HISTORY AND BACKGROUND On March 16,2023,the Applicant's Project Engineer,Chi-is Emilius,P.E. of Brennan Consulting, requested a Waiver of Site Plan Review in accordance with §195-8.1 I(C)with respect,to the Applicant's proposed Middle School Extension Project. The Applicant proposes a 26,000 SF, 2-story classroom addition connected to the existing Southeast classroom wing adjacent to the existing school cafeteria. Paved drives and concrete sidewalks will wrap around the addition and blend into the existing drives and sidewalks of the existing facility. New plantings are proposed around the new addition along with paved play space adjacent to the cafeteria.Miscellaneous renovations throughout the existing Middle School are also part of the total construction project. FINDINGS Or PACT The Planning Board has made its decision based on the following findings: A. The property is within the Residential 4 zoning district and the Building Commissioner has determined the use is a non-profit educational facility,which is subject to MGL c. 40A Section 3 (Dover Amendment). B. The Town Engineer,J.Borgesi,will provide Project stormwater peer review services. C. The North Andover Fire Department has approved the submitted Swept Path analysis(see email correspondence from Lt. B. Kilcoyne dated March 21, 2023). D. Per the Applicant,the Project will have no significant impact either within the Site, or in relation to adjacent properties. Specifically, as detailed below,there will be no significant impact on: a. The local area street network,nor any street specifically will be impacted by the school addition. No additional students will be added, and the existing curb cuts and driveways will remain the same, All utilities to the addition will be provided by the existing building, hence no utilities will be needed fi•om the streets. ATTEST' AUlle Copy 495 Main Street Site Plan Review Waiver Page 2 of 5 b. Approximately 1,042 students attend the school, and that number is expected to stay the same. When determining the traffic impact,vehicular and pedestrian, in the case of school's trip generations is assessed based on the number of additional students. Therefore,there should be no impact to the local street network. c. Other traffic impacts include the following; all curb cdts and driveways will remain the same; the number of busses and vans will remain the same; Site circulation will remain the same; the startlend of school time will remain the same; the number of students walking will remain the same;the school grades will remain the same; and the administrative staff may increase slightly; however,the change is estimated at not more than 15 people, d. The proposed school building addition will not require additional public services or infrastructure. The purpose of the addition is to provide additional space for the same number of students. Consequently, no additional public services such as police, fire, emergency will be required. e. There are no wetlands,endangered species, or vernal pools in the area. The size of the Project does not trigger MEPA thresholds. The Project is not in 100 year flood zone and does not have a bordering vegetated wetland in the vicinity. f. The Project limits are within an existing school and will continue that use. The Project will not require the alteration of any unique or historical resources as it is currently as paved plan area and lawn space and will continue the same use after Project completion. g. The Project abuts an athletic field to the south southwest and an elementary school to the east. There is no impact to neighborhoods to the north as the Project scope is within the footprint of the existing school lot. CONDITIONS SPECIAL CONDITIONS E. The Project is in close proximity to other schools;therefore, • All temporary construction fencing shall be covered with a mesh screen. • Temporary fencing shall surround the entire construction area limit of work. • The contractor shall coordinate with the School Administration Officials regarding entering and exiting the Site through the Middle School entrance. • The Contractor shall communicate with the School Administration designee every afternoon when school is in session via email to provide a list of expected next day deliveries and approximate times. • . During the school year from August 15th to June 30th the contractor shall coordinate with the School Administration designee on a weekly basis and include them in all weekly scheduling and Site coordination meetings. • No parking shall be provided for Site users on adjacent residential streets at any time PRIOR TO LAND DISTURBANCL AND/OR ISSUANCE OF A BUILDING PERMIT F. Two(2)copies of the recorded Notice of Decision with endorsed plans attached must be submitted to the Planning Department. 495 Main Street Site Plan Review Waiver Page 3 of 5 G. The Applicant shall tv the existing drainage system before the design is finalized so any maintenance or repairs to the existing drainage system can be included in the final design(see email correspondence from J. Borgesi dated March 21, 2023), H. A NFPA 241 plan, detailing how the Applicant will safeguard this property throughout the entire Project(including access to the property during construction)shall be submitted to the NAFD along with the Building, School Department and Police Department(see email correspondence from Lt. B. Kilcoyne dated March 21, 2023). I. A 780 SMR Chapter 34 review(Investigation and Evaluation)should be submitted to ensure all current codes are met, including whether or not a BDA will be required(see email correspondence from Lt. B. Kilcoyne dated March 21,2023). J. The Sprinkler and Fire Alarm plans will be reviewed during the building permit application process(see email correspondence from Lt, B. Kilcoyne dated March 21, 2023). K. L. A pre-construction meeting must be held with the Applicant, Developer, Planning Department, Town Engineer, and School Administration representative. The purpose of this meeting will be to review the phasing of the development and for the Applicant to submit a construction sequencing schedule to all at the pre-construction meeting for the purpose of tracking the construction and informing the public of anticipated activities on the Site. M.. The detailed and dated sequence of construction shall include the installation of sedimentation/erosion control devised, Site clearing,drive aisle construction,drainage installation, and all other work planned through final stabilization. N. Once online, all catch basins and any other stormwater inlets on the Site or within 100 feet of the Project shall be protected by silt sacks to prevent sediment from entering the drainage system. Silt sacks shall be maintained and regularly cleaned of sediments until all areas associated with the work permitted by this decision have been permanently stabilized and the Planning Department has formally approved their removal. DURING CONSTRUCTION O. Dust mitigation must be performed weekly, or more frequently as directed by the Planning Director, throughout the construction process. A water truck shall be located on Site to mitigate dust impacts, if needed. P.. Any stockpiling of materials (dirt, wood, construction material, etc.) must be shown on a plan and reviewed and approved by the Planning Director. Any approved piles must remain covered at all times and fenced off to minimize any dust problems that may occur with adjacent properties. Q., It shall be the responsibility of the contractor to assure that no erosion from the construction Site shall occur which will cause deposition of soil or sediment upon adjacent properties or public ways,except as normally ancillary to off Site construction. R. Coordination of delivery times shall be completed the ensure that no queuing of construction vehicles on Route 125 ever exists. No construction vehicles will be permitted to use the side streets abutting the Site for access or egress at any time. 495 Main Street Site Plan Review Waiver Page 4 of 5 j ' 11 S. Any fill used.in connection with this Project shall be clean fill (natural materials only), containing no recycled materials,trash,refuse,rubbish or debris, including but not limited to lumber,bricks,plaster, wire, lath, paper, cardboard, pipe, tires, ashes, refrigerators, motor vehicles or parts of any of the foregoing, T. All exposed soil finish grade surfaces shall be immediately landscaped (native plantings/seed mixes) and stabilized, or loamed, seeded and mulched, with a layer of mulch hay or matting (natural fibers only,no plastic netting).All disturbed areas must be graded,loamed and seeded prior to November Ist of each year. Outside of the growing season,exposed soil finish grade surfaces shall be stabilized with a layer of mulch hay or matting until climate conditions allow for seeding, During construction, any area of exposed soils that will be left idle for more than 30 days shall be stabilized with a layer of mulch hay or other means approved by the Planning Departmerit. PRIOR TO ISSUANCE OF A CERTITICATE OF OCCUPANCY U. Upon completion of the Project the Applicant will provide a signed statement indicating that no Illicit Discharges exist on the Site. V. The Applicant must submit a letter from the Project engineer stating that the building, landscaping, lighting and Site layout substantially comply with the plans referenced at the end of this decision as endorsed by the Planning Board and that the stormwater management structures are functioning as designed, Alternatively,the Applicant and/or Project Owner may provide a bond, determined by the Planning Board, to cover the full amount of the landscaping materials and installation if weather conditions do not permit the completion of the landscaping prior to the use of the Site. W. Prior to the issuance of the Certificate of Occupancy,the Applicant shall be responsible for cleaning all stormwater structures. X. The.Applicant must submit a letter from the engineer certifying that the lighting provided meets minimum Illuminating Engineering Society(IES)standards. Y, The'Planning Staff shall review the Site. Any screening as may be reasonably required by the Planning Staff will be added at the Project Owner's expense. GENERAL CONDITIONS Z. The contractor shall contact Dig Safe at least 72 hours prior to commencing any.excavation. AA. Gas,Telephone, Cable and Electric utilities shall be installed underground as specified by the respective utility companies, except for so-called "green utility boxes" as may be required by the utility companies, BB. Any plants,trees, shrubs, or fencing that have been incorporated into the Plan approved in this decision that die or fall into.disrepair must be replaced by the Project owner in perpetuity. CC. The hours for construction shall be limited to between 7:00 a.m.and 6:00 p.m.Monday through Friday and between 7:00 a.m, and 5:00 p.m. on Saturday. Construction employees shall access the Site between 6:3 0 am and 7:00 am Monday through Friday so as to arrive prior to the school drop-off time. Any work outside of these times shall be reviewed and approved by the owner, Construction Supervisor,North Andover School Administration,Planning Department,Police and Fire Departments. 495 Main Street Site Plan Review Waiver Page 5 of 5 DU No open burning shall be done axcept as is permitted during burning season under the Fire Department regulations. EE. The owner shall apply to the Board of Health for the appropriate dumpster permit, 1 FF. The provisions of this conditional approval shall apply to and be binding upon the Applicant, its employees and all successors and assigns in interest or control. GG. Any revisions to the Plans shall be submitted to the Town Planner for review.
