall be placed on all lots prior to the
commencement of construction.
18. Prior to a Certificate of Occupancy being issued for an
individual lot, the following information shall be required
by the Planning Department:
